    I wouldn’t say “very common,” and particularly not in the context of marriage-based immigration.

    also not a great look if that info came out on AOS. They want you to join bank accounts, medical costs, insurance etc as evidence of  legit marriage

    As already mentioned, it is not the physician who is making the decision to issue the visa. It is the consular officer. The physician is simply doing his/her job on reporting health history.
     
    The thing you have to realize is that the US has no shortage of people who want to visit the US. So by not issuing you a visa it will not make much of a difference. Yes, casual use of cannibus and previous DUI's don't make you a bad person. But there are millions of people applying for a visitor visa just like you who have never had any of those issues.

    Moral turpitude is a legal concept that refers to any conduct that is believed to be contrary to the community standards of honesty, justice, or good moral values. It is up to the United States government to decide this in your case. Defining driving drunk as "silly" is not the correct word. Reckless, unwise, and unconcered for your safety and for the safety of others would be a better phrase. Around 10,000 people are killed in the States every year due to drunk driving.   Cannabis is still banned at the federal level in the USA. A recreational cannabis smoker who used within the past week could be deemed as a drug abuser. The USA defines drug abuse with a stricter defintion for visa purposes.

    To be completely honest, that's what is worrying me.
    I am a recreational cannabis smoker. Obviously not all the time as I work a lot. But if this tests positive on anything is it grounds for a refusal?
    Don't even have time to clear my system by not smoking as the medical is less than a week away.
    This whole situation is really getting me down.

    They sent me back my passport in august 2019, we didn't fight for it until now. Don't you think it would have been expired?

    It's been US for 7 years now. I am saying ME because from her side, She can only lead a life with me if she's near to her family. That's the only thing.

    No.. unfortunately not since we don't live together anymore. We did live together for 2 years though in the Philippines until I had to move back to the United States. Maybe I'll check with my wife for anything that has both our names on it still there in the Philippines. Thanks.

    Everybody gives to you their point of view, now depends of you and your girlfriend to decide what is the best way to start. 
     
    Nobody here is toxic, this is a forum with people who had a lot of experience applying for a IS Visa.
     
    You don't need too prove nothing to us but if you are askingfor help this is the kind of information you will get.
     
    Just be sure to read all the USCIS requirements and have all the things they will ask you too for.

    What works best for you depends on a lot of factors, and people are asking you questions because you are not giving us much information that would help us to help you. If you don't want to answer those questions, use this website to do your own research. Read the guides, browse the forums including the regional forum. 
     
    But first, get to know this person before planning a wedding and an immigration path.

    OP - yes you can file.   But you should have met several times before filing any petition.  You want the strongest possible petition.  Invite your US Citizen girlfriend to join us here and we can wolk her thru any issues.
     
    And read the guides.  Blue bar at the top of every page.

    I think since you've been in a situation where you've been hurt before and had financial issues during a divorce, that thinking about a prenup is a good idea. As for 'hot mess' stories, well it's not just a tales from less developed countries... there's been a few from the UK too. That being said, even if something shouldn't work out - you still would have a life in the UK. You might not have the life the same way you had it presently, but you would have a life. The UK is always there for you. I suppose the larger question is why are there family members that disagree with your decision? Is there something about him in particular that they should urge caution? Is the relationship short? Do you have a financial plan? Consider that carefully.

    I can understand about feeling overwhelmed with such a life changing event, but being concerned about divorce before even getting married is not a good sign.People in life will always have their own personal thoughts and feelings about things. Ultimately it is your decision to do what is best for you. Have you spoken to your fiancé about your concerns and what your plans are for the future, take some time to focus and try to be stay positive.

    I would be most concerned that you will be looked at as being a public charge. Your husband won’t be able to support you or himself for a very long time. Your savings, etc does not come into play- it wouldn’t matter if you are a millionaire - the US person has to show the support. Do a quick google search on new public charge rule if you haven’t heard already. 
    In addition you need to show proof of domicile- if he lives in prison where will you live? How will you show proof of commingling of your finances, both of you cohabitating etc. 
    The age gap is only a concern for certain countries - for example if it is not the cultural norm. Your families. It involved- only an issue if the cultural norm is for families to approve (many Muslim countries for examp,e)
    In regards to your ESTA if you lose it and apply for b2 afterwards you may risk denial due to ties to your home country (if married) They may think you will adjust your status while in the US.
