BC97 reacted to YecaCruz in Getting a mortgage after AOS (after K1)
    Hi there!
I'm actually a mortgage loan processor. Although I'm not an underwriter or actual loan officer(I just take all the docs and info and organize it in a nutshell) I've learned a thing or two.
Not sure if you plan on going with a specific mortgage program but there are some out there that require a minimum 2-year work history IF they are to include your income into the overall debt-to-income ratio...however...
For example: for a Fannie Mae or Freddie Mac conventional loan less than 2 years of income can be considered as long as there are other positive factors to offset the short income history.

What exactly are those factors? Not a clue lol! That's where the loan underwriter will look at your loan app and make that determination. Could be the fact that. Just depends on whatever loan program you are going with (Fannie Mae, Freddie Mac, portfolio loan etc).

BC97 got a reaction from Lemonslice in Can I continue working remotely while waiting for an EAD?
I'm aware I'm resurrecting an old thread, but thought it would be useful for others to know that I worked remotely as a consultant for a UK firm whilst waiting on my I-485, and I did not have an EAD. My green card was approved yesterday after I answered 'yes' to working whilst here in the interview (I was not working when I filed the I-485). I was asked by the USCIS officer what company I was working for and I said the company name and that it was in the UK, and I was working remotely for them from a home office. He said 'so you're working over there technically, no more questions - the answer to if you're working is no'. And he left it unchanged on the form.

If I hadn't accepted working remotely for this company I'd have missed out on a lot of potential pay, so if you have the chance to work remotely for a foreign entity (not a US firm), definitely do it. I had no issues - I plan on filing my taxes with IRS retrospectively and getting an accountant to do it for me once I have my social security.

I didn’t read the all the replies but you can’t email anything to USCIS. Expedite request is only possible if visa is still processing and awaiting approval. You call USCIS and make an expedite request, if not denied they will provide you with fax number for additional documentation. If K-1 is already approved and waiting to be transferred to an embassy I’m not sure if you can do anything, we had to wait a full month and couldn’t expedite the process itself. I just secured my medical date super early, that helped a bit.

thanks! We're just waiting for our fee to process and will be submitting the form to NVC. So will call the visamedicals soon to find out exactly
I've moved to UK after graduating university so unfortunately they don't have my immunisation history here.

I don't think people are criticizing. You've posted here asking for advice that is what they are giving you.

At present covid19 is causing a big backlog of these applications, and as a result many people are trying to claim that theirs should be expedited based on various reasons, but mostly financial hardship. I imagine USCIS are seeing record numbers of requests based on financial hardship.

Looking at the USCIS site it says

So you're definitely going to have to provide good documentation that
    1) establishes the loss (and presumably show how that could be alleviated by an expedited k1). When it says "document" I assume they want bank statements, bills etc.
    2) show that the petitioner is not able to withstand the financial loss without an expedited k1.

    As others have pointed out
    1) you won't be able to work for many months after entering the US (I assume EAD and green card are probably also victims of covid19 backlogs, so you'd then have to attempt to get those expedited too)
    2) health insurance is very expensive in the US. You'd certainly need to have that, considering that we're in the midst of a global pandemic. When I moved to the US on my k1 I had global travel insurance but I checked and found that would not cover me past 24 hours in the USA (since I was moving with the intention of staying, and it was "travel" insurance). I was going to be covered on my wife's work insurance, but that could only happen once we'd been married and she'd completed the paperwork at work. So I had to take a short term health insurance policy for one month until I could be added to my wife's. It was not cheap. If your partner is not working and therefore (i assume) does not have a work insurance policy to add you too, you may be talking about many months of health insurance payments until you can work. That's several thousand dollars at least...

If your savings could help the petitioner, I would be asking (as a USCIS examiner) why you can't send money to them now, rather than only helping out once you're in the USA?

I'm not meaning to criticize - just putting myself into the shoes of the USCIS employee who will examine your case - as I said, they must be seeing a surge in these, if they just rubber stamp them all as approved its just going to clog up the system with people jumping the queue, and encourage even more to do the same.

They are not criticizing, they are playing devil’s advocate, which is what the embassy will be doing too. Consider it preparation for what’s to come.

It is going to be a tough one, asking for a visa to be expedited based on financial hardship where the person receiving the visa cannot work for many months and has to part with the best part of 2 grand soon after arrival in order to be able to stay in the country, and will need to have health insurance and be fed. If the petitioner is not working, do you have a joint sponsor lined up for AOS? London will allow self-sponsoring of K-1s, although if you have sufficient savings to self-sponsor they will then question where the financial hardship for the expedite lies.

But anything’s worth a shot. It costs nothing to try.

    Hi,

It does not hurt to request an expedite.  But be prepared to show how an expedited K1 can alleviate the financial hardship of the petitioner.  The K1 beneficiary cannot work in the US when they arrive, and will not be able to for about 6 months or so when he/she gets their EAD.

If the petitioner is maintaining 2 households (that is, paying for the fiance's housing and expenses), that may be a valid reason.  But if it's just to get the fiance to the US and start generating a 2nd income....that will be very difficult to prove.

BC97 got a reaction from A&D25612 in Department of State posted about K1 visa - what does this mean?
Yeah, that’s why everyone here is so annoyed (me included). But the travel ban gets cited as a reason for them not issuing the visas, despite the visa not being banned.

There is no exemption either though. There’s a specific exemption for spouses and children which is why IR1/CR1 visas are getting processed and not K1’s.

The short answer is no. Some have started doing K1’s, but none covered by the travel ban.

BC97 reacted to Babaloo in When K1 interviews resume will it be a free for all or in order of NOA2 date?
The best for embassy would be just cancel everything. Tell everyone to start over again, whatever happened does not count due to covid19 because we all went over 4 month limit. Thus they can put things in order fast way.

BC97 reacted to HRQX in When K1 interviews resume will it be a free for all or in order of NOA2 date?
Essentially the status quo remains: "We are only able to process visas for spouses and minor children of U.S. citizens (IR-1, CR-1, IR-2 or CR-2). We are not currently able to issue or reissue any fiancé(e) (K-1) visas. This is why it is not possible for you to proceed with your visa application at this time." So we tried calling the embassy earlier this week about our expedite and apparently they “aren’t taking calls anymore” which is annoying but I saw this post on facebook just now (regarding the London Embassy)

It is promising if true...they got through the students incredibly quickly so now they just have to get through the CR1/IR1 backlog plus the few emergency appointments they’ve accepted

All the embassies have gradually been posting about K1s at different times over the past couple weeks. I think they’re just fed up of people asking and don’t take it as good news. Maybe I’m just being pessimistic cause we’re almost getting used to not receiving any good news.

So basically phase 3 comes whenever the country gets to NZ-levels of covid exposure then (I'm probably exaggerating).
I wish there was something on each embassy's website which says "We're currently in phase two of re-opening. Given current local progress, we expect phase three will start in x weeks time."

K-1 meant I got to see the woman I want to spend the rest of my life with sooner rather than later and just suited what we wanted to do with our lives more.
Even if it's a harder overall timeline, the most important thing for us was seeing each other sooner rather than later. None of us could have predicted a global pandemic that could have affected timelines this severely last November when we filed.

It’s been really nice. Public beaches are closed but other beaches are open. Restaurants and bars are open. We’re going to Cozumel for the weekend. A man was gunned down and murdered a block away from our flat at the corner store I go to everyday and I saw the pool of blood in the parking lot.  We’re staying a month and then to the US.

I am honestly starting to feel like like this with all of these updates

But if the US is as obsessed with maintaining bilateral relations with the UK (and EU, but less so) as they seem to be, they cannot keep the travel ban in place too much longer. What that means for the embassy is anyone's guess.
