    Many people feel this way. But the polices are what they are. The only explanation I can give you as to why this is allowed (which you may not agree with but I am putting it out there anyway for you to consider) is that child support is not being considered as money to use to support the immigrant specifically but as money used to support the household overall. If you have 2 kids that makes your household size 4 you need to show you can support 4 people. If you have 3 kids then you need to show you can support 5. Youd have more child support with 3 kids then 2- so their child support is covering the childs share of household expenses. In most cases the parent receiving the support would argue its not even enough to cover the full amount of the childs expenses itself but rather just a portion of it.

    Don't ever hand over your guns or license, at bare minimum, nor any other property of yours at all, without a warrant demonstrating probable cause/due process for an actual crime. They (police) can say anything they want, there's no reason to voluntarily give up freedoms just because someone says so. Remember, cops can lie to you and nothing happens, whereas if you do it to them, you've committed a crime. Different rules, protect your rights. If you voluntarily give access, or hand over property, or volunteer information, these things can be used against you, and regardless of how comfortable you are with your innocence, don't do it. If they want to commence violating your rights without your consent, they lose a big defense without your compliance, and are far more liable for violating your rights. But if you volunteer to give them up, that absolves them of most liability. 
     
    This isn't implied to mean cops are terrible, it's that this way of going about it separates the bad cops from the good ones, and more importantly, reaffirms standing up for your rights. They don't protect themselves.

    I'm from the Philippines and we waited almost 5 months (140 days to be exact) before our petition got approved. Still waiting for it to be transferred to NVC.
     
    I was stressed out because I saw MANY people -- from the Philippines and other countries as well (even the "tougher" ones) -- who got approved in 90 days or less. I was happy for people who got approved early but I was hoping for good news for us as well. I stopped going on here and Facebook groups for a while because it wasn't healthy for me.
     
    Also, as it turns out, approved in 90 days or less wasn't always the case. I stressed myself out for nothing. I've seen plenty of people, who sent their petitions waaay after we did, are already done with the process and some are in the US already. But I learned to just trust the process and to wait for the perfect timing. We had no choice. You still can't control when it will get approved no matter how much you think about why your case is taking longer than others.
     
    It is definitely easier said than done, but try not to compare.

    Well, you can call an attorney after they admit you into the USA, but while you're waiting in line, you are not allowed to call lawyers.
     
    Also, keep in mind that CBP officers have a lot of discretion and are known to be petty and retaliatory. So if they hold your fiancee for 15 minutes for seemingly no reason and you get angry about that, they might decided to keep her there for two hours "looking into something" just because they can.
     
    They can also order you to leave the secondary inspection area and decide to question her separately and make her cry and see if they can catch her in a mistake/lie.
     
    I'm very much in favor of US citizens standing up the CBP officers and refusing to answer their questions when the US citizen is traveling alone. But when traveling with a visa holder, this is not a good idea, because she is very much at their mercy.

    The visa interview was conducted abroad, and you were approved.  All the CBP officer will do is process you, it can take anywhere between 5 minutes and an hour depending on the POE and how they do things.  You could be processed in the regular line for non-US citizens, or you may be taken to secondary processing in a back room.  They may ask a few simple questions like what is your correct address in the US.  All they're focused on is verifying that you have a valid foreign passport with a photo that matches your face, that your visa inside is valid, and entering your information into their computer system and stamping your visa with the date of entry.  Nothing to be worried about.  If you don't speak English very well they have experience with that too.  Relax and focus on preparing for your move to the US.  Good luck!

    I will be escorting my fiancee through immigration end of Dec 2019, if they give me issues, they will face an upset US CITIZEN who will definitely call an attorney.

    We decided very early on in our immigration journey that the only petition that we need to be concerned about is our own. We were happy for other folks having good fortune on their immigration journey. We are all stuck on the same leaky boat, the USS USCIS, some of the folks have longer sojourns than others, some have shorter, that is the way it goes. We never had the time, energy, or inclination to worry about what other people were doing, we have our own life to live. C'est la vie !

    Just wanted to provide an update. My fiancé had his interview yesterday. The ASC or CAS (biometrics) did not provide a letter only a sticker on the back of his visa and at first they were denying him entrance to the consulate building (female sitting by main building door). He insisted he was not given a letter and she insisted that he was. He was told to go back to ASC and get the letter.  But he saw another person with the same situation and he spoke to another security guard and he scanned the sticker and allowed him in. He got to the line at 8:30am and came out at 1:15pm! I was waiting at Starbucks across the street!  He got approved!!! YEYYYYYY!!!! 
     
    Now the waiting game begins for the actual visa....

    Surely if it transpires that she has TB, that would be pretty life-changing...and potentially life-ending if not treated. Remember, the six months treatment in Manila isn't for testing...it's after testing, if the diagnosis is confirmed positive...so surely if she has TB, it'd be worth changing her job and moving for, to not only get the visa and be reunited with you,  but also to get the treatment that may well save her life?

    Katerina, your best next step is to get on the first flight possible to enter the US, even if it's only a quick trip and then you return home to get your affairs in order before you come back with all your stuff.  Use that IR-1 visa as soon as you can and take your evidence that the marriage was entered into in good faith with you in case CBP questions you because of something he does between now and then, like contact them or the consulate abroad or USCIS and claims fraud.
     
    As for the divorce, I suggest that you file for divorce in the state where you take up residence in the US.  Get a good divorce attorney.  Maybe do some research about divorce law in the state where he lives and the state you will be living in to understand how property is divided in a divorce.  File wherever it is advantageous for your situation.  Normally, only the property that you accumulated while married is subject to the 50% division guideline, so most likely in your case that will be minimal.  If you own property together it could be more complicated.  If he fights the divorce it could be a long and expensive process unfortunately, with discovery and depositions and accountants and attorneys.  Save your evidence that he cheated, that he was abusive.  Don't give him any money, and fight for your rights.  Ask your divorce attorney to file a restraining order against him so that if he harasses you or threatens you, a police report can be filed, he can be arrested.  So sorry that you are going through this, but the light at the end of the tunnel is a new life in the US that hopefully will be good for you in the end.  You can always go back home later if you don't like it here.  Reach out to family and friends for emotional support.  Good luck to you!

    Read this example DS-160 application very carefully. Then ask your beneficiary to come clean and share exactly what was put on that form so that you can know how bad it is.  
     
    Right now you’re being BS’d and since if you check “married” you HAVE to provide a name and address for the spouse (which the IO also has in front of him) you’re the only one in the loop being left in the dark.  If you don’t name the spouse, you can’t ever submit the application or it’s incomplete and gets rejected.

    Me?  I’d be unhappy if I invested all that effort into someone who left out that critical detail that yes married was checked but didn’t add that a “spouse” was also NAMED in that application.  I’d be more unhappy if I got lied to and made to look stupid over it.
     
    You can’t miss that and you are supposed to print out that application to bring to the interview by the way.  You’re getting snookered.  Your beneficiary?  Checking married AND naming a fake spouse puts him in a very bad place.

    They’re giving him a chance to fix it, they have to because if he can produce some document then he’s off the hook.   Once the admission is made that there is in fact no spouse the denial reason will switch to a much more serious one than a missing document.
     
    No wonder Nigeria is such a high fraud country if the “agents” routinely lie on simple B visa applications.  I don’t think you can lie on that level though unless the applicant participated.
