We had to resubmit documents a few times too.  It's super frustrating! I would always upload the correct document the same day but still have to wait 2-3 weeks to get a response.  In all, it cost us about 2 extra months of waiting!

I submitted  my documents on the 10th of April. I just got notification RFE... i have uploaded again and submitted. i hope they review again in 8 or less days..... my AOS was rejected but in the email they requested for more documents.. is that normal.. just reject a document for the sake of it just because you want more documents.

    Not only that.
    1. They gave us a DS 260 form with their logo and asked me to fill it up. When I was done, I sent it to them only to find out that they will type it in our CEAC ACCOUNT and then asked me again to recheck what she typed. I could have done it straight in there! And guess what, all she did was type in the infos I sent and she put infos in there that I dont even know where she got! (Dates and spellings).
    2. When I found out about the HK police not sending the original certificate or even a copy of it to me (they send it straight to the embassy), I asked the lawyers on what to do because CEAC IS ASKING US TO UPLOAD but I can’t because HK will not give me. The only thing the lawyer told me is they will call NVC and get back to me. I did all the research about this because I don’t trust them anymore and found out here that you can upload receipt instead of the PC. So, I told the attorney that. And here is her reply, “We called NVC and talked to a supervisor and it seems NVC is not aware of it.” (????!!!!!)
    3. They changed the type of Police clearance needed here from Canada since September. I asked them again. Which of the police clearances from Canada shld I be requesting because we have different types/kinds?  THEY DO NOT KNOW!

I did majority of the work here. The only job they did is typing WRONG  and UPLOADING wrong and delaying our process! They didn’t deserve the money. And we are already fully paid!!!

We got an email after 9am and have to send in birth certificate because it was hard to read. So they rejected it. And I see they didn’t look at 2 things that was submitted.

We just heard from NVC today via email and our case number has been assigned!  We are SO excited.  We have all our documents ready, so we're going to submit everything while together in Europe four days from now. The end of this long journey is coming!  We submitted our I-130 9 months ago, and it looks like if all goes well with NVC document submission, my husband may have his interview in July.  Every little victory needs to be celebrated in this crazy process.  Hang in there everyone.

Just make sure your documents are not upside down or sideways.

They should be be positioned in the same way you would hold them if you were reading them or looking at them in your hands.

I agree that people need to relax. I've seen in a few threads now people making inquiries WAY before they should. USCIS tells us approximately how long it is going to be and they give us the date on which we can start inquiring. It's not much information, nor is it super accurate, but that is how USCIS has decided it works and we have to live with that. Do I wish I could be approved faster? Of course, everyone here does. But inquiring before that date just takes USCIS's/their congressman's time away from people that have legitimate problems (or are legitimately outside of normal processing) and makes it harder for them to get help.

I know a lot of people are reaching out because of the increase in wait times, and I agree that it sucks, but not a single part of this process is fair. Is it fair that Potomac is processing MUCH faster than the other service centers? No. Is it fair that Texas is processing much faster than Nebraska? No. Is it fair that people are still getting their cases sent to Nebraska even though they are clearly behind? No. Is it fair that wait times are getting longer and USCIS doesn't seem to care about it at all? No. I could keep going but the fact is this is something we all signed up for, fair or not, because we want to be with our spouses no matter what and this wait is unfortunately part of that "no matter what".

So maybe this wait time has just made me cranky, but people need to stop making inquiries/contacting congressmen before they are out of normal processing, because even though one petition is a tiny drop in the millions of petitions they get, every petition that is approved because someone complained and got lucky makes the process even less fair for everyone else.

You can't pay the fees until you get the case number. You can pay them as soon as you do. When I got the case number in my email, I immediately logged on to CEAC (well it took about 5-7 mins to allow me to log in, I guess since the case was just freshly created at the NVC) and I paid the first fee (AOS) $120. You must pay with a US bank account (account # and routing number). CEAC doesn't let you pay for both at the same time so I paid that one first. Then paid the next one (IV) $325. I paid these on Wednesday 2/20 and by Friday 2/22 their statuses changed from "Processing" to "Paid". Then I was able to log in and start the DS-260. My husband and i worked on that all day Saturday and submitted it Saturday evening. Then it took me about a week and a half to upload all the required documents (Passport pages, birth certificates, marriage certificates, police and court record, translations, I-864, tax transcripts, W2s, paystubs, etc) and more supporting relationship evidence like boarding passes, chats, additional photos, etc. I was done uploading everything by 3/5/19. I submitted everything that afternoon. By 3/8/19, I got an email from NVC instructing me to log in to CEAC and check their messages. I logged in and saw all the documents had been accepted but two things were rejected. My birth certificate (which I technically didn't even need to submit since I'm the petitioner) was upside down, and I uploaded my 2018 1040 form instead of transcript ( I only just filed my taxes a few days earlier so I didn't and still don't yet have access to the 2018 transcript). So I fixed these two issues and resubmitted them that same day (3/8) and by the next Friday (actually early Saturday morning the 16th at 3:10 am), I got the " documentarily qualified " or "case complete" email from NVC. This Friday will make two weeks waiting for an interview date. The NVC sends your files to the embassy after your interview has been scheduled. They work with the embassy to schedule an interview date first. Sorry this was long, hope it helps.

dont want to come off like the visa journey police but are you able to create a timeline. That really helps others estimate the times while we are waiting. I know it doesn’t determine our approval but it really gives us an estimate.  And what was ur service center?

You want suggestions as to what you can do to move forward.  Here are some ideas.  A CR-1 denial can be appealed, unlike a K-1 denial which cannot.  Your file will go back to USCIS and in a few months you will get a NOIR.  At that point you can submit more evidence of a bona fide marriage, such as more visits to be together, documents showing co-mingling of finances such as a will, health insurance, retirement benefits beneficiary designation, etc.  That will take more time for USCIS to review the additional evidence, maybe months.  If they like what they see, they can send it back to NVC, then to the consulate abroad for another interview, where the visa can be approved or denied again.  If the file is not approved at USCIS when you submit the additional evidence after the NOIR, you can appeal the decision, but that takes more time, a year or more after that.  So even if you are successful in the end, all of that process could take a year, two years, who knows?  This process takes forever even without denials, appeals, file getting sent back to the US, etc.  If your wife really married you for love, and not for immigration benefits to be with her family, then she should be happy if you move to India to be with her, to live with her and make a life there together.  Then after living in India for a few years while the CR-1 process continues, with the appeal and everything, you can either move to the US together later or file for another CR-1.  Many who have gone through a CR-1 appeal after denial and NOIR recommend that it is faster just to file a new CR-1.  If you really love this person and if she married you to be with you and not only to live in the US, if the relationship is genuinely bona fide, she will be happy to be with you and live in India for as long as it takes to eventually get a spousal visa to immigrate to the US.  Good luck.

    OK.

From what you posted it sounds like the officer believed that your wife's family was trying to find a way to bring her to the US. You previously mentioned that the Co had no evidence of fraud. there is no law that states that a CO has to have hard evidence to refuse to give a visa. If there are suspicions, than a case can be denied. That is also why they have interviews.

You may not see the suspicions but in the eyes of others there are some things that look concerning.

Your wife had a previous family petition that she failed to be a part of. Most of your wife's immediate family is in the US. Your wife's family arranged for you and her to get married shortly after she was found ineligible for her previous visa. You and your wife spend a short amount of time together before marriage. The wedding was fairly quick.
Those points are enough to give an officer investigating your case doubt. Hope this gives you an idea of what it looks like from the outside.

    Good luck to you.

While arranged marriages are common in India, most people don't have your particular facts.  Most arranged marriages in India don't involve immigrating to the US.  People have been know to arrange fake marriages for their children to immigrate to the US.

Your USC sister-in-law filed for her parents as Immediate Relatives.  Derivative beneficiaries are not allowed.  Your wife was never going to immigrate with them.  (CSPA and aging out is not an issue here).

Shorting after immigrating to the US without their daughter, the US Embassy suspects that they arranged a fake marriage for their daughter to immigrate.

You are connected to her family, you weren't a suiter that she met.  Her family arranged your love affair.  That's suspicious given that it was done shortly after they immigrated and she couldn't.

You knew her about a month before going to India.  How long before hand did you buy the tickets?  Did you buy them a week after talking to her and then waited 3 weeks to take your trip?

You married her after 2 weeks there.  In 6 weeks between meeting her, you were married in a giant wedding with 1200 people.  How easy is it to arrange a wedding that quick?  Seems like something that would take a few months to arrange.  Seems like the wedding was planned and the only thing missing was a US citizen groom.

That's the suspicion.  How was a 1200 guests wedding arranged after you started to talk six weeks prior?  Sound normal to you?

Eh.. let me guess. You're a middle age, white American. Your "type" is younger Asian (props Phillipino) or southern American girl. You know them for couple of months and then sponsor for K1. Doesnt work out, you meet another one and you sponsor her barely knowing her..

Dont worry. We see this exact thing all the time. Sometimes guys like you come complaining about being scammed also.

Am I guess the pattern right? If it didnt work out 3 times already then maybe you should actually take TIME knowing someone. At this point USCIS will also put you through extra scrutiny.

Also intent to marry you send with the original petition. She could've done medical and interview without your knowledge.

Happy Friday Everyone!   Well many of you have heard me vent and stress many months.  I finally got my update.  It is not pretty.  A poor choice can cause a hard lesson.
I finally received my notice from USCIS, it was a NOID.   It stated my husband had previously reported he was married to another woman, therefore our marriage was not recognized.
My thoughts all came racing back, but my anger still took over.

My husband over 15 years ago when he was just 22 missed his brother who had came to USA several years before to attend college.  He went to apply for visitor visa and they told him get married, he told them he doesnt love anyone to marry...lol    I have no other names to call him but stupid, desperate and depressed, went back and lied telling him he was married.   He told me of this and I was concerned and he felt it was not a concern.  I am ignorant as well for not researching.

Therefore our NOID stated that he previously reported he was married so therefore, until proved otherwise, our married in Palestine was not recognized in the US and would be denied, giving us 30 days.   NO PROBLEM, we have all the court documents and everything requested, so now we will be approved for the I130.  However, when he goes to the embassy for the interview he will be denied for his lie in an attempt to come to the USA.  (he never got approved anyways, never been to the USA).

We will have to file a Waiver and a Hardship something...it is all overwhelming.  A lie is lie but we have hope that since it is over 10 years, he has never entered the USA and the fact that I cannot live where he lives, we pray God and the United States allows a pardon.

This process will take most likely 2 years!

Now we all have one obstacle removed from our journey; it's all forward progress from now onward🙏. Thanks to everyone who bombarded NVC with numerous calls to make them aware of this lingering problem and making your voices be heard. We fought this together as a community and it feels like we've won a battle. Don't stop fighting to be with your loved ones. Special thanks to Rasha167, Candy55, KJ2, SM&RM for being my partners in crime on this issue; you guys rock.
