    yup, receipt date for a case inquiry is March 2020 for Texas so you are well before that. They have such a massive backlog on so many things from Covid I think that the lines are just jammed with inquiries all the time. I’d do the form and if no luck within a couple of weeks maybe follow up with your congressperson for assistance.

    Hi, so my son´s case had the same message and 2 weeks later it was approved...maybe its a glitch with the system so don´t worry about it..good luck!

    Just wanted to post an update in case someone else is in the same boat. The Tier 1 agent today said this is normal and is just how they are processing applications during Covid where they can't see the beneficiary on their system but transferred me to Tier 2. Tier 2 agent (got a call back after 5 hours and was extremely nice) said everything looked fine in her system and there's no RFE and being outside normal processing time is nothing to worry about. I'll update again when/if I hear back from the case inquiry.

    Yes, there are a few background checks at the petitioning stage. The main one that tends to delay things is the FBI one. This includes background checks on the petitioner.
     
    More background checks happen later, namely at the consulate stage. In some countries especially, it's not uncommon for that to take a long time after the interview to complete.
     
    Maybe something didn't get entered into their computer system properly. As noted, call USCIS this coming week (Monday is a holiday) and ask for a Tier 2 officer. Tier 2 officers can actually look at a case, whereas Tier 1 agents are just customer service/support who provide basic information.

    1) I think you meant July 2019, not July 2020. If not, welcome time traveler.
    2) That's 9 days over 10 months, not 11 months.

    (I just had to post this...don't take it seriously!)
    3) As noted, your petition is outside of normal application timelines for TSC, so you can put in a Case Inquiry to request an update. No guarantee it will do anything, but it's all you can really do at this point.
    4) I wouldn't say it's "normal" given the above, but it's also certainly not unheard of by any means. It doesn't indicate a particular issue in your case...it could just be background checks haven't come back yet.

    Unemployment is NOT a means tested benefit. 
     
    However,  being unemployed and not having sufficient CURRENT income, might cause you to fail the criteria to be a qualified sponsor

    NOA1 refers to the actual letter you received informing you of the date USCIS received your application, your priority date and the date the notice was sent out.
     
    NOA1- Notice Of Action #1.
     
    NOA2- Notice Of Action #2-  is the second notice to you by USCIS that your case was approved.

    I mention it because most countries have a residence-based system and many people assume that they only need to report tax where they are actually present at the time. Nowhere did I accuse you of trying to cheat. You might also have taken it as a friendly suggestion that it could make tax sense to sell before getting the green cards, which I wish someone had warned me about. Have a nice day.

    Send NVC an email to expedite the other one so u can have same day interview. It happened to my parents too but I emailed them and their interview was scheduled the for same day in 24hrs. Good luck

    You can be exempt for a visitors visa interview if you are in your 80's.

    Yes, you got the NOA (Notice of Action) right. 
     
    Some notes: The NOA2 could be anywhere from 8-14 months, depends on the service center. Once approved, the I-130 will be transferred to the NVC. It'll take NVC 4-8 weeks to input the case and have a case number. Once you have a case number, things go fast or slow kinda depend on you. First you have to pay fill in 1 form and pay 1 fee, then wait a few days, then pay another fee, then wait a few days then fill in another form. What you can do to speed it up is read about all the documents required and have them ready at your disposal so when it gets to the points where you can send the documents, you don't have to wait. If you are well prepared, you can minimize the time the petition sits at NVC

    To be more specific, it's required for either AOS or consular processing. There's no AOS involved if obtaining an immigrant visa.

    Yes
     
    Because it's not required with the I-130. If AOS, it's with the I-485. If CP, it's submitted through the NVC
     
    After your I-130 is approved, it will be transferred to the NVC. They will be collecting documents and the I-864 is one of them. When the case is documentarily qualified, the NVC will schedule the interview and forward the case to the appropriate Embassy/Consulate

    I brought this up before but no one seemed to know the answer, so I’m just gonna throw this out there. What if you apply the I-130, it gets approved and transfer to the NVC. From there, you stall. If you don’t pay the fees and send the support documents, the case won’t move forward. The NVC’s rule is, as long as you keep contacting them at least once a year, the case is still “alive”. So you keep contacting them every year. If there is a change in law, you have an approved petition. Any changes in laws will take some time to take effect, so in theory, you can proceed your case to interview in just a few months, before any new laws to take effect. In theory that should work. I really want to find someone who did that in real life. Like, what is the longest a petition has sat at the NVC and “still alive”?

    Essentially, yes. My father could come in as my mother's husband if the category goes away, either as a green card holder or as a citizen, if she chooses to obtain citizenship. However, she does spend a sizeable amount of the year in England, just under six months. Her choice to spend this much time in England will slow down her path to citizenship, and I have reminded her of this repeatedly, but she has always done what she wished, no stopping her. 
     
    My father comes over here for visits when she is here as his schedule permits, but Mum and I have always been very used to him not being around much since he travels for business much of the year. Mum and Dad see each other about four months a year in total right now, depending on where each is in the world. My father also has the option of an EB5 visa, but he is hesitant at the moment to invest more in the States before the next election and rumblings about a possible recession. 
     
    Keeping your options open is a solid plan. Never know what will happen.

    Oh I didn't even think about this option. I assume you mean that since your mom has a green card (or becomes a citizen in the future) your dad could come in as a spouse if the IR5 category is removed. Also how much time apart do your parents spend from each other?
     
    I guess this gives us one more option (and preference)
     
    Preference 1: File for I-130 after 5 years
    Preference 2: File for I-130 and stall for a few years
    Preference 3: File for I-130 now
    Preference 4: File for I-130 for one parent so the other can come as a spouse if IR5 is removed
    Preference 5: Lose opportunity to file for I-130 because of changes to immigration rules

    Filed for my mother as soon as I was able (2017), she's had her green card since 2018, splits her time now between home and the States. Father wasn't interested at all, not a big fan of things over here, but he's thinking about it seriously now getting on in years. Money thankfully isn't an issue, I know it is for some. If the IR5 is pulled as an option and he wants to be here, there are other ways to get here for him. Keeping an eye on it for him in the meantime.

    IR-5 is not a family preference visa. It’s an immediate relative visa (the same as spouses and minor children).
