Is 11 months normal for IR-5 application?

Hi everyone. I filed I-130s for my parents in July 2020

 

Received Date: 7/11/2019

Priority Date: 7/11/2019

Notice Date: 7/15/2019

Texas Service Center

 

https://my.uscis.gov says "In Process. Your benefit request has been accepted and is under review" and https://egov.uscis.gov/casestatus says "Case Was Received and A Receipt Notice Was Emailed". We haven't received any further communication.

 

It's going to be 11 months since we filed the I-130 -- does anyone know if we are still inside normal processing times and/or is there anything we can do besides just wait?

It is out of normal processing time.  Open an inquiry.

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

1) I think you meant July 2019, not July 2020. If not, welcome time traveler.

2) That's 9 days over 10 months, not 11 months.

(I just had to post this...don't take it seriously!)

3) As noted, your petition is outside of normal application timelines for TSC, so you can put in a Case Inquiry to request an update. No guarantee it will do anything, but it's all you can really do at this point.

4) I wouldn't say it's "normal" given the above, but it's also certainly not unheard of by any means. It doesn't indicate a particular issue in your case...it could just be background checks haven't come back yet.

I called to put in a case inquiry and got referral# for both my parents -- apparently I have to now wait for someone to contact me within 30 days. What worried me though is that she said the beneficiary's information is missing in her system (for both my parents) and that I should call on Tuesday to talk to someone in "Tier 2". I have no idea what this means but I didn't like the sound of that 😬 Does anyone have thoughts on what this might mean?

Yes, there are a few background checks at the petitioning stage. The main one that tends to delay things is the FBI one. This includes background checks on the petitioner.

 

More background checks happen later, namely at the consulate stage. In some countries especially, it's not uncommon for that to take a long time after the interview to complete.

Maybe something didn't get entered into their computer system properly. As noted, call USCIS this coming week (Monday is a holiday) and ask for a Tier 2 officer. Tier 2 officers can actually look at a case, whereas Tier 1 agents are just customer service/support who provide basic information.

Just wanted to post an update in case someone else is in the same boat. The Tier 1 agent today said this is normal and is just how they are processing applications during Covid where they can't see the beneficiary on their system but transferred me to Tier 2. Tier 2 agent (got a call back after 5 hours and was extremely nice) said everything looked fine in her system and there's no RFE and being outside normal processing time is nothing to worry about. I'll update again when/if I hear back from the case inquiry.

Got a reply today that says "We have had to perform additional review and this has caused a delay in processing time". I'm thinking maybe it's because I realized I entered my mom's birthday in my dad's application in error and had to send them a written and signed letter requesting to correct the error (The tier 2 officer last week confirmed that my dad's birthday has been corrected in their system)
