    Too me getting the Australian citizenship is a complete waste of time.  She has no intent to live there after getting it.  There has been previous discussions here about why that is not good.
     
    Figure out where you guys want to live.
     
    Is for stateside concurrent filing.   If she is intending to enter and adjust then she will be committing visa fraud.

    People get married on tourist visas all the time.   It's called a destination wedding.  They can return home and do consular processing or look at adjusting.
     
    Off topic - It happens worldwide  We (both) got married on a tourist visa in Hong Kong.  Nice, easy, quick, legal marriage.

    Ultimately you will need a CR2/IR2 filed for the child.  A tourist visa should be denied as the child is eligible for citizenship upon arrival in the US.

    I'll do some more personal checking tomorrow, but my experience has been that the child born to a USC, even if not eligible for CRBA, had to get a IR2 visa rather than a B2 (or in the cases I see usually a BCC).

    Not usually if they are there legally.   But in California you can get instate if you are undocumented but have proof of an address.  SSN seems to be "optional"
     
    You can go to SSA a day or two after and get a SSN.  Sometime it is hard to find someone that knows the rules.

    I am a USC and also have Mexican Permanent Residency.   I married a Filipina and we decided to wait out a spousal visa application in Mexico.  She was given a Mexican Permanent Residence and Green Card five hours after applying.  See was offered a few jobs there.  Since you are married you should at least qualify for Temporary, if not Permanent, residence if you wanted to live there..  You could rent out your house in the meantime.

    I sounds like NY structured their law for political reasons, which makes it so hypocritical that they are accusing the CBP of acting politically.

    The use of MVD records I think would also extend to immigration cases in addition to the TTPs.   I know that things on my MVD report never appeared on my FBI report.

    If you take into consideration that she won't be able to work or travel internationally, the CR1, with being able to visit with her visa, might be a better "experience".

    Daughter is a citizen.  Best proof is to apply for a passport with mother's naturalization certificate.

    She is allowed to board (since green card is not expired) then she will seek permission to enter at the POE.  If there is an issue she can ask for a hearing.  Don't sign anything, especially a I-407 to surrender her green card.  Hearing would be in a few months or maybe even a year.
