i know this is an old thread - but i strongly feel that you've chosen the wrong lawyer. Did you not interview the lawyer to make sure he has done these type of cases etc. So any updates on your case??

Hello, we ended up receiving a NOID which we were expecting but wanted to file WOM just to get some movement on the case. Jim & his team handled the rebuttal for our NOID. USCIS intern asked for an extension to answer the lawsuit so we have a date of September 10 to get good news, God’s willing. This has been a total of 17 months since our interview and overall 3 years journey. I’m hoping we all get the best and most fitting outcome for us all!!

As a matter of fact I have and everyone was served. I was told 60 days from when the last person was served I will hear from USCIS, which is June 20. So for now it's the waiting game. Also, I was informed that because of our current pandemic there could be delays. Keeping my fingers cross I will post my outcome on here. Everyone talks of doing WOM but never bothers to come back and share any follow up details. After our interview we were told we will get our visa but were put in Administrative Processing were given a white slip no additional information needed. This is so frustrating, we go through this process to begin our lives together but yet so many of us are separated from our loved ones and have no idea what's going on we are just waiting and our lives are on hold. We like to believe that if we follow the protocol and provided everything USCIS is asking for we will be successful in this journey; however it's far from the truth. It seems like USCIS just wants to deny our petition. Praying that each and everyone of us have a successful outcome and are reunited with our loved one. Be safe/healthy everyone.

The NOIR was issued 21 months ago. It is over.
It is clear that the wife has delayed responding, let alone responding, finding an attorney, filing taxes as married, and doesn't seem interested in filing again. Both the wife and husband have made mistakes throughout the process. The beneficiary doesn't understand that he didn't file DCF and has even asked about doing a F2a. He has complained about the cost to get an attorney to fix their mistakes. With Skype, Facebook Messenger, Facetime and now even Zoom, he should have been able to be involved in the attorney meetings. He seems quite eager to get here; his wife isn't putting in the effort. Now they are waiting for CBP. Nothing makes any sense in this case which leads me to believe either there are facts not being shared here or it's one big troll.

Look, let’s assume the best case scenario. Let’s assume she got pregnant by an ex boyfriend who she was totally faithful to right before you met. Maybe I’m being too generous, but I’ll go with that because I can’t assume anything here. So she’s 45 days from giving birth. That means she’s known she was pregnant for 4,5,6 months?
and how long did it take her to tell you? I can tell you one very important thing about relationships. They are built on open communication and trust. You do not have that. She kept that from you. Regardless of her reason, she’s not mature enough for a loving relationship. You are setting yourself up to be a victim with no recourse if you go through with it. I would tell her that you are going to put things on hold. Cancel the i129f and go see her. Then reapply later. When she freaks out and tries everything to manipulate you into moving forward, you’ll know what kind of person she is. Best of luck

I am seriously thinking about filing for writ of mandamus since my fiancé’s case has been under administrative processing for over 16 months. What do you guys think? Should I wait until things with covid-19 have settled a little until I file one or should I just go ahead and file it now?

I hope everyone is doing well during this pandemic.
It looks like nothing will happen until embassies open, because our case got postponed for 2nd time and now we have to wait again.
I wonder if anyone with the Writ got their 2nd interview at this time or they just keep postponing it.

@Boiler I’m actually one of the very few who DO follow through. I did file a WoM and wanted to start a thread about that because we got a call on June 30 and we filed on May 19. Even during this pandemic they are responding. So we’re just waiting to get to the finish line so I can start a thread since no one has enough information about that on this forum. This forum has been gold to me and I want to make sure that people know all avenues and options. #intherunningstrerch

Thanks for sharing. I have hired Jim as well he’s so instrumental in our journey and I am so happy I decided to go with him as well. He’s the best out there. My husband been in AP for one year and five months and due to our current pandemic I decided to go with Jim we now in the waiting phase June 20 will be out 60 days to hear back unless our time gets extended. Some embassies permit the spouse attending, some encourage it, some forbid it (London is an example of that). That’s why this was posted in the Vietnam forum: to get experiences from others who have interviewed in Vietnam.

For most embassies if you present yourself with your passport as a USC they usually oblage and allow you wait for your spouse inside the embassy or even be part of the interview

Personally, I think this is a very individual decision, and it first depends on whether or not the embassy/consulate even allows it. If it is allowed, my view is that it helps for the USC spouse to be there, for moral support and to be part of the interview if asked anything to verify that the relationship is bona fide. I flew to Brazil for my husband's visa interview last year because he wanted me there. The Rio Consulate allows spouses/fiances to be present for the interview, and I was called to the window for the interview and we were each asked two simple questions. The IO was able to observe how we interacted, listen to how we spoke Portuguese with each other, saw the non-verbal language, the quick touch of the hands, the reassuring glances between us, the nervous smiles, and my husband's visa was approved after a 4-minute interview. I've been an active member of VJ for two years, and I have seen many examples of spousal visas that were denied when the USC spouse did not attend the interview abroad, and none that were denied because the USC spouse did attend the interview. I'm not sure where Jim Hacking's advice is coming from, maybe he also says it depends on the unique situation of each couple, location, etc... So at the end of the day, you make your own decisions, right? Good luck whatever you decide! Administrative processing is most likely because of other reasons, unrelated to your being there for his interview.

Not sure what this means. I am eagerly waiting. I took a snip it of it and forwarded to Mr. Hacking. I hope we are getting good news. It's been 16 months to be exact since we had our interview. I am assuming because they received the summons, it's the first step in getting my case moving.

Yup...that's what I figured the result would be. This challenge was premature.
I'm going to assume the case was decided without prejudice, so a new one can be brought if there is somebody who has standing to do so.

Last week our office filed a TRO against President Trump to try to stop his Immigration Ban executive order.
The immigration ban will hurt a lot of immigrants who are trying to come to the U.S. to be reunited with their families, immigrants who are trying to start a new life in the U.S.
So we filed a lawsuit to try to get it stopped.
We had a hearing last Thursday with a federal judge to argue that the ban wasn't legal and shouldn't continue.
And we received a decision.
The judge decided that we did not have a standing, our clients hadn't been harmed yet, and that because the embassies are closed anyway for COVID-19 the executive order hasn't effected our clients directly.
As of now, the ban will continue.
But we aren't giving up.
We are reviewing the response and hope to keep the legal challenge alive.
We will continue to fight for immigrants.
The embassies are still closed, there has been no word on when they will reopen.
But as saddening, disheartening, and frustrating as this is we can't lose hope.
There are elections coming up soon.
There is a light at the end of this.
Until then, we will be working on getting immigration back on track and to get our country back on track.
Don't give up.
We've got to keep fighting.
