Your IO unfortunately didn't know the rules for K1 medicals. That's why we always recommend to take a copy of the instructions/rules to show the IO that K1 medicals done abroad DOESN'T EXPIRE as long as AOS is FILED (receipt date) up to 1 year of the date of the medical and the vaccination sheet was marked completed.

Ayrton got a reaction from Celie in EAD fee for renewal - AOS NOA1 after Oct 2nd?
She definitely didn't pay for it. The fee changes also never happened. EAD and AP are still free.

And how is she already applying for renewal if she just applied for AOS last October?

He didn't get the first one because he used your ITIN. He will be able to claim the money when he files 2020 taxes.

For the second one, it's still too early. Not everyone received it already.

    No it doesn't.

Ayrton got a reaction from Tereza in Affidavit of support with no tax returns
Affidavits of Support aren't petitions to be approved or denied. They are contracts between the sponsor and the government to support you, and they are in effect the moment you become a PR.

She's not required to send tax returns to USCIS if she was not required to file them with the IRS. That's why the instructions are pretty clear and tell you to give them the reason why a tax return wasn't filed. In her case, not enough income to be required to file.

What should matter to the IO is her Current Annual Income, not what it says on her previous taxes (even though they can still check the whole scenario). If her income now is above the poverty line, you guys are good to go and no joint sponsor is required. Send employment letter and paystubs to support that.

I understand that since it's a new job, you might think you need a joint sponsor, which is fine and will eliminate the trouble a misinformed officer can cause. But a joint sponsor in your case is not required.

Ayrton got a reaction from millefleur in Documents to have correct name on SSN card
You could've had your name fixed on the I-94 by just emailing them/filling out a form on CBPs website. I did that back in 2019. They replied with an email asking for a copy of the passport and less than 24 hours later my name was fixed.

For the SSC issue. You need the form, an ID and proof of status. Since you're sending EAD, it covers the last 2.

I would send a cover letter though explaining that your card was issued with the wrong name and you now want to get it fixed.

I'm sure you would remember if you sent it or not, it's a big form with a lot of evidence that goes with it, credit report, colleges degree evaluation.

So if you received it, it probably means you didn't send it. Do it asap, there's probably not much time left on the RFE.

File for I-90 online, so you don't need to send the card right away. When they're ready to issue the new card, they will send a RFE requesting the old card. And before you send the card, you can get a stamp if you need it for something.

I tried to expedite my I-90 and they said nope.

You can still use the card as proof of being a PR. The card is only void when USCIS adjudicate the case. If they deny for example, you keep the card you have.

    You're not a Conditional PR.

Ayrton got a reaction from Chancy in Social Security Administration is a mess
I changed my name in the court last year, after applying for my AOS.

I sent all the paperwork to change my name on the SSC and they rejected saying that I should have to change my name first with immigration, which was not correct. So I sent a second time and included their instructions saying that I didn't need to change with immigration first.

After less than 2 weeks I got the new card. So I'm assuming there was no SAVE verification, since my name in the USCIS system was not matching the new name. Or they verified with the old name and issued the card with the new one.

But anyway, it took only 2 weeks and it was during pandemic.

Not every AOS is from K1. Some people take years to apply for AOS. Someone can arrive in the US today and commit a crime tomorrow. Their previous background check are useless.

Background checks will always be happening for every application sent.

    You are definitely overthinking.

If you' were given a waiver at the medical and the sheet was completed. You don't need to do anything else. You didn't need to take the vaccine afterwards.

    From the USCIS website:

"4. Vaccines Not Routinely Available Abroad
“National vaccination shortage” principles do not apply overseas. In the context of overseas vaccinations, the term panel physicians use to indicate the unavailability of a vaccine is “not routinely available.” Therefore, if the adjustment applicant is permitted to use the vaccination assessment completed overseas, [11] then officers should not find the applicant inadmissible solely based on the lack of the vaccine(s) that is “not routinely available.” Officers should also not issue an RFE for corrective action. USCIS will grant a blanket waiver in these cases."

So you don't need to find a CS. You didn't even need to take the vaccine.

Ayrton got a reaction from Jackie1011 in Is my DS-3025 completed?
You will give your original medical to the POE officer.

You don't need to send the DS 3025 with the AOS package. This is not a requirement. The instructions say that you need to show that you received the vaccines, and since the original is already in the sealed envelope, you don't need to send it again. Some people send it to make sure the officer reviewing the case knows it was already done.

I would not send the copy you have. The panel Physician made a huge mistake of adding vaccines that were taken after the form was originally signed. How can you have on the form a vaccine that was taken in Jan 2021 and the form was originally signed on Oct 2020? The officer can easily think you edited the sheet yourself to add that.

You should ask the physician for another form of proof that that vaccine was taken.

As long as the medical was completed with no issues and vaccination was completed and you filed for AOS withing one year of medic date, no need for a new medical. Sending DS3025 with AOS is optional, since not everyone receives a copy of it.

Don't reschedule it. Go to the interview and say you didn't receive the medical yet. They will issue a RFE. You will mail it to the office and they are gonna issue the GC after that.

Her current income is gonna go on the 864, questions 7-20. This is the form used to determine her eligibility as a qualified sponsor.

The I-944 asks for the Total Income on the returns, if any. Since she didn't file any returns, that's what you're gonna write down.

Focus on proving the current income on the 864 form. She needs to get an employment verification letter and paystubs to prove her current annual income.

Your quote is a general definition for what they use to compare to the poverty line. For example if you have a salary, your annual income will be the whole thing, before retirement deduction, before tax deductions.

For Self Employment, you annual income is what you take home after your business deductions, it should be on the schedules, but before marriage tax credit and other deductions like that.

Then I wouldn't worry. If you don't get a RFE, they won't even talk about it at the interview. You still have some time to file taxes. Wait until you have the ready to schedule update before you file taxes. If you do get a RFE though, find a joint sponsor and file taxes as usual.
