Change locks, file for divorce, do not talk to her or if you do, make it through a lawyer, do not be in her presence without witnesses, etc.

    Sorry it didn’t work out.

I will chime in that to cover yourself, you’ll want to maintain distance from her.  Document anything that happens & call the police if she shows up.

Most importantly, file for a divorce.

I agree with @Ben&Zian.   I would stay away from her......Her best chance of remaining in the US is to find a reason to claim abuse....and that could get you into big trouble.

File for divorce. Move on. You won't be impacted by it at all honestly. What she chooses to do is on her, not you. She knows she needs to leave because she is out of status, and if she doesn't, it's on her. She knows you're the only one who can help her adjust so. Divorce, and just keep away from her and protect yourself. Trying to "force" her to go home might backfire in some sort of abuse claim, so again just stay clear or her.

The embassy does not have to look at any documents. They aren't required to. They can simply go off the initial application from the applicant. Having a child in the US, who is potentially nearing citizenship, to the CO says, she will stay there and adjust status.

As long as you don't enter USA, it doesn't matter what you do before that.
MAKE SURE there are no transfers in USA (which doesn't look like in Your case). Once you enter USA, You CANNOT (Shouldn't) leave until you've got GC or Advance Parole.
They won't be bothered about one-way or round-trip tickets, as usually round trip is a lot cheaper than one way, and they care less where you enter from.

Talk about muddying the waters! The whole point of a K-1 is because you want to get married, you're ready to get married right now. So, by your logic they will tell USCIS that it was a mistake to get married but they want to get married and this time it's not a mistake. If I got that phone call at USCIS I'd have a hard time believing the whole situation is a genuine relationship. How can an engaged couple get married by mistake?

All in all, the CR-1 is better, in my opinion.
     K-1
        More expensive than CR-1
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
Spouse can not leave the US until she receives approved Advance Parole (approx 3-4 months)
Spouse can not work until she receives EAD (approx 3-4 months)
some people have had problems with driver licenses, Social Security cards, leases, bank account during this period .
Spouse will not receive Green Card for many months after Adjustment of Status is filed.
    CR-1
        Less expensive than K-1
        No AOS required.
Spouse can immediately travel outside the US
Spouse can start work if desired
Spouse receives Social Security Card and Green Card withing 2 or 3 weeks after entering the US
Spouse  has legal permanent Resident status IMMEDIATELY upon entry to US.

All-in-all, the CR-1 is superior to the K-1 imo.

I'm no expert and there are people on this site with much more knowledge than I'll ever have. That said, do not forget that you are dealing with the federal government. So, everything must be done correctly with no slip ups.

My thinking is if you try and continue the K1 at this point (not saying you are; just an observation), you could risk shooting down your chances of even a CR1 visa.

Do it correctly regardless and withdraw your K1 immediately and subsequently initiate the CR1. It will cost you more time but think about where you will be in the long run. Sounds like you didn't plan ahead and went with the moment both with filing the K1 and getting married.

Congratulations on your marriage. Now, slow down, think things through, and do it the right way.

Damn, such a waste of time and money though. Now you have to start everything from the scratch and pay new fees...
I've seen few posters who decided to get married while waiting for their K1 to be approved and it's always such a shame. Few more months and you'd have a visa and now you have to wait over a year for a spouse visa.

Also, don't try to continue with K1 thinking that USCIS won't "notice" your marriage. It will and you'll just create more problems for yourself. Just saying.

oh man, now you will need to start over!

you can no longer continue the K1. that is for unmarried people to marry inside the US. now you will need to withdraw that one. and then after that's completed, file CR1. you know that CR1 takes ~12-14 months, right? you just unnecessarily wasted money and 4 months on a K1.

If your wife applied for a tourist visa with intent to enter the US and adjust status, she is setting herself up for a misrepresentation charge......which would result in a lifetime ban.........want to go that route?

Also I would just like to say that the minute a CPB sees your foreign wife trying to enter the country with a tourist visa with a US citizen husband she will be scrutinized and they will find out she has immigrant intent and she won’t be allowed in the country to which will come with a bar permanent or temporary. Not really worth the risk is it?!?

Yes, that is the purpose but your attitude is why people are giving you grief.  You came for help with an attitude and your high level plan.  Then, you got defensive and snotty.  People will not help you if you are snotty and superior and think you know it better with your high level plan.   Be humble when asking for help.

You could have said you had a plan.  Instead you came for help with your HIGH LEVEL PLAN which implies a sense of superiority.  Please explain what makes your plan "high level?"

You could have answered "thanks Sarah."  Simple and to the point.   Instead you choose to add "but I already received that answer."  There was no need for the but.  It makes you seem snotty.  It came off as "thanks but no thanks because I already received that answer."

When someone ask "wife?" you got snotty again.  You could have said you misspoke and meant fiancee, but no . . . you had to make up a BS explanation.  Wife is not the future tense of fiancee.  Tenses are for verbs, not nouns.  A child rationalizes and BS even when not necessary.  No one would have though less of you for a simple mistake, but you turned it into pure BS.

    Attitude counts.

You can NOT come on a K1 visa, apply for your EAD, then go back and forth to your home country. If it was that easy, we would all do it. Trust me, my husband hates not working and would do this in a heartbeat. You need to stay in the US and NOT work after entering on the K1 visa. EAD cards are taking about 6 months at this point. Once you leave, you will not be allowed back in. End of story.

Just a point of clarification, it is not that anyone is not allowed to leave the US, but rather not having documentation for re-entry to the US.

Your plan as mentioned above isn’t the best timing wise. If finances are an issue it will be better for you to visit on ESTA, get married, apply for a spousal visa, leave and wait for it to be processed while working in Europe. You can still always visit while it’s being processed. It should take around 12-14 months to finish. Bonus points you get to enter as a permanent resident eligible to start working in day 1.

    Of course you can leave.
You will NOT be able to come back to the US though.

Yes you can. But you won't be able to return back to the US.

You use Advance Parole/Work Permit combo card. That you need to receive BEFORE YOU LEAVE US. If you leave before you get that, you will NOT be able to come back to the US.

Then you should not have apply for K1 visa at all.  And 3 months is very optimistic. Some people are waiting for 6 months for their work/travel permits. K1 rules are very clear, if you knew the work will be an issue, you should have apply for the spouse visa instead.

basically this is how it has to look like:
You arrive on K1 visa. You get married.
You apply for AOS and include Work/Travel applications.
    You WAIT in the US.
Once you receive your travel/work permit, you can travel and/or legally work in the US.
/Once you receive a green card you can also travel/work but you cannot be outside of the US for more than a year.

Current timeline for green card is about 12 to 14 months.
Wait timeline for Work/Travel permit is about 3 to 6 months.

If you leave US without AP, your AOS will be considered abandoned and denied. And in order to come back to the US, you will need to apply for spouse visa and wait about a year for it.

So yeah, it's a pretty bad plan.

Fadae reacted to shawndee in Questions on New I-134 That Expires 11/30/2018
This process has been fairly straight forward for my fiance and I up until this point so, I'm hoping to get some help. And, as us newer filers know, there is a new I-134 form that doesn't match the example on the VJ Site.

As per the instructions, you are supposed to answer all questions and, if a question doesn't apply to you, type "N/A" or "None" if it is a numeric response that is zero. Ok, got that. My question is: Is that for EVERY space that would be blank? For example, under "Sponsor's Mailing Address", since I live in the US I wouldn't fill in the "Province" box. Should I type "N/A"? I only ask this because there will be a lot of "N/A's" on my form on certain pages ("Beneficiary's Children First Name, Middle Name, Last Name" etc., for example) and I'm afraid to do that if that isn't what is required.

Also, regarding Part #3. Question 26.a.: "I have submitted a visa petition to USCIS on behalf of the following persons". Would that be my fiance? This seems redundant as all of her information was entered in Part 2. Or, is this info entered if I have petitioned someone else that isn't her?

I realize that I might be overthinking all of this but, I'm sure that you can relate to wanting to do it correctly. Is there anyone that has used this form and has been approved willing to post a mock up of how they did it? Thanks for your help!!!

    To answer the OP:

If you follow VJ's example I-134 form dated 2011 - Question #11 regarding contributions yes/no boxes are left "unchecked" and in the explanation section, you are to write "N/A (K1 Visa Process For Permanent Residence)":
    http://www.visajourney.com/examples/Form-I-134.pdf

In the new revised I-134 form dated 2018 - Question #38 now regards contributions.  If we are to follow VJ's example, you would still leave the yes/no boxes "unchecked".  But now, your explanation is submitted in Part 7 on page 8 of the new form.

    You will do this:
    3.a. "Page 4"
    3.b. "Part Number 3"
    3.c. "Item Number 38"
3.d. "N/A (K1 Visa Process For Permanent Residence)"

You're basically giving the same information as in the old I-134 form, but, in a different location:

    Hope this helps everyone!
