Marry in april to august  in Canada and you will be in sequence for a spousal visa at 12 to 14 months.  She will even have a green card awaiting.

We also filed in February 2017...  It is incredibly difficult.  I admire your good spirits.  Sometimes we are full of faith sometimes we are utterly depressed...depends on the day.

How many updates have you had?  Did you involve the senators or local congressman?

We were getting lots of updates but the last two months have only updated because of an inquiry from us or our Senator.

It will be a year this May since I took Shahada in Dubai during Ramadan.  I was hopeful my husband would be home with me this Ramadan.   I know InshallaAllah it will all work out in the end but in the now it sucks!

They are not saved from Administrative Processing.... They can refile or marry and file a CR1 and still be put in the black hole.

The US embassy of Pakistan is extremely tough on divorced couples.  Especially when the Pakistani is divorced.  It always gets some type of scrutiny (even if its just submitting extra docs and a few months in AP).  A large majority of them are treated this way.  Calling people liars is something this embassy does frequently and they can tend to be rude and not willing to listen.   Most definitely there was something they saw about your case before you got there that made them decide to return it hence why they were not open to any more discussion.

Whatever that is you need to really think about how to overcome it.  Getting married and filing a spouse visa is not a guarantee it will work in your favor.  I'm sure if you think about how the interview went long and hard you will know what issue they had with your case.  If you really do  not know you can attempt to file a FOIA with the USCIS to request the counselors notes.

Divorce differs by state so you'll have to read the details based on the state you reside in.   I live in Pennsylvania and filed for divorce in 2014 but because he refused to sign the papers it didn't complete until 2016.

As others have said you can send the evidence to USCIS and let it go from there.

I also agree in getting child support.  File through the county you live in.  He must support the child.  If not supporting her makes his citizenship difficult than thats a plus.

So sorry you are going through this.   I hate reading stories like this...for these types of people make the process harder for others.

    Good luck to you!

I feel for you.   You get to the interview with high hopes only to find out you are not thrown in a black hole.  No-one knows how long, what they are doing and why you are there.  It's truly depressing...those who have never been in this situation have no clue.

There are days my husband and I don't get out of bed.   We are both athletic but my husband hasn't been to the gym since his second interview in October.  I have been exercising much less.  We've both gained weight.  We cry a lot..we pray more...sometimes we even ask why are we praying.   Allah brought us through so much after our case was returned we were so excited for that second interview this truly broke our spirt.  My mind is so off somedays.. I feel like I can't even articulate properly..it sucks!

You'll have good days and bad days try to do your best to keep yourself busy.  One day it will all be over and this will just a be a memory...a bad one but a memory none the less.

I've only seen two sets of parents (fathers received ds5535) get their visas from Pakistan in about 2 months.  Other countries i've seen get the visa in about 4 months.  Pakistan and Morocco seem to have a longer processing time.  This time last year Pakistan had about 6-8 month processing time unfortunately it seems to be getting longer and longer.

Ahmed&Freda got a reaction from NikLR in Need some guidance and help about US visa
As Kastrs has mentioned you do not need to meet multiple times before the marriage.  It's not culturally accepted in Pakistan to meet many times before a marriage.  My husband and I also married on our first  visit but that wasn't even brought up as an issue.  What was an issue was my husband and I both being divorced, they also didn't like that we met online but that was a small issue.  The divorces have caused us the most hurdles.

If she is much older than you and was married before you'll need to overcome those red flags and prove that your relationship is not for benefits.   I do agree you'll  need more visits before the interview.  Not much commingling of finances can be done from abroad but you do your best to combine your lives as a married couple (read the guides above).

Make sure you are both prepared that this could take years..if you're not up for it turn back now.   It can be emotionally draining and agonizing at times.     Living apart from your life partner is extremely difficult and gets harder everyday.

My senator always gets a response in about a day.   It takes a week if I inquire.   You've been waiting a long time I would see about getting the petitioner to contact the senator in your area.  I have seen where they stop answering inquiries but will answer the senator.  I don't know if it means anything is wrong or they just give up on answering after so many inquires.

    Hi @Chaudhary231

The word sponsorship can be interpreted differently. “Paying for the trip” is different than how true sponsorship is interpreted by people dealing with immigration. This is because, when a US citizen  or permanent resident sponsors a family member for an immigrant, they sign a document (Affidavit of Support), that is legally binding, that states they have the financial capability to provide for the family member. If the family member becomes a public charge, like welfare, after they arrive in the US, then the government can use the legally binding affidavit of support to sue the Petitioner who applied for the member. The AOS is a legal requirement by the US government in order for a person to bring over family. Your wife’s family had to sign a AOS.

For visitor visas, however, AOS is not a requirement. There is no legal support document require by the US government for a foreigner to get a visitor visa. So even if someone is paying for a trip, in immigration terminology, it is not a true sponsorship.

Furthermore, there is no mention  or process of “sponsorship” when a person applies for a B2 for tourism. In fact, there is a section on the US visa website that states that a affidavit of support is not needed....

“Note: Visa applicants must qualify on the basis of the applicant's residence and ties abroad, rather than assurances from U.S. family and friends. A letter of invitation or Affidavit of Support is not needed to apply for a visitor visa. If you choose to bring a letter of invitation or Affidavit of Support to your interview, please remember it is not one of the factors used in determining whether to issue or deny the visa.”

I would give them some time to look into things.   Once a questionnaire is requested visas are typically issued (except for Diversity visas) after an extended period.  If they weren't serious about the visa they would just deny on the spot and not go through the leg work of background checks.  Its hard to say why the questionnaire was given or how long it will take sorry you can't get more help than that.

Hopefully you'll hear good new once the AP is completed.

Yes the petitioner can join.   I've been to the embassy twice and stood next to my husband during the each interview.

It can be helpful but if there are any issues  in your case the petitioner attending will not make the outcome any different.
