    Myself and my newly husband (U.S citizen ) just did our traditional and court marriage here in Nigeria.  But we want a quick process (K 1 visa) . My question is : he can file a K1 visa right, doesn't necessarily mean it's just for finances?  Thanks

    Then why were you concern with "How would the US Government know?"  If you were going to be completely honest and disclose everything, you shouldn't be concern with how would they know because you would tell them about the marriage in Mexico.

    Zero chances.  Not wanting to spend money on a plane ticket is not an extreme hardship to you. 
     
    Instead of wasting money sending in an I-129f that will be denied, why not spend the money on a plane ticket?
     
    If you go ahead with this, here is what's going to happen.  I-129f denial for not meeting the requirement to meet within 2 years, thus money and time is wasted.  Then you have to buy a plane ticket to see her.  Then you have to pay again to file a new I-129f.  
     
    If saving money is the goal, then fly to meet her before you file the I-129f.  Otherwise, you are actually wasting money by filing without meeting her.

    What you submit (all three or just the most recent) is not the issue at hand. Whether he filed all three years is. 
     
    You would just submit 2018.
     
    You would still have to answer questions 24a, 24b, and 24c with the amounts of income he reported from his FILED tax returns from 2018, 2017 and 2016. Knowing what he made because he has a W2 for 2016 is not enough. The amounts are derived from his actual tax returns. 
    If you were to input the amount from his W2 in Question 24c, what are you going to answer for 23a?
    "Yes" he filed all three years of taxes? That would be untrue and certainly they could find out very easily.
    If he checked "no" for 23a then he would have to check question 25 and submit a statement as to why he didnt file for 2016. Forgetting is not a valid reason. He would have to have not earned enough to not have to file. And that's not the case with him.

    Traffic misdemeanor which can be short jail time and a fine. Also, you may not be covered by insurance so if something happens you may not be covered. I don't think you want to start your life in the US like that. Why not just take a uber or lyft or see if a family member can take you or your hubby could take off?

    Trying to change original plea will not be easy, and have to be convincing... most judges probably will see right through it as something made up to get asylum now that you realize you'll actually be deported. It's called a desperation technique used by a lot. No offense, but it would be different had you originally claimed fear of persecution, but you even said they asked if you feared going home, and you said "No"... doesn't matter what type of hearing it was, you answered it and now are trying desperately to change it... Deal with the consequences of decisions made, don't backlog this countries court system over possibly frivolous claims like so many others.

    Also when you file your US tax returns, if you are married in the tax year, you would file as MFS or MFJ.  If you file as MFJ your wife is treated as a resident of the US for tax purposes and her world-wide income is also included on your tax returns.  Do more research on filing US tax returns while residing in a foreign country or get a good tax accountant who knows this area of US income tax law.  You will also need evidence of US domicile.  Read the guides.  Do your research to learn more about the process.  It will prevent problems later if you do.

    Hello vj FAM! I'm glad to announce that I got approved for my k1 visa. I want to sincerely appreciate everyone who God has used to answer my questions here as well as the experiences of those who have gone ahead of me in this whole process, thank you for sharing. So my interview was on the 8th of march 2019 I got there after been rescheduled, the immigrant queue were asked to go in perhaps because we were been rescheduled. I wasn't lucky enough to hear that as I was so far back in the midst of the crowd. Oh well I asked the security lady, she said there would be a recall. I didn't wait for long, I joined the general queue, they asked me why I had just my appointment letter, I told them I was been recalled and had submitted my documents already together with my passport. I went pass security checks. Finally it was my turn to be interviewed. I saw about two other k1 applicants there. We weren't many at all. I was asked about 4 questions
    When did you meet in person?
    What year did you meet
    Where did you meet?
    Why do you want to get married to him?
    What do you love about him?
    Tada! She approved me even while I was still talking about why I loved him

    Hello, fall 2017 filer here. I got approved recently after responding to an RFE for my I751 petition. The forum has been incredibly helpful, arguably better than some immigration lawyer I spoke to. I want to share my experience and timeline in case it might be helpful or can alleviate some anxiety out there.
     
    Timeline: Fall 2017 jointly filed, Biometrics followed up very quickly in 2-3 months time. Then long wait until Feb 2019 for RFE for general documents to prove bona fide marriage. I responded in two weeks after receiving RFE. The response was acknowledged on Friday the same week the documents were delivered. Card in production around 10 days after the acknowledgement of RFE response. Long wait but quick turnaround after RFE response. 
     
    There is one complication with my RFE: after getting married, my husband and I lived two years together and we lived apart for two years because of work reasons (relocation, different city) and then we were physically separated for another 8 months because long distance take a toll on our relationship. So when filing jointly 2017, we did not live together but NOT by choice, when receiving the RFE, we were not living together BY CHOICE. As you can imagine, this creates a complicated situation because we are in the limbo mode: not divorced but not living together either.
     
    I consulted an immigration lawyer about the best strategy going forward and he suggested me to get a divorce first, wait for the divorce decree and then respond to the RFE by switching from jointly filed to a waiver. He thinks this process will probably take more than a year and he thinks rather than wait for approval on 751, I should wait until 2020 to file N400 to force an interview happen quickly. All makes sense right? I thank god every second for not listening to him!
     
    What I did instead was to write a long letter explaining the ups and downs of our marriage as well as having my husband write a letter. In the letter, I told the officer that a divorce down the road is considered but we have not yet decided finally. I also told the officer that we want to REMAIN JOINT FILING STATUS. Note: my husband and I are still on good terms despite separation. I decided to be 100% honest with USCIS and listed my past address since we get married. Of course, I also sent a giant packet with photos, affidavits from a couple, banks statement for past three years, IRS transcript (I sent returns initially, not transcript), Amazon orders, birthday gift receipts, copies of driver's license with same address showing, copies of my H1B visa to prove I did not need green card to stay in the country, the proof to show that first two years of living apart was not by choice, and flights and hotel reservation for past trips. I bought a big multi-layer folder and fill it in full. Overnighted it via Fedex to USCIS.
     
    ~ Two weeks later, I got approved!
     
    The moral of the story is 
    BE HONEST - worst strategy is to lie in an immigration application Lawyers are incentivized to complicate the situation so that they can charge you more. Also some of them are too busy that they will rarely help you respond to an RFE in two weeks, only you can do that. USCIS apparently values timely responds as indicated in their notification when RFE response is received. For really complicated situations you might need a lawyer, but be aware of their incentives and don't get bluffed by them. Word of mouth is probably important here when looking for a good responsible lawyer. USCIS officers understand marriage fall apart and takes a very humane customized approach when looking at our cases. Don't be afraid that they might not understand. As long as your marriage is real, you have nothing to worry about. Be creative and exhaustive with your supporting evidence. I underestimate the document requirement when I first filed, I thought they might retain the file when I get my conditional green card and merely send a few updates. If you have not filed yet, be sure to send as many documents as possible to avoid RFE. Be creative means not only tax document, children birth certificate or mortgage, you can send anything that shows you get married because you fall in love. I actually sent in the Facebook page of our relationship status change many years ago when we first started dating. Be as detailed as possible in your cover letter and in the affidavit letter. Let the witness talk about events you did together, how you get to know each other as a couple. Amazon orders histories are good proof of joint living as well as relationship.   
    This is a long way to say, don't be afraid of RFE and don't be afraid that a damaged marriage might cause a denial of your petition. And most importantly, if someone say, you will definitely get an interview because you and your husband don't live together any more, WALK AWAY from that person as they know nothing about I751 petition.     You have no fault but the situation is created by thousands of others who came to US on visitor/business visas and never returned. V.O. was probably thinking like, “an unmarried person of this age going to US on a not so important conference, does he lose anything if he stays in the US and doesn't return back.” 
    It happens due to other people of your own country.

    You need to have a heart to heart with him on this. Don't let anything undermine your marriage, and resentment can be the start of really bad things if you don't get it in check. Tell him how you feel, in a kind respectful manner. That will go a very long way.
     
    I can only imagine you are a little homesick, so keeping your mind occupied with things to do will help, and so I could see your reasoning about moving to a bigger town, where there are things to do. Be willing to bend a little, not that you haven't, I'm sure you have, since you immigrated here to be with him. Surely he will consider seriously what you have to say, especially since you have to drive such a long distance to your job. I would kindly make mention of that as well. This is a hard process to go through, and I can't imagine that he doesn't highly value you, enough to do things to help you be a little safer, like doing something to help cut down on that drive!

    Then don’t get the plane ticket for April. Get it in August or something. It is best to get the plane ticket after you know when the oath is. Or if she must go in April and the Oath is in April, then maybe reschedule the Oath until after she comes back. 
     
    The precedure is what the procedure is, doesn’t matter how much you don’t like it or whine about it. To me, it’s pretty reasonable, you go to the Oath, you give up your GC because you no longer LPR, then you become a US citizen and you can apply for US passport. So really you’re whining about how long it takes to apply for a US passport, which is 2-3 weeks expedited or 4-6 weeks normal processing. PLAN AROUND IT, like the rest of us do.

    I'm really sorry that you find yourself in this position. It must feel awful and uncertain right now. 
     
    It sounds like you could do with some support before you can tackle what to do about your application. There are support groups you can contact to help you through this stage  - https://nationalwidowers.org/support-groups/  They may also know of advocates that can help you with the practicalities. 
     
    It is very early days so take your time to grieve.

    My friend was in the same situation, she had to wait to the 5 year mark to gain citizenship as a widow. 
     
    I do do feel your pain, I was married to my husband for 2.5 years and he unexpectedly passed. He had a conditional GC, and yes, the death certificate was submitted to the gvmt and now 2 years later I got notice for his deportation (since we never filed to remove conditions, duh; he DIED!). That's our government!

    Sorry for your loss.
     
    Under section D. 2 you can see that you no longer can continue with your N-400 at this time. (You can apply again under the 5-year rule)
    You can contact USCIS and explain that your spouse has passed away and that you, therefore, are withdrawing your application for the N-400 I would attach his death certificate if it was me.
     
    You do not have to start all over with the ROC.

    You can't gain citizenship through marriage since your spouse passed. Also, don't tell people they can't post that's against the terms of visa journey. Are you sure it was negligence? If so, get yourself a lawyer.

       My husband received his Green Card in the mail one week after our interview!!!.
     
    We are both breathing a sigh of relief and we are happy to have an almost 2-year break from immigration.  Wishing you all a successful trip on the rest of your journeys.
