sy1983 got a reaction from Keeley in Health Insurance
Several options come to my mind.
1)Give birth abroad and file CRBA which is super easy and takes about a month for the entire process up until getting the US passport.
2)A full time job would offer health insurance for spouse and family members.
3) Call Medi-care in your state and ask for assistance, they are lenient with pregnancy and children, sometimes there are programs they can put you in for the mean time
4) Look for an insurance agent instead of getting bombard with ads online, they are usually quite knowledgeable

Sorry to hear of your story. How much time passed between you meeting him and getting married to him?
You probably need to accept that you are going to lose quite a bit of money no matter what in this situation. Federal immigration law is totally separate from state divorce law. I would imagine that he is still entitled to half of whatever you made during the marriage regardless of his immigration intentions. So you will either lose the money to him or to a lawyer in the end unfortunately.
I just want to point out that these situations also happen all the time between US citizens. How many people do we all know that got married, found out the person wasn't really who they thought and had a nasty expensive divorce? Probably you know more than one. It can happen to anyone. So don't beat yourself up too badly. Next time you find someone, really take your time and get to know them/live together for at least a couple of years before getting married.
On the flip side, there are immigrants who come with good intentions in a marriage to a US citizen, and those US citizens completely take advantage of them. I've read cases where the immigrant followed all the rules, did everything correctly, and got screwed over by their US citizen spouse making false claims to the authorities.

Well I can only give you experience of my best mate. His ex lawyered up and so did he in order to defend against her. End result almost a million dollars between the pair of them in legal fees and it financially ruined them both.
As much as I would love to say fighting works - far better to reach a mutual agreement because the only winners end up being the lawyers who have no incentive to settle.

Ah, if only it'd been a girl it would be a completely different answer...
But no, you don't get anything for having a child of either gender in the US. Other than a large bill, which I'm hoping you paid in full.

Was it in a state that Common-law marriage practice is accepted ?

How long they lived abroad has no bearing on it. They abandoned those ties for the sake of their spouse, and created new ones in the US.
The reason for somebody coming and the reason for wanting to stay are separate issues. The marriage is why they came, but their new ties are their reason to stay.
A USC cannot petition a parent until they turn 21. That's a heck of a long time to be separated from your child.
I get that you disagree with the law. But this is not a loophole...the law was clearly written with this intent.

sy1983 got a reaction from Orangesapples in Is he able to get his permanent residence card?
I agree. Im sorry to hear that he was cheated on and the marriage didnt work out but the whole point of issuing a permanent resident status is solely for
marriage. If the marriage doesn't work out on either fault of the party then residency should not be allow and should go back to home country, where he is from
and back with his family there. It makes perfect sense ..

No, no, no! Don’t follow this advice. You are K1 not spouse visa. K1 is not processed at NVC. Once you have your number from NVC you schedule your medical and interview at the embassy. Keep tracking your case on ceac to see if it’s arrived at the embassy so schedule your apppointments accordingly. Gather all the documents you will need at the interview. Medical needs to be done before interview.

It really depends on the interviewer, in my wife's interview they didn't ask for the original copies. Not even a word of mention.

Sounds silly but some states have no time requirement. For instance California, if you have relatives in Cali (which almost everyone does) maybe she can stay with
her family there and get free health care.

I fly to the Philippines all the time, I lived there for a couple of years, met my wife and we often visit home. There is nothing wrong with the fear of flying
but I gotta tell you, you should definitely visit the Philippines its a lot of fun. Why not fly with a safe and reputable airline ? Nothing is gonna happen man.
these big jets are way different from the domestic flights. Just this year alone I've done 5 trans pacific flights.
She can probably apply for a visitor's visa and whip up a good invitation letter on your part. Getting a visitors visa in the Philippines is not extremely difficult, she
should show strong ties to her home country and being able to financially fund her trip.
The thing about filing for k1 is to show proof of this legitimate relationship, if you can do so then I don't see it being a problem

sy1983 got a reaction from David & Diana R in Wife on Green Card & 4 Months Pregnant?
In California there is no 5 year ban, any legal immigrant can apply for L.A care and Medi-cal and they will determine your eligibility.
You can also check with your local hospital, they offer big discounts for people without health insurance.
Getting a full-time job right now and getting them on your coverage is a good start.
If you absolutely don't have any other means to pay for health insurance, then I would suggest going back to her home country
and give birth there. When the baby is born, file for CRBA and within a month, your child obtain US citizen and a US passport.

Let me get this straight, your ex-fiance petitioned you but things didn't work out so you are trying to find a way to withdraw yourself
or like many have said, wait a year until it expires. For me, this means your relationship just ended days or weeks ago, but somehow
you are already asking if this can affect your 2nd petition before your 1st expires.
If you can get engaged to two different USC within ONE year and somehow talk them into petitioning you right away, clearly you are meeting
USC for the sole purpose of migrating. I hope they outright reject you and put a ban on you.
