Tourist Visa frm Manila to USA

Hello Folks,

 

What are the odds of a fiance getting a tourist visa to the USA while K 1 visa is in process(just started)?

She is self employed. Has business licenses. Rents an office. Owns a vehicle. Has child that will stay behind with sister while she travels.

She has a sister here that is citizen and came in on K1 7 0r 8 yrs ago. Here mother is here and wants to go back to Philipinnes. She wants to visit sister and take mother home.

Naturally we hope to visit as well.  She thinks a trip to Hong Kong will help as her sister was denied tourist visa and consular told her to go to HongKong and come back and re apply.

I have asked this before and have listed all the pros and cons as I see them.

Any thoughts or experience would be appreciated

Unlikely, due to intent to immigrate.  Why the rush when she will be in US via a K-1 in a few months?

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Roll the dice and spend $160 that is the only way you will know for sure

Thanks for the reply.   As to "Why the rush?""    The answer is irrational. It is hormone related.

 

As to "roll the dice""  I dont mind chancing the $160.00 but would not want to see her get a plane ticket and get turned around at the border or worse yet stack the deck against her/us as far as the status of the K 1.  We have been going back and forth on the roll the dice question for some time.  The decision was to file the K 1 and wait. But sometimes women change their minds . . . . .at least that has been my experience!

 

I too must admit that I am not the most patient guy in the world . . . .

You only asked about the chances for a visa and nothing about the chances of admittance once a visa was secured.

 

A visa denial or a refused entry will not stack anything against you as it relates to the K-1

It's strange that the CO would tell her sister to go to Hong Kong and then come back and re-apply.  Going to Hong Kong is visa free for Phlippine passport holders for 14 days so going to Hong Kong and returning doesn't show much in way of reducing risk of overstay in my opinion

If she has strong ties to her country, it is kind of trying to to tell two different stories at the same time.  She wants to immigrate to start a life here (K1) and she has ties that prevent her from immigrating (B1).  This contradiction is not lost on CBP at all.

 

Best to try and use that money to see each other outside of the US while it's pending instead. My opinion.  I have a friend with a CR1 visa pending and the spouse recently came for a visit on ESTA, they gave her a lot of static and said that she couldn't do it again.

I seriously doubt any visa officer would suggest visiting Hong Kong will somehow turn a visa denial to approval. 

 

Is she paying for her trip to Hong Kong? If so, by all means. We have stores and stores.

I think the best thing to do is for me to try and get back there for the visit.  That way the plane ticket wont be wasted and she wont have to chance the hassle at the border.  There are things I  would like her to see here and help make decisions on while we wait and her mother really really wants to go home. Thanks for the advice everyone. I wont post this again. Maybe I will get lucky and the K 1 will go through quickly. Positive Thinking!

My wife tells me all the time I am the most impatient person she know but with the visa process you have to have patient,It is hard believe me I know

11/17/2016 : I-130 sent ( NSO marriage certificate took forever) 

11/23/2016 : I-130 case accepted notified by email NOA1

01/27/2017 : USCIS APPROVED NOA2

02/04/2017 : NOA2 hardcopy received in mail

02/28/2017 : Case received by NVC

03/02/2017 : Agent assigned 

03/07/2017 : Case number assigned with invoice

03/28/2017 : Fees paid (IV and AOS)
04/05/2017 : DS260 online form completed
04/09/2017 : IV and AOS package sent to NVC
04/12/2017 : Requested for NVC expedite
04/17/2017:  NVC expedite approved

She goes to Hong Kong, you meet her there and her mother flies to the Philippines alone. Simple solutions all round.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

The best way is to wait for k1 to be processed. Her chances for a tourist visa are slim to none.
