Most likely will. Whenever it does, I assume that it will have same immediate affect upon any new, or pending applications, they will simply be halted or denied, same as with the travel ban for the Middle Eastern countries in the previous bill. Affect was immediate.

You have some other issues still though you need to address with his petition such as the overstay, which again is right now a 10 year ban technically, then also, was the visa he used to enter originally even legal or obtianed illegally? Then need to get him to understand you never lie on immigration forms. Always be honest no matter what the consequences are, because being caught in the lie could result in life time ban.

I am assuming they want and need to see amended original orders to include her with original date, same as yours... Otherwise obviously they see a large gap of time.

I would be trying to get with the commander or even battallion commander or whoever actually deals with the orders in Korea and try to still get them to amend the originals if possible.. but it has been awhile so I don't know how likely that would be with possible change of commands/personnel changes and all.

    But on the other hand...
If you're in the US illegally, you should always remember you can be deported any time. Sorry, that's the price you pay. Fighting the deportation of illegals seems kind of silly...

Well the US was pretty generous really with allowing the ability to sponsor/petition almost entire families just by one member becoming a USC or LPR.

It's all in the "MEGA" thread.

Using one visa to enter to then change to another, which most likely was your original intention, is bypassing the whole process. If you wanted to go for an F1 visa, you should have applied for that, not used the B2. That's my honest opinion.

I highly doubt with being removed they would grant a waiver; but might as well try, doesn't hurt, just costs money. Or wait the ban time, but even after the ban is up, I doubt they are going to approve another visa anytime soon with a removal on your records.

I used the short form of "Vital Records" and supplied a copy of the bio page of my US passport, that was sufficient for us.

He should get a copy of his son's birth certificate yes, it has been asked for before regardless of whether or not the child is immigrating or planning to. This is generally asked for at the interview though to my understanding, not the I-129F petition phase.

And I'm just saying those are not reasons for the petition to be sped up or expedited. You need to start planning what you are going to do there though while waiting. That's all I'm saying.

I do agree with that, I work for a Danish company and during summer time, don't ever expect an email back from them, they all are on 6-7 weeks off.

Still, do agree when people have these 3-4 months all the time where they just travel, it's interesting what kind of ties they show to convince people they would actually have something to return home for...

I always wonder how even on the VWP people say they come for 2-3 months at a time... I wish my job would let me have 2-3 months off 1-2 times a year haha

Always expect the unexpected. Between marriage license, wedding/civil ceremony, even certified copies of the license to have for AOS and other things.

Any emergency stuff, clothing possibly.... I thought I had it planned out pretty well but then we got a puppy haha.. there was an unforseen expense but worth it.

Have you both met in person within last two years? And of course both are free to marry.

If so, then you can file for a K-1 definately. The denied B2 visas will have no affect on the verdict of the K-1.

If she is a legal status resident in Israel, she can be petitioned there. If she isn't then she would need to go through the embassy in Nepal.

This one I actually see no problem with (as opposed to more or less anything else the Republicans propose). The core family (spouse and children) can still be reunited. Allowing extended family members to immigrate has been generous, but seems unnecessary to me.

While past income on W2's or tax transcripts are good, if you have a job and are working already and can supply 3-4 pay stubs, employer letter, and such to show a good earning, it can definately help offset the tax return issue.

I myself probably would go a head and have your co-sponsor lined up just in case. Rather have one and not need it than need it and not have it you know.

As for the difference between house hold member or not... I think no matter who it is they have to qualify the same as in supporting themselves, any dependents, and the intending immigrant. Not just cover a short fall.

I don't think thst would qualify for expedite honestly. Sorry to say. USCIS does not really care about family issues....

As to issues at the embassy, it's hard to say. I assume in Tunisia, like a lot of African countries, that family approval  is a huge cultural thing, and not having your family approval could cause issues as it "out of the norm" for your country; but that being said, with you being a same sex couple, the embassy might also be very understanding of your situation and understand why you wouldn't have family approval... It is hard to say exactly how the embassy will view this to me honestly.

Part of the naturalization/citizenship interview and test is to write and speak English... I think even asking for a translator wouldn't be good...
