It has nothing to do with the distance. It’s based on the agreement between the states. Some states have agreement with each other in which one living in one state but working in another state just files the tax return based on the state of residence. In some cases with no agreement, one needs to file in both states, as a non resident in the state of workplace and as a resident in the state of residence but will get the credit for any tax paid to the state of workplace so that one doesn’t need to pay state tax twice.  In some cases one may be required to pay state taxes based on the residence even if they work on a state with no state tax.
So for people living and working in different states, those things need to be looked into from their states taxation websites.

So I just wanted to give you an update. My interview went very well and was super quick. The officer was really nice and understood why my husband couldn't be there. I was approved on the spot and have already received my approval letter.

I will have to agree that “on paper” your marriage does not look legit. You have been married for 3 years but within a few months in the US you separate to different states.

You have no evidence of comingling finances. Or sharing responsibilities of the household.

You have no pictures or corespondence in the 2 years of being together.

When it is time for your Removal of Conditions expect to be heavily scrutinized.

With a green card, you are authorized to work.  This is an immigration board, not a job search board.  If you want help with immigration matters, then VJ is a good resource.  VJ is not a good resource for looking for a job.  You should try the job boards; Indeed, Monster, etc.

You are confusing being able to apply with the chance that it will be approved. You can file, but what you want to know is the likelihood that it will be successful. Maybe I missed it, but why was the first K-1 allowed to expire? Death? Changed his/your mind? That's going to be the big question. Because at this point, it certainly looks like your trying to get to the U.S. - very common in your country. My opinion is that you will be denied. Why? Because you got a new U.S. boyfriend before the first one expired or shortly thereafter. Coincidence? Maybe, but doubtful.

Why does it say '' I GOT MY IMMIGRANT VISA'' when the person hasn't even had their interview at the embassy yet? What a confusing post.

way to be overly dramatic. No legislation is going to be signed that would impact your current status. Before that, A LOT of other immigration legislations would be signed but definitely nothing that would affect you and your case.
Maybe check out the threads from Jan 2017 - March 2017 AOS... plenty of other people waiting for their AOS. A lot longer than you have. Might help you see that you are not the only one. You haven't even waited a year yet. Or take some time off of VJ, that way you don't see others getting their interviews. You constantly have multiple threads going on regarding your wait time. You are driving yourself crazy.

Yeah the grass is always greener...

It’s not about the EAD/AP. It’s about being in a state of limbo, a gray area between being a permanent resident and not. The fact that a piece of legislation could be signed tomorrow that could drastically affect my life and we’d have absolutely zero legal recourse.

Before the two of you spout off about sympathy, there’s actually a myriad of personal reasons as to why the GC is important to us, moreso than the EAD/AP - so next time, take a step back and realize that despite what the two of you may think - there’s actually more to the story than you two know.

yup 150 days for me and thus have little sympathy for people who are complaining about not having their Greencard when they already have their EAD/AP and got that super fast. Not being able to work and live a normal life is what sucks. Had to wait 3 months longer than him to be able to work... but yeah... the grass is always greener on the other side.

While technically legal, the EAD submission from a K1 would have to be filed immediately upon entering, and would expire at the 90 day mark when the authorized stay under the K1 expires (I94).  As @Boiler stated, with the current processing times for the EAD being longer than 90 days, most likely the K1 I94 would expire before even receiving the EAD, so it would be a waste of money.

Regardless, this path is not even available to the OP considering they said they have been married for more than a year so I am assuming the K1 I94 has long since expired.
