Hello guys! I just wanna asked if  am i qualify  to apply a  new k1 visa with a new petitioner? I had a final confirmation letter recieved stating that my previous k1 visa was expired on may 7 2018 and me and my boyfriend now was going to apply a  new k1 visa and were 6 months in a relationship next month to apply and we already meet in person last march, is it good now for us to apply a new visa?

Technically your fiance can apply.

 

  But if you just had a previous K1 recently there may be some scrutiny on you case. They may want to know why you are jumping from one relationship to another and seeking K1 so quickly.

Actually i didnt used my previous visa, i choose to stay in philippines. I think its not that big problem for me to apply a new k1 visa .. and my new boyfriend was call to the lawyer regarding on my situation and both lawyer said that we can apply anytime as long as my previous visa is already cancelled.

But a petition was filed for you. And that is one of the things that is asked in the almost all visa application.s.Just because you didn’t use it, doesn’t mean it is not on record.

 

Like I said, they may ask about it so you should be prepared. They may see it as you are fiancé shopping for a visa.

I guess it could be say that i do shop a visa's  if i used the visa to take advantage on it but its not, thats why me and my x fiance withdraw the visa and could not used anymore since i recieved the final conformation letter that its already cancel.. but still i am aware and prepared  also for their questions regarding on it and i dont think so that they will denied me just because i didnt used the visa and jump into another one. But hopefully it could make it through by God's help.. thank u anyways for your opinion:)

It's not an issue to APPLY for a new K1....you can apply anytime after the previous one is cancelled. 

The issues can arise during the interview stage.  Amount of scrutiny depends on the time between the first K1 application, the date it was withdrawn, and then the date the second K1 application was filed.

so, i didn't use a lawyer because i didn't need one. but reading stories on VJ has led me to believe that K1 lawyers don't really know what they're doing. whi h makes sense, because final decision lands on USCIS and the consulate officers. that is all i will say. perhaps, your new boyfriend's lawyers are really good, who knows.

 

i'm with the VJers who think that the genuinity of your relationship will be questioned. you sure can apply, that's not the issue. eventual approval, however, is not as certain as the majority of us.

Actually, we have seen cases on VJ where a person was denied a k1 for having previous K1 petitions.

 

I'm not saying you will be denied. You may very well go through this with no problems. I am just informing you that it is possible that they may deny you. You should be aware of any risk to your case. If you go into this journey without being aware of any risks you will set yourself up for being blindsided and extremely shocked if there is a denial. 

 

Again, I'm not saying you will be denied. But I am simply making you aware that they may look at your history. And that it IS possible to be denied for it.

 

P.S. Here is an example of a person being denied a K1 for having a previous K1 that was withdrawn. And they are from the Philippines also...

Thank you for sharing..but she denied because her previous visa is still active? And her petitioner send the withdrawal letter to her? Why her and not forwarding in the embassy? ..on my case my x fiance send the withdrawal letter..maybe she didnt have the final confirmation letter stating that her visa is totally cancelled..in my part i had a the final confirmation.. well i dont k ow about her on what she did why her previous visa is still active

Seems so. But issues like that can happen. As you can see they did everything by the book with the withdrawal and still got denied. This is why i say you should be aware of these type of things.

 

If you do a search you will see older cases of being being denied a K1 for having a previous petition(s). 

 

You may not have any of these problems. But it is risky to go through this thinking that absolutely nothing will happen.

Thank you for sharing this Nuestraunion, it sounds so sad for me when i read it.. im still hoping and praying that our case will be going through  but this story makes me think alot so sad ..i hope theres a positive and good way on my new journey.

How can i make sure if i may not have any of this problems:(, it seems similar on my case!!! 

 

But when my boyfriend call the 2 different lawyer they both said that we can apply anytime as long as my previous visa is cancelled.. so i guess yhe lawyer knows best?
