    By hook or crook your spouse needs to go, do not reschedule, you need to get it while the getting is good!

    I wouldn't meet the 3 year requirement until April 1.  I also front loaded my petition pretty heavily.  I don't have many documents listed on the interview letter that I actually have to bring to the interview.  

     

    Mine is not a combo interview; I entered the US on an IR-1. 

    Better read your interview letter again. You mentioned you did not have much to bring. The letter states if you submitted documents online then you should bring the originals with you to the interview. We all know they might now even ask to see them and what you uploaded is enough, but you gonna take that chance you get a IO in a bad mood that day. My wife's interview is on April 11th.

    My wife just got her 24 month letter in October so are they only sending these out for people whose extensions are close to expiring?

    USCIS changed from 24 to 48 months on the GC extensions for the I-751. USCIS is starting to send the new 48 month letters out to eligible people yes!

Speaking from experience, your best offense (since you are going to be the one filing) is to remain civil and cordial, the more you raise a ruckus with her the more pressure and reaction she can levy against you. Like what has been pointed out she only can get a 50/50 split of the assets you accumulated during the marriage, so stop accumulating!!

     

    It is in your best interest to get the ball rolling NOW and end this swiftly. Encourage her to naturalize as also what was pointed out her naturalizing gets you off the hook for the I-864. Another important tip: Should you have carnal knowledge with her at any time during this time where you have made it known that you wanted a divorce that will go badly against you later in court. Also protect yourself against false domestic abuse allegations. Depending on your state and in most states the cards are going to be stacked against you.

     

    My recommendations do a DIY divorce you can get the forms online again depending on your state. It works well especially if you have no kids as you say, and no property. If you are going to do it...DO IT. Mind you with today's divorces you do not need a reason to divorce each other. File before she does and I am sorry for your troubles, but like war marriage is hell and you have to defend and protect yourself.

    I got married to my spouse (U.S citizen by birth) on March 13, 2020 and we've been living together in the U.S since then. I received my 2-years Green Card on June 02, 2021. I know that one of the criteria to apply for N-400 is to be married for at least 3 years. Last week we completed 3 years of marriage and I was wondering if I'm eligible to apply for citizenship or do I have to wait June 02, 2024 to apply for it?

    Use the resident since date 3 years from that,  in addition to still being married to that same spouse. You can apply 90 days prior to you reaching 3 years.As what was pointed out use the USCIS early filing calculator to be sure. Have you already submitted your I-751 ROC? If not you will have to submit that first.

    They (USCIS) are slowly starting to send them out it should not be to much longer for you all to receive them! Several folks including me have gotten them in the last couple of days!

     Very hard for a man to wrest children from their mother especially in Texas. The woman would have to be a total incompetent to lose her kids to a man!

    In fact the trend is starting to show that most people (here on VJ) do file their N-400 while their I-751 is pending. USCIS for some reason goes bananas when they see you have both a I-751 and a N-400 pending. They are adjudicating N-400s by the droves it seems. If you have any inclination to apply for your N-400 I would recommend you do it especially if you have a I-751 pending too! I've seen several cases here on VJ, where the I-751 got boosted out of the mud due to having a pending N-400. @Crazy Cat can vouch for that. While it's just speculation that your I-751 will be sped up if you submit a N-400, it does not hurt anything at all and can only help your cases. That's a rare gem when dealing with USCIS.
