We has waited 40 months for the I-751, so my wife filed under the 5 year rule.  4 months later, both our I-751 and wife's N-400 were approved in a combo interview at the Dallas (Irving) office.  I received an email 2 days before her N-400 interview telling me it was a combo.  A month later, wife took the citizenship oath.

We had a combo interview at that same office, only it was a combo interview without me the USC. Suited me just fine no complaints.

I think Dallas is an example where the "N-400 hack" works....at least in some cases.

I concur the Dallas office has been on the ball insofar as the I-751s and N-400s (and knocking the I-751 loose). Not sure about other offices, but it does seem like especially the January 2023 N-400s and the January 2022 I-751s that it in fact did get the ball rolling. There are always exceptions though!

It worked for me in San Diego. I applied for i751 in 01/2022, then heard nothing after biometrics.

I applied for N400 on March 1, then had my combo interview/naturalization on the same day May 10.

As it did for me too!

Hi, I’m about to apply for AOS for my spouse that came in on a K1 visa. Actually I applied 2 weeks ago but received a rejection “I-485 priority date could not be established”. I am guessing I made a mistake in part 2) 1.a I checked immediate relative but she came in on a K1, I’m guessing I should of entered the person admitted on a k1 box, but how do I make sure the box labeled “priority date” is correct? What is the priority date I should enter there so I can resubmit my I-485 asap.

I don't think that box applies to you! And yes you should have checked the K1 box!

I think there are plenty of us out there who do not have joint accounts. Contrary to the poster above, I did not even bother with a cover letter, let alone any explanation.

We hope that will be sufficient for you and your IO will be happy with that. Not required to have joint accounts, but if not wouldn't explanations of how you do your finances be an appropriate thing to do, since that is what USCIS wants to know!!!!

Even before sending the 751 to Phoenix I wondered if that might be the case. But is this an educated guess on your part or do you know this for certain.

If your packet is in order yes they do send out the extension followed by your bio-metrics or bio reuse! But as what was pointed out to you it does not mean your packet is going to be approved or RFE proof!

In my opinion completely not necessary. Our I-751 submission was this month (May 2023) and was less than 100 pages. The 48-month extension and waived biometrics letters were received less than two weeks later.

You can be thankful then, myself personally I would not risk and I did not risk sending in just a 100 page I-751. It's all a matter of personal choice and what you feel comfortable sending in, but to say not necessary I would not say that and yes I understand you gave YOUR opinion! You never know what kind of IO you will get a 100 page I-751 maybe the difference between an interview or a waived interview!

getting ahead of ourselves there 😊

I am preparing the documents now, but I was seeing all the 500+ page evidence examples across these forums. Makes me wonder if that is necessary. Worst case scenario you get an RFE?

It's really a personal choice how much information you want to send in. People want to AVOID a RFE. People have submitted small amounts of evidences  and been approved just fine; on the other hand, people have submitted 500+ pages of evidences and have also been approved just fine (we were one of those that sent in the kitchen sink). It just depends on what you want to send in and your personal choices. You'll want to give yourself every chance at success the first time without a RFE!

  8. Hello June 2023 AOS filers another month another round of AOS submissions,  Please be aware that this checklist is NOT all inclusive and you must consult the USCIS website to crosscheck this checklist against/with. The AOS process has been confusing since the pandemic hit, not to mention the added politics. So please I want to stress that you only use this check sheet as a starting point and guide if you will. The USCIS site will be the final guide. Please ensure that you check your forms for the correct versions and editions because if you use the wrong forms USCIS will reject your application and send it back to you. This is easily checked on the USCIS website prior to downloading your forms. You should also ONLY download your forms from the USCIS website.  The current and correct fees can also be ascertained from the USCIS website .

Just a side note before we get started  USCIS may decouple Forms I-765 and Form I-131 if filed jointly with Form I-485. Here is the quoted text taken directly from the USCIS website. "To improve efficiency and reduce Form I-765 processing times for Form I-485 applicants, USCIS may decouple Forms I-765 from Forms I-131 filed at the same time. Effective Feb. 1, 2022, when possible, we will adjudicate an applicant's Form I-765 first. If we approve it, we will issue an Employment Authorization Document without any notation about advanced parole. We will adjudicate the Form I-131 separately and if we approve it, we will issue an advance parole document". I know this is old news, but I thought it would be good to include it here for your knowledge.

What this means is some people elect to include three (3) copies of their marriage license / certificates one attached to each form (I-485, I-765 and I-131 respectively). I do not know of anyone receiving an RFE for a marriage license/certificate missing on the I-765 or the I-131 since USCIS has started doing this new way of adjudicating the AOS (the marriage license / certificate with form I-485 is required though). This is an age old concern that has been in play before this new way USCIS started adjudicating these forms. Some filers including me when I filed the AOS back in 2019 sent in three (3) copies of their marriage licenses / certificates. I did it then because of peace of mind and there were some RFEs given out for missing licenses / certificates (back then).  USCIS also used to issue Combo Cards, Employment Authorization Document and Advance Parole (EAD and AP combined in the same card). I've seen now where they have issued an EAD without the AP.  Whether you include three (3) copies of your marriage license / certificate is going to be your individual call when you file your AOS.  Having said that let's get into the checklist:

    AOS Checklist

    • Cover Letter listing Table of Contents
    • Check Payable to U.S. Department of Homeland Security - $1,225.00 (this includes the Bio-metrics feealso be aware that fees are supposed to increase in the near future so please double check before you send your packet off!

Form I-485 (completed and signed by non-US Citizen/beneficiary)

    • Form G-1145
    • Copy of beneficiary's Passport with biographical page
    • Copy of beneficiary's K1 Visa from Passport and entry stamp
    • Copy of NOA2 Approval letter (from K1 process)
    • I-94
    • Copy of beneficiary's Birth Certificate
    • translation of birth certificate (if needed)
    • Certified copy of Marriage License or Certificate
    • Passport Photos (2) name written on the back
    • Copy of DS-3025

Form I-864 (completed and signed by USC) (goes with form I-485)

    • Proof of USC's citizenship (copy of birth certificate, copy of passport bio page, or other)
    •  Current tax year 2022 and (optional 2021 , 2020) Tax Return (with W-2) or Transcripts (transcripts are better if you can get them)
    • Employment Verification letter (updated one - not the one used during K1 process)
    • Pay stubs (last 3 months)

Form I-765 (completed and signed by non-US Citizen/beneficiary)

    • Copy of beneficiary's Passport with biographical page
    • Copy of beneficiary's K1 Visa from Passport and entry stamp
    • I-94
    • Passport Photos (2) name written on the back
    • Copy of NOA2 (from K1 process)
    • Be sure to use the correct filing code of (c)(9) if this code applies to you. The I-765 instructions explains all the codes in detail. If you are filing under a different code (other than (c)(9) the fee for your AOS will not be correct and USCIS will reject your entire packet.

Form I-131 (completed and signed by non-US Citizen/beneficiary)

    • Copy of beneficiary's Passport with biographical page
    • Copy of beneficiary's K1 Visa from Passport and entry stamp
    • I-94
    • Passport Photos (2) name written on the back
    • Copy of NOA2 (from K1 process

Be sure to double check for the current fees as fees do sometimes increase and they can change on a dime so please check. Additionally, check the forms as listed above i.e., current version and or edition date, there have been many changes to various forms. Consider sending tax transcripts instead of the 1040, and W2's. Also consider preparing a cover letter for each form in addition to the main cover letter.

Make sure you send long form birth certificates and not the short form.  Hope this helps in your preparation of your AOS. When in doubt ask questions.

Please consider filing the I-131 and the I-765 even if you don't think you'll need them right now. You never know what changes your life will have on down the road, so I recommend you file these two forms from the start. There is no extra charge to file them with your AOS and it's better to submit them all at once.  There has been much confusion coming out of USCIS, partly due to Covid-19 and partly self-inflicted. This confusion filters on down to the people filing for AOS. The above listing is subject to change at a moment’s notice so please check, recheck and check again BEFORE you send off your packet for any last-minute changes.

Congratulations on a successful submission of your AOS packet!

Good luck to everyone still on the path!

Congratulations! January  N400 filers still continue to rock. It's been a banner month for most! I suspect most of us if not all will be finished soon!

Anyone know what to do when all the clerk offices and USPS and libraries are booked months in advanced??

in houston tx and cannot find an appointment

Keeping checking everyday and go out a little further than where you live. We did that and after a couple of days one opened up not close to where we live but doable. You'll have to grab whatever time and date is open though, but keep trying.

    1. Print out the application DS-11
    2. get the necessary passport photos done (Wallgreens,  UPS store, etc
    3. Mail the application and certificate of naturalization in with fee and any other needed document according to the following site

    https://travel.state.gov/content/travel/en/passports/how-apply/forms.html

If you are requesting a passport for the first time it has to be in person at an approved acceptance site i.e, USPS

  12. When my wife took her oath just last month guests where not allowed in the actual ceremony room, but they had guest rooms where you could hear the ceremony but not see due to a inoperable video projector. Most of us guests mingled in the courtyard, they let us out into the courtyard a few minutes before the new citizens came out. We took pictures and they had booths to register to vote if they wanted to at that time. I think it just depends on the location and the office.

Yours is definitely an outlier and I presume your documents are now lost:

    * the state department lost them

    * usps lost them (they are sent first class mail)

    * usps delivered to a wrong address

You would think Mike with all the fees they charge, they could at least mail items with a tracking number or some sort of receipt. I mean that still does not guarantee your documents will not be lost, but at least it gives you a tool to search and possibly find out who screwed up!

Just updating following my husband's N-400 interview (Montgomery, AL Field Office).

The appointment was at 9:30AM, and we went in at 9:15AM. I was not allowed to go inside. He was called back at 9:35AM and was finished at 9:55AM.

The civics questions that he was asked:

    • Who is the current president?
    • What is the political party of the president now?
    • Why does the flag have 50 stars?
    • In what month do we vote for president?
    • Name one war fought by the US in the 1900s.
    • What does the constitution do?

He was not asked anything at all about the pending I-751, and other than confirming that we are still married, there were no questions pertaining to our relationship. She did not look at or ask for any documents, except the green card. After going through all the usual questions in the N-400, he was approved and immediately scheduled for the oath at 11:30AM today. I wasn't allowed to go inside for that either, but was able to watch through large windows into the room. The oath was finished in 15 minutes, he got his naturalization certificate, and left the office a U.S. Citizen!!!

Case status for I-751 now says "Interview Was Completed And My Case Must Be Reviewed" (which I am just ignoring, lol) and N-400 case status says "Certificate Of Naturalization Was Issued"

Very very happy to be done with this huge milestone and finished with USCIS!

Another satisfied January 2023 N400 Filer! Congratulations!

  15. Just an update wife waited the 10 days after Naturalization and went to SSA yesterday. The process was simple and smooth, walk-in but we got there an hour early to wait in the long lines (she got her first taste of being American Lol) we were one of the first ones in the fast enlarging line. Once the office opened she went right inside they asked her a few questions about her birth date and location, her father's name,  her mother's maiden name and my wife's SSN, then they asked for her driver's license and finally naturalization certificate. Did a few keys strokes returned the certificate then said have a new day! And yes it was the original certificate! Passport office next week will be the last step besides receiving the passport.
