    No one is shooting down your idea, people are merely telling you the reality of your plans.
     
    I posted a similar question last month I think. I understand It’s disheartening to hear “it’s impossible” and “accusations” from people who reply, especially when you are genuinely trying to give someone a better life. But the VJ responses I got, same as what you’ve received here, offered the reality of our adoption plans. Ignore the “accusations” don’t take it personally, they’re just explaining the process and how the US will look at our case.

    Playing devil's advocate here.. what if the abuse claims are made up for a (future) immigration benefit, we see it occasionally on the forum. Not accusing the OP of such an intention, but we see VJ posts along vawa lines. Absent dead parents, adopting a niece/nephew to get them to the US is a long shot.

    You can try, and can probably legally adopt her. However, you are unlikely to be able to use it as an immigration benefit. Absent biological parents are not the same as no biological parents. There are too many cases of people who have adopted nieces and nephews to try to being them to the US. I can't think of a single one with parents who are alive that have had it happen. You MIGHT have a chance, but I think the father being alive (listed on the bc or not, he's still her father) doesn't help. I wish you luck, but I think your chances are zero. At the very minimum, you would have to move to the child's cluntry for two years (as custodial parent) to even qualify to adopt. If bringing a niece or nephew over were feasible, I at least would have done it long ago!

    Nearly everybody from PH knows a family member from PH who would love the opportunity to live in the US (or more often, a parent or other caretaker who would love it for them). Culturally, it's acceptable and even common to have family members live abroad now for a (perceived) better life later.
     
    Reality does not always live up to that expectation, but that's a common perception.

    It is semi cultural, well not just PI, I have seen people ask a similar question in a UK forum where in that case Parents had passed.

    To answer your question about LPR vs Citizen. . . I think you would want to be a citizen especially if you have to move back to the Philippines..

    I know right?! It’s so confusing that we have no idea what’s happening. There isn’t a pattern so we can figure it out. I’ll breathe better once my GC is in my hands lol!

    You know what, I understand that you want to bring A LOT of evidence. I bought a bunch too--the required and few more extras. It definitely helped my confidence during the interview. Having said that, the number of chat logs you want to bring is excessive. I didn't even bring our chat logs in the interview--they already should've gotten it in initial K1 package.
     
    You'd be very surprised that your interview would go into a different direction/topic that you thought about it your head. Like, the IO ended up asking so many questions about my then-fiance's occupation. At the end, I asked her if she needed my husband's income info. She answered I didn't need to because "you seem to know your fiance very well." 
     
    I also overheard an IO tell an applicant, "I will not approve you nor reject you right now because you don't know how much your fiance is making. We'll wait for his income documents in the mail." -- See how bringing income docs would be more important than chat logs? One of the responses said it well, quality over quantity.

    Same receive date as you, except mine is in California. Haven’t received my Notice yet. I’ve also sent an email, and they said they’ll send me a copy of the Notice. That was 8 days ago, still nada.

    Although, I see you live in California. It's relatively quick to receive your renewed passport. Better to just renew it. No problems, no worries.

    This is literally unprecedented. A 7-country ban through an EO placed by a president in office for not even a week that initially impacted permanent residents?
    As for other countries having bans, many countries have laws regarding a lot of different things that would be unconstitutional and unacceptable here in the United States. That's not a good threshold for dismissing the legitimate reactions of others as overreacting.

    Just to add documentation for those weary souls out there,,,
    We received the visa at 2GO, but the ustraveldocs still shows that it is at the embassy. 2GO also still shows in transit. All of you future information seekers out there that can't wait to be with their future loved one can thank me by upvoting my post.

    Approved here as well! I'm so happy for all of us! It was surprisingly quick. I also got out by 11 am.
