    If the 2nd anniversary is as close as 50 days from the issue date of the visa, I would also recommend waiting for the anniversary date to enter.  One thing I would add if you take this route, make sure your wife pays close attention to CBP when she does enter, the visa will most likely be classified CR1, but she may need to offer to the CBP officer that you are now both past your 2nd anniversary.

    Your income, both of you, is zero (for immigration purposes).  
    A job offer or plans to work unfortunately won’t count
    You choices:
     
    Precede your wife and start working
    Qualify on assets - the requirement is 3X the 125% poverty level listed for your household size
    Procure a joint sponsor
     
    Assets:  They want liquid assets.  Highly liquid, and for us they were pleased that they were parked in the US.  Way it is. “Moving assets” is one way to establish “intent to reside in the US”.  You’re a little early filling this out I think.

    The best evidence you can provide is that of time actually spent together....along with legal documents normally generated during a marriage.  Financial and property mingling is also good evidence.

    That ain’t COVID.  
     
    Actions have consequences, and getting married won’t escape these.  Proving “extreme hardship” for a waiver isn’t easy and it isn’t quick.  Sorry bro.  Tough break.
     
    There IS a waiver process but it’ll take awhile.

    "Technicality"?  Visas all have rules.  It's up to the visa holder to know and abide by those rules.

    So he worked for the company B without first applying for H1B transfer by that company? Remember, company A doesn't need to withdraw the sponsorship so that's not a problem. Your friend should have started working for company B only after initiating H1B transfer. Not doing so means H1B violation from the moment he stopped working for the former company. It's your friend's fault. He can go for it again but denial will be very likely.

    I agree with above comments. This scenario is akin to a person submitting an application to sponsor Spouse A, but divorcing Spouse A, and bringing Spouse B  to US using Spouse's A application. It just doesn't work.
     
    There is no technicality that can be remedied, it's misrepresentation and the visa laws don't substitute sponsors/applicants like that.

    So he worked for company B without authorization. It has nothing to do with what company A did or didn’t do. It has everything to do with company B hiring him without authorization and him working for them without authorization. Visa violations are not looked on kindly. He can try get another company to sponsor him and see if he can get a new work visa approved by a consulate but I think that would be tough with this history.

    Red light didnt ruin your life.  Choices did.
     
    Catch your snap.  You need to sit down with an immigration attorney, a good one, and listen to him or her read from the book.  You got a long road coming up and you got to pony up for both of you.  Big chance that road is a dead end.
     
    Marrying before you’re caught puts you on a path to a waiver.  Marrying just after?  Man that looks bad.  That looks like marrying for immigration benefits.  This is a deeper hole than most of us can help you out of.  I hope y’all work out.
