    The problem is the airlines letting her fly.  If she is not admitted into the US, they face the cost of flying the person back and facing fines.  The airlines are weary of flying LPRs who have been outside the US for more than a year.  
     
    CBP does not care.  They will admit anyone with a valid green card.  It would be rare for them to refer anyone to immigration court for abandonment of LPR status.
     
    If you can get on a plane to the US or cross the US border, you'll be fine.

    My brother in law and his wife entered the US earlier this year on B2 visas. Within a week upon entry, my bro in law had a Texas drivers license, and it was only valid for the dates on his visa. He planned to leave originally. They had their baby in June, but we no longer speak to them. We hear this information through the family back home.
     
    Fast forward now, he has decided to overstay the visa, and have petitioned (w/ a lawyer) to remain here. They use coronavirus and the newborn as the reason to not go back home, and remain here.
     
    I read on the USCIS website that a US citizen can sponsor their parents only if they are over 21 years old, which obviously this newborn baby is not.

    Is it still possible they appeal and get a green card or citizenship or even granted to stay in the USA? We are hoping they just go home but it seems they have other plans.
     
    What is their options? Can they be deported? Obviously the newborn baby cannot be deported.
     
    I think they have to wait for a judgement before being technically status of overstay now? Am I able to do anything to stop their application,  or contact USCIS about it?

    Well, they sent it back because I assume you didn’t go to the interview right? So as a result, it expired and they sent it back to USCIS where it ‘dies’. They might send you a notice in 6 months and they might not. The reason will be that it expired and that’s it. You should focus on your spousal visa. Good luck.

    I want to share my experience.... I hope it'll help someone. 
    I applied on February 6th of this year ( I got bored one Saturday morning then I decided to apply for citizenship lol). 
    It went very very very very quick from the moment I submitted my application ( I applied online). 
    5 days later received a receipt letter etc... And a week after submitting the application I received my interview letter ( I was like woowww that was fast. 
    Today was my interview, I applied under the 5 years rule. Since I was divorced I was expecting question about all that, but NO! 
    IO only asked me for my marital status I responded divorced. We went through the 6 questions for the test. Did my writing test and ready.... Asked yes and no questions and approved me 😳... The whole thing took 15 minutes tops.
    Then he directed me to another room where they asked me to take the oath and they gave me my CERTIFICATION ( I was like 😳😳😳😳😳😳😳😳 lol)
    The whole thing took less than 30 minutes. 
    The IO ONLY asked to see my green card.
     
    I honestly thought the entire process would take at least 6 months to a year. But seems like I was wrong.
    I hope this will help someone in the Raleigh area.

    Hi,
     
    DHS has not approved an immigrant visa for your stepdaughter.  USCIS approved the I-130 that was submitted in October 2016.  A big difference from having an approved immigration visa.  

    You need to look at the monthly Visa Bulletin.   Your stepdaughter's case is in the F1 visa category.  The current Priority Date for the F1 category in the October 2020 VB is September 15, 2014.  Your stepdaughter will likely be eligible to apply for an immigration visa in about 12-18 months with the NVC.  In about two years from now, she will likely have her immigrant visa interview at the US Embassy in Bangkok.  By then, her ban will be over and it will be a nonissue for the US Embassy to issue her a visa.

    Well if the guard told him he would let him in, sure. Please update us, I am assuming the CO in charge will realize it was an error and go ahead with the interview.

    I have seen several people get the same notice in error. Call USCIS tomorrow and verify it. The people who received those recently called USCIS and were told it’s an error, the N-400 is not approved until the interview has been done.

    After entering US on a K1 he can't travel outside until he gets the green card or advanced parole. 
     
    Going to another country BEFORE entering US is ok, you can meet up there, have the ceremony and go to the US and get the marriage certificate.

    What if I tell you USCIS change of address is very unreliable joke? I would proceed with Tennessee appointment. An office change at this time will be a super long wait. You can explain it with proof of address change with your interviewer to see what the officer decides.

    The endorsed CR1 visa in your passport is your Green Card until the plastic one arrives.......with full benefits of the plastic one.

    O.K. I would still call directly to check, anyone moderately savvy with a computer can spoof a phone number (call you and make it look like they are calling from a different phone number).  Make sure you go to the same office where you got your medical test only.  Good luck!
     
    Ah, OK man, it doesn't sound too bad then.  USD7!  It could be that they didn't realise you are missing a vaccine or a test or something like that.  Still, good luck!!
