Laststop reacted to TNJ17 in AOS Interview Questions! (Marriage Based)
This is not standard at all. They definitely suspected fraud. Most interviews are just a couple of questions for formality. I don’t mean to offend by what I’m about to say but please don’t say this is normal on a forum like this. You’re scaring people saying this is normal. This is not normal procedure. For whatever reason, and that is no one’s business, they suspected you weren’t a real couple. This is the procedure when they think the relationship isn’t genuine. A standard aos interview is nothing but a couple of questions and basically just looking over paperwork with the couple together.

It sounds like the interview went pretty well, so that's good. You're closer now than ever to being together in the US.

It sounds like a DS-5535 (or similar) is going to be sent. Unfortunately, there are no known rules for precisely who gets this for background checks...there's probably a random component of it, but also country involved, employment history, travel history, etc.
I wouldn't push it to the point that they are playing games or didn't want to be proven wrong...this doesn't sound like a personal offense but just part of the process.

In the end, you'll get there. Keep your hopes up please.

Technically, if you don't take any action, she can only use it to enter the US. However, the K1 has very specific requirements tied to the US petitioner (you) and it will be very difficult for her to be able to become a legal permanent resident without you (unless abuse is claimed in which I speak about below).

You should care because the petition and visa is tied to you. If, for example, you happen to find a person who is a better fit for you and you need to petition for them also, this current K1 will be on record which will make things difficult.

Also, if your ex uses the visa to enter the US and falsely claim abuse (which is a way for her to get a green card without you), then you will have that to deal with.

Your best course of action is to contact the embassy and let them know that the relationship has ended and to cancel the visa.

    No they are not.   https://travel.state.gov/content/travel/en/legal/travel-legal-considerations/us-citizenship/Renunciation-US-Nationality-Abroad.html

”Citizenship is a status that is personal to the U.S. citizen. Therefore parents may not renounce the citizenship of their minor children. “

This woman is an American and CBP should have been hassling her to use a USA passport to enter the USA.

This is woman needs to get a USA passport.  If she is in the USA now, then the main hurdle will be determining her social security number.  But with that, her birth certificate, and a filled out passport application, she can go to the post office and get this started.  She will get a passport in a couple weeks.

We filed for the n400 while the I 751 was processing. My husband was told by the USCIS officer that it would be better for us to have waited. However, we applied in March 2018 for the n400 and had an interview by July 2018. My husband became a citizen on September 26, 2018.  I would say apply for the n400, but do it online if you can.

While your i751 and n400 are pending, if you need to travel you will be doing so on an expired green card. That's why the USCIS issues an 18 month extension letter. So you will need to travel with both the expired green card and the extension letter. If your i751 and n400 are pending beyond the 18 month green card extension then you will need to go into a USCIS office and receive an i551 stamp in your passport. That's what the poster above meant.

If you are traveling abroad extensively, then your priority is probably to get your 10 year green card to avoid the hassles above in traveling with the extension letter or i551 stamp. In this case, you wouldn't want to risk further delay in i751 processing.

If you don't travel abroad extensively, then your priority is probably to receive citizenship as soon as possible so that you can finally put an end to all of this.

Note, even though the local offices quote a range of dates for N400 processing times, there are many VJ stories that indicate that N400 processing times at local offices are a little quicker with both an i751 and n400 pending. This was the case for my wife. Albuquerque processing times for N400's was 9 to 15 months when she filed, but in reality it only took 5 months with both i751 and n400 pending. Note: some VJ'ers have conjectured that having both applications pending at a local office is sort of a forcing action for them to process both applications sooner than later. Your mileage may vary. Good luck!

Got you now, that timeline of events helps clear up some stuff then...

While you can marry, think a lot here will tell you to wait. Let him get state side and settle then pursue this all. Take the time. I assume, as he wa stationed there, he will be dishonorably discharged from the service. That can have a huge impact on future employment opportunities plus having a conviction for a sex assault/crime can only hinder his opportunities more.

Don't just rush into it all because of the distance or anything.

You need to make sure exactly what kind of sexual assault crime it was because this is one of the worst type of crimes in sense of people trying to petition for foreign fiances/spouses.

Honestly you can do the proxy marriage but why rush it? Mean, if you two are dating and he committed a sexual assault crime on someone else.... kind of see where I'm going with this whole thing?

My husband flew from the UK, so the situation is a bit different. If he drives across the border, I can't see why they wouldn't let him through with his belongings, provided he has the visa and follows the laws.

You should hire a US attorney to cover your side of the divorce.  You wont be visiting anytime soon unfortunately.

I'm sorry you had to go through all of this.  It wasn't fair to you on top of having a miscarriage to have your marriage end as well.  Best wishes to you in the future.  I hope one day you find a more understanding and loving spouse.

(thinking she may not have been working now)

she and the USC children still have to be included in number of people that will be living in the house

Don't waste money on a lawyer. You've gotten this far on your own. Every time I read about someone having a lawyer, the lawyer just messes things up and they don't make the process go any faster either. Plenty of people do it on their own. Save your money.

You definitely have good income. You can try to bring ONE of your parents to the US first and leave the other parent behind to take care of him. After your parent has the green card, they can sponsor your brother under F2B category (waiting time around 7 years ). You can always bring the other parent over later. Your parents can return to their home country later if they do not like the US. You can get an immigration lawyer  to represent your brother. The process takes time but it will worth it for your brother with DS. Good luck.

Well, I would never want to interfere in my wife career, she is an independent woman and that is one of the things that attracts me a lot on her. I don't want a house wife, and she despite that because her mom worked her whole life too. And we live 2 hour drive from each other, not a plane ticket

AP or a green card is needed to re-enter the US. The K-1 is a single use visa.

As an immigrant I had no credit score coming here. I had no help whatsoever. I had to take out a car loan at a high interest rate to even get my credit score started at 600. Then I was finally able to get a secured credit card and from them on my score went up.

Now my husband got his SSN and I added him as an authorized user on my credit card. Within a month he had a file on creditkarma with a score of 750.

It can be easy if you have help from someone who trusts you but if you start out by yourself it's difficult to even get a credit file and score.

Perfectly acceptable reason to be absent. But, they can do as they wish.

Tell them about the appointment, show them the letter, and let them write you up if they need to. But I would really be looking for somewhere else to work. I've never worked for an employer that was that much of a jerk for perfectly acceptable/legitimate absences.

Sorry to hear about the denial.

I think the AP is a formality of the case being finalized. But to answer your question, yes there is still hope for you to be together. It just may not be from a K1 visa. But you still have other options. You can marry and file a spousal visa. If you look at long time member @adil-rafa's timeline you will see that she and her husband were also initially denied a K1 from Morocco and had a very challenging immigration journey. But they were able to overcome and are happily together now.

This may only be a setback for now so you should definitely keep strong.

    Best of luck to you.
