Have you followed up with the embassy via email or phone?

I-129F petitions are only sent back to USCIS when the visa is refused and the petition goes back to USCIS to expire.

Follow up and get your senator involved!

That's evidence of infidelity which you said you knew of before you brought her here.
As stated previously, infidelity does not equal fraud.

You can refile but the process will start all over again- and starting over does not address the concerns that the CO had.
This is the only opportunity to address their concerns and attempt to have your case reaffirmed.

The second one is written on a legal pad.

... Like it's still inside of the legal pad. Did he send her a legal pad full of letters?

That and ... why would you have letters she wrote to him.. shouldn't those be with him...

    Yes you can refile.
Besides the wait time, the biggest difference between refiling and having the existing petition reaffirmed is that with a reaffirmed petition they cannot refuse the visa for the same reason with the same evidence. With a new petition, they can consider the same evidence/conditions that resulted int he first refusal.

In addition to all the great stuff above you  could also add (for the comments about the age difference and your answers to the counselor questions) a statement written and signed by you.   Write why it is you fell in love with her, what makes her stand out from someone in your own culture.  Write your account of what went on in the interview perhaps they misunderstood some of your answers.   Add proof of some chat that shows how you communicate to prove that you can and do daily throw in a few that discuss future plans and genuine care for each other.  Proof of additional trips made since the interview.

The statement about going over information before the interview...I would add along with your account of that chat that this is completely normal.  Most couples will rehearse the interview to settle nerves and go over complicated questions that some of these high fraud countries may ask.  Include why you felt it was necessary to rehearse those items.

@Sparrow I have seen this mistake by CO  happen. CO's do make horrid mistakes that mess up peoples lives.

I believe they got your wifes info mixed and thought you omitted information. What you need to do in your NOIR (I have help write many) you need to go line by line at each denial point and address it with evidence.

For the "been married twice" have for that evidence your wife's G325a and your's to show her marriages attach again her two divorce decree's. Show your evidence of single-hood(bachelorhood) whatever to show it's their error. Explain you have never before been petitioned or filed for any other visa previously.

See,s your wife's petition package was very lacking. I pray all this time there were multiple visits so you need to show in Visa Stamps, boarding passes, show the chat's, IM's, posts from social media since the beginning of the relationship.

Pictures with family (especially your parents) and friends, wedding, events, different venues.

Affidavits from family and friends like 3 or 4 to speak to the bonafides of your relationship.

Does she have kids? what about your communications with them? show that.

If you have joint accounts here or there show it. She should have done taxes married filing separate show that.

Now is not the time to hold back. You get one chance with a NOIR.

Hypothetically speaking he could be telling the truth.   Government agencies do make mistakes.   In my NOIR it mentioned me being married twice before which was untrue.  I just responded to the NOIR with the facts,  I did not use an attorney and it was reaffirmed.   We don't know this gentleman from Adam he is asking for advice is it so hard to just give it without making assumptions that he is hiding something?

OP I have to admit this is tough one.  You really need to seek advice from an attorney even if its after your wife prepares the rebuttal just to have them look it over.  Also seek advice with a Pakistan attorney regarding how to prove you were never married.

Try to step back a little and understand that people are attempting to give you a more well-rounded view of what typically happens in cases like yours.  And generously letting you know "extra" information relevant to your situation to save you not only time but money as well.

The information you've been given in this thread is based on personal experiences, years of dealing with immigration in many forms and USCIS in general, anecdotes from other members as reported before in these forums, knowledge gleamed from some who went through the same consulate, and advice from those who have been denied a K1 in the past.

We all know (on one level or another) what we've had to go through to be with our loved ones....The immigration journey is one that can get complicated and confusing at best...heart-wrenching and near-impossible at its worst.

People have stuck with this thread for pages to give you as much information as possible, asked questions (which you thought irrelevant) to be able to give better advice, and offered info on other aspects you may not have thought about while you go through the K1 process (and potentially the CR-1 afterwards).

No one wants to see anyone's petition fail if a relationship is real and true.  No one wants to see YOU fail.  I guess what I'm asking is try to help us help you.  More knowledge is better than less.

They answered by telling you the common reasons why visas are denied.   99% of the time the consulate will not tell you why they denied you, as they just have to tell you they don't feel the relationship is bona-fide.  They don't tell you why they have those thoughts.  No one here can tell you what they don't even have for themselves.

That's why people suggest a CR1 because if it's denied, you do get the reasons why and you have an opportunity to appeal.

OP,  I strongly suggest listening to the advice here.   It sounds like you love him and sometimes that is very difficult to see things objectively.

Just a thought-  listen to what he says- that he doesn't want to have "relations" with you there because of a foreigner that came over and he feels used his cousin.   So he's essentially saying "I don't trust that you won't do this".

But yet he wants you to trust him, to spend THOUSANDS of dollars (between immigration and traveling) before all of this is said and done.

As someone suggested, suggest moving there and gauge his response.   Is his love unconditional or will you find that conditions depend on his US arrival?

My (now husband) is from Nigeria, a very high fraud country.   We spent 3 years on immigration, thousands of dollars, and two denials.  This is not an easy journey.

In addition to the difficulties, add extra if he's ever been in the embassy before and was denied, especially recently or multiple times.

You can look at the portal for where you'll be interviewing and read the consulate reviews.   That will help a bit!

Well I'm going to throw my hat in the ring.

All you need to submit DS-160 is the USCIS number better known as the WAC number which is the WAC #. You can use WAC or NVC case number or you can leave it blank. It doesn't matter for K-1's.

The DS - 160 is a document that stands alone. It does not require a "fee" to submit.  It does not affect anything. It does not need to be finished to do anything else but needs to be completed for the interview and it can be completed between now and the day before your interview. You can't use it to find any information about your case. You can't use if for anything other than for its original intent and that is for the CO to use during your interview to adjudicate your case. The only exception is that some Embassy's require you to complete it and send them the confirmation number and then they will allow you to schedule the interview. The one embassy I know off the top of my head is Japan requires it before scheduling. Check your P3 letter. I think I have given it to you @Smashy. If not let me know as I have a copy for MTL.

You don’t need a wet signature for the I-134 in London. Don’t submit the I-864 they probably won’t accept it as it’s the wrong form. Fill out the I-134, scan it to your computer with a signature, email your fiancé a copy and have your fiancé print it out and bring it to the interview. You should be fine. Worst case scenario they will ask your fiancé for a copy with a wet signature but I HIGHLY doubt that. @britishandusa submitted an I-134 without a wet signature and was absolutely fine ☺️

Standard "I am not a lawyer, this is not legal advice... if you need legal advice, please consult an attorney" disclaimer applies (again):
Proof of fraud is very very difficult and expensive except in cases like polygamy where the person is already married to someone else. A simple no-fault divorce decree for "irreconcilable differences" with a signed settlement agreement is usually the least risky and fastest/cheapest way to start healing and move on. I would be very suspect of a lawyer that would recommend annulment in this situation, it creates too many procedural traps that can drag on for years.

It's REALLY important to separate emotions from legal formality. Legal formality gets you through the process and on to the next part of your life. Emotions get you in trouble. What you don't want is for those 2 things to overlap because then it's your emotions creating legal formalities (aka legal problems).

DO reach out to a close family member, clergy, and/or a trusted close friend for emotional support.  DO rotate between them so you're not unloading too much on 1 person. DON'T try to keep everything inside.

I'm so sorry to hear this.   I have no information for annulments in California but I truly hope you can find peace and healing that you need.

As far as USCIS goes, I'm assuming you've filed for AOS.   You can inform them that you are withdrawing the application and do not wish to proceed with AOS.   He has no legal path here without you.
