D (3) visa is not very easy to obtain , it has to be anchored to a non immigrant visa The only waive available to banned CIMT
Minuses to some ....having lived in he past in the US, having a conviction or do not satisfy USCIS conditions will be obeyed
Pluses ....if the CO recommends you for such visa, they send the request to DC about 80% of the time when CO recommend its approved
One can ask the CO upon applying for a tourist visa about the D (3) the law says if you have aprepared letter to request this the CO should
accept & send to DC almost always denied in this manner
They look at reason for your ban, if rehabilitated (if this applies), family ties ,dates you want to be in the US and why
The visa is normally issued for a year, but it can be issued for longer if multiple entrances were requested, upon US arrival

2 yrs outside is definite abandonment, if a valid pressing reason caused you to want to stay out you could have applied with strong reason to uscis, you should return to US & continue residency now, the pandemic was worst in Italy according to news media, and you say light & banking was being kept up in the US, careful with your excuses have back up documents for uscis

Amazing how much hate and judgment get spewed on this forum over

as an immigrant (wants to close the door behind them) others trying

Frankly I think OP and family should have used the period waiting for 2nd baby's birth
to short sale their home, ship a few stuff and go home, it would have been easier to reapply possibly with waivers at a later date. and may have been able to been approved for the overstay....With that almost decade of ignoring the orders I guess they'll wait for the babies to be 21 to petition them (if such law still exisis

Immigration officers don't know the laws they know & is trained
how to scrutinize ppl coming and going at POE or borders,
so many times information they give out is not correct.
People should always clear text messages coming thru any
airport ,and working gets one banned from any country if
they do not hold a permit to work.
You can file a K1 petition for her , I212 will definitely be needed
the consular will say if she need the I601, who knows, but I would

AWA is hard to ovecome even with a great atty, If you have a minor child or is at an age that you can become pegnant USCIS will never approve you, only about 20 cases after much struggles & an experienced atty got approved.
examples L Boy (petitioner) 22 yra ld having CONSENSUAL sex aith a 16 yr old G/F but age of consent in his state is 17, parents reports it he's arested..........

You or your dad should sign nothing for him...Yes you can petition a new husband he's ;ying to you that you cannot....They may ask questions however
