Jawaree got a reaction from AKN2 in She wants to be back after divorce!!!! Now what?
You should think hard about that dude and tell her
she has to get counseling and anger management B4
you think about the marriage route....that kind of
    behavior don't change overnite.
manipulative, codependency, abusive & maybe mental is
the issues, she will be sweet & later have U arrested for
claims of abuse leading maybe to an assault charge and
possible deportation after setting you up...be careful

    Jawaree got a reaction from kokoro88 in 212 (d) (3) approved - 10 years
D (3) visa is not very easy to obtain , it has to be anchored to a non immigrant visa The only waive available to banned CIMT

Minuses to some ....having lived in he past in the US, having a conviction or do not satisfy USCIS conditions will be obeyed

Pluses ....if the CO recommends you for such visa, they send the request to DC about 80% of the time when CO recommend its approved
One can ask the CO upon applying for a tourist visa about the D (3) the law says if you have aprepared letter to request this the CO should
accept & send to DC almost always denied in this manner

They look at reason for your ban, if rehabilitated (if this applies), family ties ,dates you want to be in the US and why

The visa is normally issued for a year, but it can be issued for longer if multiple entrances were requested, upon US arrival
CBP questions & decide how much time they will allow you to stay (its imperative to leave on time or it will be revoked)
If for any reason you want an extension you must go into USCIS with documented proof of reason to stay. a warrant is
issued when this visa is jumped

One cannot adjust, live or work on this visa...The good thing with multiple entrances and doing the right thing the opportunity
to be with family & friends at times is there especially Holidays

Jawaree got a reaction from Mike E in Apply for citizenship after living abroad for over 1 year
2 yrs outside is definite abandonment, if a valid pressing reason caused you to want to stay out you could have applied with strong reason to uscis, you should return to US & continue residency now, the pandemic was worst in Italy according to news media, and you say light & banking was being kept up in the US, careful with your excuses have back up documents for  uscis

He can petition you for K1 if his parents will be co-sponsor
If his conviction is not Adam Walsh Act
Since you saw him in the last 2 yrs & this is what you want and its your life.
He has 90 days to be married after you arrive, so check with his institution
on marriage procedure way before your arrival. If he is in FEDS check it
out thoroughly federal inmates are like property of the state.

You can do a FOIA but that's a long wait
& realty he has no other negatives, either
U go marry him & petition him as a spouse
    or U file K1.
In the meantime an *Advance reentry permit*
can be filed in the jurisdiction he was refused
entry, its a lone 212 asking to re-enter from
the director of that area, most are approved, the
timeline different for many states, if approved
they send the approval & you take it to Consular
interview.regardless what route U decide to take.
it would be a jump start,.that U can start on now,
just get the form online. the CO will say if anything
else is needed *Advance permission to
    re-enter* goodluck

Amazing how much hate and judgment get spewed on this forum over
and over by the same ppl and they too either got in here somehow
as an immigrant (wants to close the door behind them) others trying
to get their ppl in thinking their ppl alone deserves the opportunity.
I honestly have to smile at some of these immigrants comments..Don't
get me wrong everyone should enter the proper way, but we all know it
does not happen always like that, there are those though that deserve
some sympathy ....what if it was the other way around?
The world changes if we read history we see that, we may not be around
but will leave offsprings not knowing where in the world things will change
    God bless U all

Frankly I think OP and family should have used the period waiting for 2nd baby's birth
to short sale their home, ship a few stuff and go home, it would have been easier to reapply possibly with waivers at a later date. and may have been able to been approved for the overstay....With that almost decade of ignoring the orders I guess they'll wait for the babies to be 21 to petition them (if such law still exisis
Very glad for you and family bro

get an atty to hire an handwriting expert and re-apply...the oral argument that she
got money cant be proven & she should have stepped forward long ago...If
this is true he is now on their radar, & I would not travel outside the country

Immigration officers don't know the laws they know & is trained
how to scrutinize ppl coming and going at POE or borders,
so many times information they give out is not correct.
People should always clear text messages coming thru any
airport ,and working gets one banned from any country if
they do not hold a permit to work.
You can file a K1 petition for her , I212 will definitely be needed
the consular will say if she need the I601, who knows, but I would
prepare one....call Lizz Cannon her consult via phone is free, she
will advise U on the best thing to do

Dude when U meet a female willing to work & pay for everything
and U stay home play house husband (unless U have small kids)
that's a VERY bad sign of control, manipulating & de-masculating.
Very soon she'll (most) talk down to U, act as if U R lazy, complain
how hard she works, and definitely have someone on the side that
she's looking up to...I say get an atty...don't be around her alone
and don't rub the new sweetie in her face to make her angry.

AWA is hard to ovecome even with a great atty, If you have a minor child or is at an age that you can become pegnant USCIS will never approve you, only about 20 cases after much struggles & an experienced atty got approved.

examples L Boy (petitioner) 22 yra ld having CONSENSUAL sex aith a 16 yr old G/F but age of consent in his state is 17, parents reports it he's arested..........
somethin like that may fly, if its a small kid forget it
What was he accused of ?.. you have to know the complete back story IF you do get to the stage of interview, lots of therapy & refs would be needed

Very uphill since the only way one gets to stay is K1 resulting in a marriage.
he will need an atty who knows what they are doing, on VERY rare ocassion one slips thru, I guess based on atty arguments

OP its time to sit with your husband and work out how you'll go about getting legal since adjustment is not possible here now
The good thing is your new husband is willing to petition you & your child, you will have to leave to adjust, when one stays longer
out of status it can mess things up for them, its hard to pick up and leave with possibily of returning than to be deported , Start
working with a good experienced attorney....Try Ziroko Lopez for these matter. Immigration is federal you dont have to be in the
state of TX where she is located google her Richardson TX
