Jawaree got a reaction from kokoro88 in 212 (d) (3) approved - 10 years
D (3) visa is not very easy to obtain , it has to be anchored to a non immigrant visa The only waive available to banned CIMT
Minuses to some ....having lived in he past in the US, having a conviction or do not satisfy USCIS conditions will be obeyed
Pluses ....if the CO recommends you for such visa, they send the request to DC about 80% of the time when CO recommend its approved
One can ask the CO upon applying for a tourist visa about the D (3) the law says if you have aprepared letter to request this the CO should
accept & send to DC almost always denied in this manner
They look at reason for your ban, if rehabilitated (if this applies), family ties ,dates you want to be in the US and why
The visa is normally issued for a year, but it can be issued for longer if multiple entrances were requested, upon US arrival
CBP questions & decide how much time they will allow you to stay (its imperative to leave on time or it will be revoked)
If for any reason you want an extension you must go into USCIS with documented proof of reason to stay. a warrant is
issued when this visa is jumped
One cannot adjust, live or work on this visa...The good thing with multiple entrances and doing the right thing the opportunity
to be with family & friends at times is there especially Holidays

Jawaree got a reaction from Mike E in Apply for citizenship after living abroad for over 1 year
2 yrs outside is definite abandonment, if a valid pressing reason caused you to want to stay out you could have applied with strong reason to uscis, you should return to US & continue residency now, the pandemic was worst in Italy according to news media, and you say light & banking was being kept up in the US, careful with your excuses have back up documents for uscis

Jawaree got a reaction from NikkiR123 in marriage to a US prisoner
He can petition you for K1 if his parents will be co-sponsor
If his conviction is not Adam Walsh Act
Since you saw him in the last 2 yrs & this is what you want and its your life.
He has 90 days to be married after you arrive, so check with his institution
on marriage procedure way before your arrival. If he is in FEDS check it
out thoroughly federal inmates are like property of the state.
Live & let Live!

Jawaree got a reaction from oralar in 212 (a) (7) (a) (i) (I) with no other issues
You can do a FOIA but that's a long wait
& realty he has no other negatives, either
U go marry him & petition him as a spouse
or U file K1.
In the meantime an *Advance reentry permit*
can be filed in the jurisdiction he was refused
entry, its a lone 212 asking to re-enter from
the director of that area, most are approved, the
timeline different for many states, if approved
they send the approval & you take it to Consular
interview.regardless what route U decide to take.
it would be a jump start,.that U can start on now,
just get the form online. the CO will say if anything
else is needed *Advance permission to
re-enter* goodluck

Jawaree got a reaction from mjoyceb in The other side of deportation: An American struggles to prepare for life without husband
Amazing how much hate and judgment get spewed on this forum over
and over by the same ppl and they too either got in here somehow
as an immigrant (wants to close the door behind them) others trying
to get their ppl in thinking their ppl alone deserves the opportunity.
I honestly have to smile at some of these immigrants comments..Don't
get me wrong everyone should enter the proper way, but we all know it
does not happen always like that, there are those though that deserve
some sympathy ....what if it was the other way around?
The world changes if we read history we see that, we may not be around
but will leave offsprings not knowing where in the world things will change
God bless U all

Jawaree got a reaction from Neo Anderson in The Horror of Deportation/Removal Story
True.
Frankly I think OP and family should have used the period waiting for 2nd baby's birth
to short sale their home, ship a few stuff and go home, it would have been easier to reapply possibly with waivers at a later date. and may have been able to been approved for the overstay....With that almost decade of ignoring the orders I guess they'll wait for the babies to be 21 to petition them (if such law still exisis
Very glad for you and family bro
