You're lucky siblings can even petition in the US. In most other western countries, only parents, children and spouses can be petitioned. The US is VERY generous when it comes to family immigration. I truly don't understand why so many people want to move to America, why so many people are frantically trying to find a way to get to America?! Filing outside the 90 days is not an issue, as long as you married within that time.

Obviously OP's husband was NOT trying to commit fraud. That's clear from the fact that he announced his intent to do AOS to the CBP officer.

my overstay was honest, as I completely ###### up the dates, for a FEW days. It was the first time, and it wasn't a malicious, intentional overstay. Could compromise on the commute. His job is 2 hours from your current residence. How about getting a place that is in the middle, 1 hour from either job. No need to pay for 2 residences, saves money, etc.
