Hello, I am currently in the states on a J1 visa and wondering if I can transfer that to a working visa to stay here longer? I have a job lined up and also a boyfriend here

Also don't think that just anyone can get a employment visa. Your employer needs to prove, for example, that there isn't any USC who can perform the job. You need to have some specific qualifications. Also from what I know, there is a limited number of work visas available. Check if there is any for this year left.

J1 is a work visa, well it certainly can be and is usually used for work.

If the Boyfriend is a USC then you have an obvious option.

OP having a boyfriend here doesn't carry any weight so good for you that you are in a relationship but nobody on an official front will care (harsh I know). If anything it will ####### up some ears as they might fear you want to stay by getting married in the US and adjusting status (very very frowned upon by some people on here).

Nobody knows what the future holds but I agree a with visa might be quite a stretch unless you have certified skills that can't be matched by a USC.

what would this job be? do you have a degree?? you need to be a qualified person to get an h1B visa and it could take a while to get...you can only apply a certain time of the year and the cap can be filled already.

you can always go back to school and get an f1? i assume you are younger, not sure if you want to marry yet, but in the USA there is no such thing as a boyfriend, common law, fiance ect visa (for work purposes. if you are young, you should think about school/college??

I see no issue with anyone who initiates the AOS process due to getting married in the US. There is a thread currently going on discussung the merits for banning all AOS situations. Take a look as it's a lively little debate

I mean the only person here that is getting even remotely close to "ballistic" is you.

OP can absolutely adjust if her and her boyfriend are ready and willing to make that commitment in their relationship.

The only "merit" I see for banning adjustment from work and visitor visas is the 'ole "I'm salty because someone else had an 'easier' time that me and now I feel entitled to take that away from them" line of reasoning.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes, you can. H1B visa comes to mind for most jobs. It depends on your industry how easy it is to get one. In academia and research, for example, there is no cap so your employer can apply at any time. They do not have to prove that no USC can do the job - that's a myth.

What they have to show is that no USC or LPR can be found to do the job during a certain time window. The process of establishing this can take several months. Next, the local prevailing wages have to be determined (another several weeks or months). Finally the non-immigrant worker petition is filed with USCIS. Premium processing takes 2-3 weeks.

So if you decide to take this avenue you should start the process (with your employer) about 8-9 months before your J1 expires.

12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)
12/04/2017 RFE received in mail
12/07/2017 repeated medical exam for I-485
12/08/2017 Attorney receives documents for responding to I-485 RFE
12/21/2017 Response to RFE received by USCIS 
02/09/2018 I-485 approval (text, email) :)
02/08/2018 I-485 approval notice issued (the "welcome letter") - I'm LPR now
