Father bringing unmarried daughter over 21 to US

Hello everyone,

My uncle applied for his unmarried daughter over 21 a couple of years ago. The application was approved, but now the wait is for an available visa. He recently became a US Citizen and decided to retire back to his homeland. Will this cause an issue when a visa becomes available for the daughter to come over to the US. Is the petition still viable? Any thoughts would be greatly appreciated!

The previous reply is correct. He can't justify bringing his daughter here to be with him if he isn't here himself.

Timeline

Just make sure that by the time of the beneficiary's embassy interview the petitioner should be back in the US. Once beneficiary gets the GC, petitioner is free to live wherever he wants.

He must continue to file taxes though.

He must continue to file taxes though.

He won't be filing taxes because he is retired and his income is below what needs to be reported. He receives no other income. If he did stay in his country, how would they even know? I'm just thinking out loud, so apologies for all the crazy questions

Then he must have a joint sponsor who will meet the income requirement on the Affidavit of Support.

NVC nor the embassy will "know". However, everybody must be truthful in answering questions.

He would need to show he was domiciled in the US before his I-864 would be accepted and the immigrant visa could be issued.

Well, if his income is too low to file and pay taxes, he won't fill the sponsor requirement as NVC looks at taxable income

another had a probem with this as income was well over the 125% but taxable as reported on taxable income line was not / retirement and ss were not taxable

Even my mom doesn't owe taxes but still files

Yes, it depends where you came from and what life you had there.

It's certainly no 'dream' for me. I will lose state-funded healthcare with zero deductible, 25 days annual leave plus 8 public holidays each year, TV with no commercials, being able to travel to 20+ European countries (visa-free) in a couple of hours, and many other things. But my husband cannot live here so I am having to leave it all behind,
