Being deported from the USA makes the OP permenantly ineligible to travel under the VWP.
Only option is to apply for a B2.

Be aware that if you do not provide an EAD or green card as your proof of lawful status to DPS here in Texas then any driver's license or ID card you obtain will have an expiry date the same as the one listed on your I-94.

You can still schedule an infopass appointment, you just need to call them now and request an appointment over the phone as they are removing the online scheduling option.

If you gain permanent residence based on marriage, and it has been more than 2 years since the wedding at the time of approval, the green card must be the 10 years one. Doesn't matter when you entered or when you filed.

Immigration-wise, prenups have no role in the process.
Beyond that, where the marriage occurs doesn't matter. What does matter is the content of the agreement. It is often difficult to enforce one unless it is carefully drafted. This is something to speak to family law attorneys about, as is the enforceability (or potential lack thereof) of any such agreement across countries.
Note that I said "attorneys". Separate, independent attorneys representing each party would be optimal to avoid one party claiming that the contract was drafted in favor of the other party (e.g. if it is being paid for by that party).

If you want it to be enforceable in the US then you would need to have it drawn up by a lawyer here according to your relevant state law. And then it would be executed and signed here, also.

There is a very recent case here on VJ where the poster failed to file before the expiration of the I-94. She was a passenger in a vehicle which was stopped by police. As a result, she spent 5 weeks in jail.......
There are no benefits in waiting to file...none at all.
