    Exactly.  Immigration is neither fun, fast, nor cheap.....

    The most important thing at the moment is that you are listed on his travel orders. If you aren’t on his orders immigration will not count your time overseas as maintaining residency

    It SPECIFICALLY says ".....where one party is not present during the marriage ceremony......"  "...unless the marriage has been consummated;..." Seems extremely clear to me.  The marriage MUST be consummated prior to starting the immigration process.

    Appreciate the info.  I've posted about it before, and I've gotten a lot of replies about saying USCIS doeant normally conduct interviews for it, but this info does help.  Thank you again.

    That is not my understanding.  USCIS has the option of waiving an interview if the applicant had a previous USCIS interview.  CR-1 visa holders do not interview with USCIS.

    "Generally, USCIS officers must interview a conditional permanent resident who is the principal petitioner on a Form I-751, unless the interview is waived. This guidance explains that officers may consider waiving an interview if they are satisfied that:
    They can make a decision based on the record because it contains sufficient evidence about the bona fides of the marriage and that the marriage was not entered into in order to evade U.S. immigration laws; For Form I-751 cases received on or after December 10, 2018, USCIS has previously interviewed the principal petitioner; There is no indication of fraud or misrepresentation in the Form I-751 or the supporting documentation; and There are no complex facts or issues that require an interview to resolve. When determining whether to waive an interview, these considerations apply regardless of whether the Form I-751 is filed as a joint petition or as a waiver of the joint filing requirement."

    Vancouver, WA here.  The PNW is definitely a place of uniqueness.  I wish my wife had the same feeling as you, she hates the weather here, haha.

    It's really hard to find a better weather than coastal Southern California. The close proximity to amazing national parks (where you can go see snow after going to the beach) is amazing - Yosemite, Sequoia National Park, King's Canyon, Death Valley. I will never get tired of looking at giant trees.

    You now can have a signed copy of the I-134 for the interview.  
     
    I would go ahead and stick with the original interview date.  Who knows how long it would be before another date can be scheduled, and plus this is the moment both you and your fiance have been waiting for! Best of luck!

    Whatever the plan is from Biden, I just hope he keeps his word on a lot of this, and of course have a positive outcome for all!

    I also downsized my name, from 5 to 2. Go to the court and get the name changed. When applying for ROC, apply with the new name and where it asks for previous names enter the old one. Send a copy of the court order in the package.

    Among everything that is going on with our country, or eve in the world, the #1 issue right now is covid, as we all know. I do hope for some positive change, especially with immigration.

    When you are required to submit a I751 application package within 90 days of the expiration of your conditional green card all i751 fliers must pay for both the i751 application fee and the biometric fee for the petitioner (the conditional green card holder). 
     
    Yes, after you file your i751 application successfully you will receive a notice of action from USCIS of receipt of your i751 application, that notice will contain your 18 month extension of your conditional green card. 
     
    The NOA with the extension letter along with an expired conditional green card is needed for out of USA travel and other proof of your continued legal residence status.
     
    The extension letter is good for 18 months after the conditional green card expires. 
     
    With a pending i751 application the petitioner's LPR status does not expire even after CGC and extension letters expires, only proof of LPR status expires not he LPR status itself. 
     
    You current conditional green card is good for travel up to the day it expires. Al long as you return to the USA before it expires you are go to go.
