question regarding who qualifies as a child on N400 application

Many years ago in Ukraine, my husband had a girlfriend who became pregnant. Paternity wasn't established and when the baby was about 6 months old the girlfriend left my husband and took the baby with her. shortly after that she ended up in jail and the baby was put in an orphanage and adopted. Since my husband wasn't the legal father, he had no idea what was happening. He'd tried to find his daughter but couldn't get any information since he wasn't the legal father. When he came to the US on a K1, he put that he had no children because he took the question to mean legal children and at the time had not had contact or any info regarding his daughter for many years. Well, this year, after hiring a private detective, he's found his daughter and the adoptive mom allows them to talk on the phone. Now we're filing the N400 and are wondering what to put when it asks about children. Obviously she's not his legal child but she is his bio child and if anything happened to her adoptive mom who's quite older and also lives in a city in Ukraine that is being bombed, he would definitely want to get custody of his daughter somehow, either through paternity being established or adoption. Or even when she's over 18 if possible it would be nice to have an opportunity to bring her to the states.

any suggestions on how to handle this on the N400? Should he still mark that he has no children but write a statement just in case later on it comes up and he doesn't want to look like he was being dishonest on his N400 application?

questions about N400 application supporting evidence

My husband came on a K1 and we've been married 9 years but were separated for 1 1/2 years in 2021-2022. We weren't legally separated and he never changed his mailing address or car registrations. We are finally doing the N400 and when it asks to list where he lived the last 5 years I'm not sure if I should only list our home since that's been his legal address or also add the home he rented a room at while we were separated. He is filing under the general eligibility.

Also we were in Mexico from April until August 2 of this year doing a family Christian program at YWAM. One of the requirements of eligibility is proving continuous residency in the same state for the 3 months prior to applying for naturalization. We kept the house we own and still live in, and have returned to working (although he has a new job than the one he had before we went to Mexico). I know legally he maintained his WA state residency but will it be a problem for USCIS? Should I make a statement explaining the purpose of going to Mexico? And show proof of continuing to pay our mortgage and proof of working upon arriving home? Or is that unnecessary?

What other supporting evidence for general eligibility should be sent in? Passport pages? IRS transcripts? Proof of tradeschool attendance? Should I be proving he's been in the US all this time or is that not necessary unless they ask for more evidence?

Also he didn't registered for selective service when he came to the US. He was 25. He's now 34 and according to the online application doesn't need to submit the letter from selective service or a written statement regarding why he didn't register. I'm still nervous though! We don't even remember why he didn't register other than we didn't realize he needed to since he wasn't a citizen. Anyone have experience with this?

Thank you!

130/485 Filing for Ukrainian with pending TPS re-registration

My wife was Naturalized a couple weeks ago, and her mother is here with us in the US right now. She entered on humanitarian parole, but then got TPS. Her current TPS document expired on 4/19/25, but she timely filed 90 days before for "re-registration", which of course is still pending, but on USCIS's webpage for Ukrainian TPS it still says Ukrainian TPS is designated through Oct. 19, 2026. Trump has not made any termination on this program, but adjudication of pending applications seems to be at a stand still.

Obviously with my wife being naturalized now, we want to file I-130/485 for her mom now. On the questions about her mothers "When does the beneficiary's authorized stay expire?", should we be putting 4/19/25. With a pending TPS re-registration, she wasn't required to leave and from what I understand is in "authorized stay", but without an approval being issued I don't see how we can put any date other than 4/19/25.

We want to get her 485 filed as soon as possible which should then protect her from being required to leave while that is adjudicated, but I of course want to make sure we don't mess up on the applications. Is there anything else we should be aware of for those who were in a similar situation. My understanding is since she had a legal entry, and a green card is immediately available for her, overstays are forgiven, which I don't believe she has because of her pending TPS application.

Edit: Her I-94 Class of Admission is "DT"

Combo Interview Decision Delays (I-751 and N-400)

Hello. We had our Combo Interview this month. We filed for I-751 (Removal of Conditions based on US Citizen Spouse) back in May 2023 and 2 years later we finally got our interview scheduled alongside with N-400 (Citizenship). Interview went great, I-751 was recommended for approval by officer but as we were told it had to be reviewed by supervisor. We assume it's due to lack of latest Tax Transcripts (2024) because at the time of filing it was only year 2023. But we brought the 2024 Tax documents with us and passed them over to the officer at the interview. Citizenship interview followed after that and went great, we passed! After the interviews we were told to wait approximately 3 weeks to see the status change and decision. 3rd week date approaching and status still shows Interview Was Scheduled with no updates. We assume that the wait will continue beyond the 3 week waiting window. We are on the final part of all the processes and looks like hit the slowdown.

Anyone else was in the same situation?

Is there anything else we can do but waiting?

Can we speed it up or inquire somehow?

I-130 Expedite Request Issues [Request based on Emergencies or Urgent Humanitarian Situations: – Active Warzone in Ukraine / Humanitarian Crisis / Life-Threatening Danger]

Hi all!

Looking for some advise and/or help here.

I filed two I-130 petitions for my dad and my mom, both residing in Sumy, Ukraine (a city directly bordering Russia and located only about 20 miles from active combat front line).

The city where my parents live are under drone or missile attacks almost every single day.

On June 3, 2025 there was a Russian strike on downtown Sumy that killed 4 and injured 29 people (its all over the world news).

My parents were going about their daily life running their errands in downtown Sumy at the time when the attack occurred. They were almost killed in this strike! They were only 700 meters / 0.45 miles away from the impact when it occurred.

This is not an isolated attack, this happens almost daily.

City is in range of Russian close range artillery.

Just two months ago there was an even bigger strike which even US Government and United Nations condemned:

US Department of State https://www.state.gov/palm-sunday-attack-on-sumy/
United Nations https://news.un.org/en/story/2025/04/1162196

I submitted 8 page long statement from myself in which I included links to news articles, photos of damages and strikes on the city, link to US Govt and UN publishing about strikes on this specific city where my parents live.

I also included maps, Google Earth images showing measured distance from frontline to the city - which proofs that city is in a range of close range artillery.

I also included references to Institute for the Study of War (Washington DC based American nonprofit research group that provides research and analysis of modern armed conflicts) where they publish daily updates showing Russian advances near Sumy city.

I included proof of evacuation orders by Ukrainian Govt in Sumy Region, etc. There was even a Russian drone strike on an evacuation bus near Sumy city killing 9 few days ago (I included that too).

Expedite Request I placed over the phone on 6/4. They told me that I will be getting a phone call in the next 10 days.

But I never got a phone call and today I received an email stating: "Your expedite request will not be submitted. We can not grant your request for expedited processing."

I am a bit confused here because it says "Your expedite request will not be submitted". Does that mean a rejection of a request ? Or they do not even allow me to submit it !?

Even the United States Government (U.S. Department of State) considers the whole country of Ukraine as a nation that is very dangerous according to its Level 4 Travel Advisory (Do Not Travel). Level 4 Travel Advisory for Ukraine by the US Government also means that there are life-threatening risks. So, I am a bit confused how can USCIS not agree with with U.S. Department of State determination !?

Overall, can someone please share any ideas why this could be ?

Clearly there is life threatening danger for anybody physically located in Ukraine.

Am I doing something wrong ? I just don't understand how such request can be rejected.

I have also seen many posts of other I-130 / I-129 expedite requests being approved based on war in Ukraine just after a phone request with USCIS by some applicants (in some cases I see some data points that USCIS approved such requests with no evidence provided on the same day).

Any ideas, insights are helpful! Please help!

Maybe I have missed something critical in the evidence ?

I am open to a lawyer as well if anyone have done this successfully and connect me with one approved good lawyer.

Thank you.

Can someone
