Waiting for NaO2, can I apply for F1 visa?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

 But you also have a K1 pending, which shows that you are wanting to migrate to the US. And the officer knows this.

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Unfortunately, I see you're trying to use your employer to cut the K-1 queue, get a F-1 to get to US, AOS and then stay. 

 

Most stuff you can learn online. 

 

This plan isn't succeeding, Unfortunately. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I would tell them the truth of having a fiancé in the US who I miss smch, I wish to have my studies and also spend some time with her while my study is on going. After which I would return to my home country . This is what I feel I will tell them and if granted F1 visa, then I’d withdraw our K1 application and then go for AOS. Hearing is an immigration fraud makes me weak cos I don’t know what to do anymore

Makes sure you tell IO this exactly at your F-1 interview. 

 

What field if study is this?

Which defeats the purpose of a K1, and the officers know it. Sorry, but they’ve seen this movie a thousand times, especially from high fraud countries.

This is a VERY BAD idea.

You are planning to lie to the US government AND your company... 

If your company is sponsoring your studies are you sure they won't ask for their money back if you decide not to return to Nigeria? MBAs can be VERY expensive. 

And how long have you known your fiance? 

If things go sideways... and you can no longer pay for your studies, you have to pay your company back AND you end up divorced... how will you pay everyone back when you lose your visa in the US and the trust of companies back in your home country?

I would not try to go forward with this plan. 

You are thinking of engaging in fraudulent behaviour with severe consequences. 

 

ETA: People are always trying to skip the waiting line at consulate by applying for tourist or student visas. I don't think you are getting the visa unless you really do cancel the k1, break up with your partner and only plan on studying in the US because you want to bring back valuable skills and knowledge to Nigeria.

You cannot enter the US via an F-1 with the intent to stay and adjust status.   That is visa fraud.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

the petition for the K1 will be viewed in computer by CO who does the interview

 

to get the F1 (non immigrant visa),  u need to follow the steps

apply to a college  

get accepted

pay the fee to hold your place for the semester

get the I 20 from the college

apply for the F1 

at inteview you need to show you have funds to pay for tuition and room and board plus books, lab fees,  transportation, etc
