Do consulates have access to previous DV entries

Hello VJ friends,

 

i had a question about previous DV entries where one wasn’t selected. Do consulates or NVC have access to the data entered their? 
 

A friend of mine was selected this year DV2023 and he’s worried that if they have access to previous entries where he wasn’t selected because the info(marital status, education, step children) he entered to apply for DV2023 are different from the previous ones.

If they have access to previous non-immigrant visa applications, fair chance they'd have access to previous DV lottery entries as well.

Why is it different? Did he lie?

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

OP, yes the embassy/consulate will have access and are able to see/compare information from previous entry submissions with the current one, and the subsequent information you will be providing on the DS260 form as as a result of your DV selection. So depending on what the discrepancy is, it may or may not impact the DV selection.

Yes, he applied when he was married with the wife and the kids and but him self with the step kids. The issue here his ex wife wanted at some point to abondent her kids so he applied 2 years ago with the kids he chose the option of biological children not step children. On the last DV where he was selected he applied by himself with the step children. 
 

if you are asking if he lies I guess he did even though it wasn’t intentional when he entered biological children instead of step children. 
 

that’s the only concern that he has. He never applied for non immigrant visa or anything. He applied for DV many times with the ex wife and step kids as biological kids and without a wife couple times with step kids as biological kids. This last time he applied as divorced with no kids and he was selected. 
 

any advice on this delama?

but he has biological children  so he will be called out on this misrep

 

he hosed himself /  even if his biological children were older and not intending to immigrant,  its very clear he is suppose to list them

Of course they have access to everything. 
 

If there is a discrepancy between what was presented as factual at one point to now, sure there will be questions. If marital status differs between entries, that’s an easy one as he will have to present all marriage and divorce certificates.
The kids is a bigger problem, the entry is specific you have to list all kids including stepchildren where you are no longer married to the parent.  As he didn’t list them now I suspect he’ll be disqualified. I actually know of a case in Johannesburg some years back where this happened. (Is also found out why they do this in case anyone wants a side track)

It’s not part of the visa application , any more than being born to someone who becomes a citizen or an employment contract with a US company is part of the visa application process. It’s a separate aspect that allows you to apply for a visa. There’s a difference. This is -for example - why entering the lottery or even being selected has no impact on immigrant intent determinations, only Ds260 or i485 determines that. of course the difference here vs a random family or employment relationship is that DoS gets and keeps your bio details.

I think I confused you guys. The kids are not his he’s not a biological father of the kids. So when he was separated with the kids mom he applied with kids without the mother. But last year when the divorce is finalized he applied by himself only. 
 

the question here he with his step kids when he separated with their mother before the divorce was finalized, but the divorce was finalized he applied by him self only and got selected. I asked what he chose under the kids option when he applied with the kids and he said that he chose children not step children. This is his only concern now? 
 

he has 2 question: 

1- is applying with step children without their mother while separated an issue?

 

2- is not choosing the option of step children instead of children on the visa application years back an issue?

Please answer a different question, because i think you’re missing the crucial issue:

are the kids listed, at all, in the entry in which he got selected?
