If they ask him he will explain the situation. He wasn’t able to add the step kids without the pictures. Anyways I hope they won’t ask him about it. He does have a divorce decree that doesn’t mention anything about the kids because they weren’t his.

Read the underlined portion of the rules @SusieQQQ provided.

"all living stepchildren who are unmarried and under the age of 21 on the date of your electronic entry, even if you are no longer legally married to the child’s parent, and even if the child does not currently reside with you and/or will not immigrate with you.   "

"The US immigration process requires a great deal of knowledge, planning, time, patience, and a significant amount of money.  It is quite a journey!"

You’re not understanding something basic here. They will go through the questions in the DS260 with him. Including the ones about kids. Being divorced is also a flag for asking about step kids, that’s how that guy in Joburg got found out - he just totally didn’t think he had to list them so got a nasty surprise.  Anyway, it’s only what $800 or so to spend between the visa fee and medical costs for him to find out. Make sure he doesn’t sell up before his interview.

So based on what you’re saying here he won’t get a visa regardless and there is no chance for him to get it because he didn’t list his step kids. Right?

Yes. Again I refer you to the rules

Failure to list all children who are eligible or listing someone who is not your child will make you ineligible for a DV

I just spoke to him. He said he couldn’t get the photos nor the contact. So he will explain that to them, but he’s debating now wether to go to the interview or not. He doesn’t want to spend money if he’s not going to get a visa.

since you’re a pro at this. Is anyone who hasn’t disclose his social media accounts will be disqualified?

It is part of the visa application process.  The entry submission is legal documentation.

This is like an attempt at comparing apples and oranges. The submitted DV entry is a record, yes. It does not signify a demonstrated immigrant intent which the DS260, which is the visa application a selectee wishing to process their DV selection subsequently submits. Same way being a DV selectee does not demonstrate an immigrant intent. Let’s not mix up terminologies nor confuse others needlessly. The submitted entry is not a visa application. It’s as simple as that.

Can you explain this more please? I’m not if I got what you’re trying to say. Are you saying they won’t pull up previous entries?

It's a record....part of the case. No, it is not an actual application (DS-260).

I believe I already clearly answered this question in a previous post. May I suggest you go back to page 1 of this thread and re-read my previous response?

No. It is a debate over terminology. The specific type of document is not relevant, what is relevant that it is and remains on record.

I will let him know. Hopefully they won’t ask. Someone told me that they don’t go back to previous entries especially that he’s divorced now and the DS260 asks if he has any children. He wasn’t able to get pictures of the kids because he doesn’t have any contact with their mom I think USA is penalizing people and pushing them to lie if they ask about these kind of things. It’s insane to ask for step kids if you can’t even get passport photo of the kids because their mom decided to disappear.

I don't think you are understanding the points being made by Susie here.  Recommend you carefully read through the thread.

Let's say for some miraculous reason he gets through it and ends up with a greencard he'll have this hanging over his head for as long as he lives in the US. Every letter, every phone call, every knock on the door could be immigration planning to revoke his Greencard because of this.

Hello VJ friends,

i had a question about previous DV entries where one wasn’t selected. Do consulates or NVC have access to the data entered their?

A friend of mine was selected this year DV2023 and he’s worried that if they have access to previous entries where he wasn’t selected because the info(marital status, education, step children) he entered to apply for DV2023 are different from the previous ones.

thanks,

If I'm not mistaken, your friend will have to declare under oath during the interview that all information provided on the form is correct to the best of his knowledge.

Regardless of whether the Consular Officer asks about the previous information or not, your friend did not list his stepchildren from previous marriage as pointed out that he should have. So the information provided is NOT correct to the best of his knowledge.

So is he planning to just lie under oath about it?

I don't think I even need to say this, but this is not a good idea....
