no marking on the visa doesnt mean her visa is not voided in the system

personally i wont do it but if you adamant about it

hoping for the best and expecting the worse. 

prepare the back up plan if they deny her entry in mexico

Does Mexico require her US tourist visa to be currently valid? Let me tell you where I had the most inspection of my green card… the two times I used it to go visa-less to Mexico. And you’ll be entering Mexico as a married couple right ? I would not be surprised at all If Mexican immigration scans her passport for US entry dates and figures out she no longer has a B, or they may conclude that (you say she’s been in the US since last year) she’s “overstayed” the B and voided it that way. (Yes I believe Mexican immigration authorities know a fair bit about US immigration requirements.) And to answer a question from the first post, no you cannot hold two statuses at once. I mean… you can try use it… but as others have said, have a plan B.

if she in in the middle of adjusting status and contemplating a trip to Mexico I assume she has Advance Parole and that would be the relevant document for Mexican immigration.  If she has documents valid for entry to the US she is admissible to Mexico without a Mexican visa.

 

 

We however had an unfortunate experience with Mexican immigration when my wife was denied entry with a valid 5 year Multiple Entry Japan Tourist Visa.  Mexican immigration fully acknowledged it was a valid visa for entry to Mexico and tossed her strait back out anyway.  Mexican Immigration is shockingly unfriendly to Filipino passports in our experience.  That said.  I believe if we had been traveling together my wife would have been fine.

I'd take a guess that the Mexican authorities would go by seeing what appears to be a valid US visa foil in the Passport and let her in. But they could do record checks, I'm not too familiar with how Mexico handles these things given that I've only crossed into the country once from the US (and I was 16 at the time lol!)

 

What I do know is that the information sharing between the US and Mexico is far less than that that goes on between the US and Canada.

 

Honestly if it's not too much effort I would advise she gets a valid Mexican Tourist visa if required. Nothing to lose from that.

OK,   I better walk back that statement.  It is incorrect.  The Mexican Embassy in the US is quite specific about what documents you need. https://consulmex.sre.gob.mx/washington/index.php/ligavisos/15-informacion/182-visas-english

 

It seems quite clear she must have a Mexican tourist Visa.

The only problem is we recently found this out. And there are no appointments available between now and when we leave or we would have done so.

Btw, my husband migrated on K1, his valid B1B2 visa was cancelled with stamp. Also, you can email the issuing embassy to inquire whether or not the Visa was cancelled. Had some uncertainty regarding MIL visitor visa, and we found out by emailing them that it was cancelled without prejudice. They do take a couple days to respond though. Fyi, neither USCIS or the NVC doesn’t have this info only issuing embassy.

FYI, neither uscis nor NVC could be expected to have any information about visas as they don’t have anything to do with them, but DOS (the department with oversight for visas) will have it if course. (We’ve had a few reports here of people with what they thought were valid visas being denied boarding to the US on instructions from DoS/DHS.) The question really is whether a visa that “looks” valid is good enough to be accepted by Mexico, even if digging might show it’s not.

Yeah, that could be anyone’s guess. Some ppl mentioned that they scan and check, so appearing valid may not do the trick. Not sure, but I guess they can try, hopefully it’ll be ok.

There we go. The Mexican Embassy in the US probably gets some version of this question every day.

 

At this point, if a tourist visa expedite isn't possible, @BigBen17 and wife will have to rebook the trip. Lesson learned for future travel.
