When is it too late to file AOS from a K-1 Visa?

Houston office is the worse, be prepared for  a long wait for an interview.

Sent: 9/12/16: I-130 + I-485 + I-765 (USPS)

Delivered: Sept. 15th 2016 to Chicago Lock Box

Interview Feb  21st, 2018 for I-485

Interview  May 13th, 2019 for I-130 Stokes interview ( 2 minutes)

NOID issued May 17th 2019

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

And because you live in a border state, be aware that she may want to lay low around border checkpoints (I'm not sure what they're called - the ones that are *near* borders, but not actual border crossings) until you get the NOA1 for the AOS, at which point she will be under "authorized stay" while waiting.  Don't forget to apply for the EAD/AP concurrently with the AOS - it's free.

Harris county?  She’ll be fine.  Wouldn’t take a trip down to Padre anytime soon.


OP:  Y’all get that marriage cert and get her AOS filed ASAP.  She can in the meantime safely hide out in the Home Depot parking lot down at the Beltway and Bellaire, nobody will bother her there 😂

Yep.  Knew a guy who had to get (two) stamps for his wife and by the time her AOS was approved they passed the two year anniversary mark

Neither of us has a US DL either, only Philippines. I guess we both could have gotten deported. Hahaha

That’s not credible.  If you believe you entered April 8, 2021 then the passport stamp shoukd have a date in April.  For example my wife entered as a K-1 fiancée on January 9, 2019.  Her passport stamp has two dates, January 9, 2019 and under it: “until April 8, 2019”.

I am.confused.  Why did you need. SS#? I'm from Texas and just got married. We got married in tarrant County and didn't need a ss#  and married after 10 days of my fiance being here on the K1. .

You don’t need a SSN I think OP was ill informed.

My fiance and I just got married through civil court on the 6th of July and her K1 Visa expired on the 7th of July as per the Visa stamp.  It took us 5 weeks to receive the social security number and Harris county in Texas would not let us apply for a marriage license without a Social Security number.  After that we had to wait three days to request a marriage appointment with the judge and the dates available did not allows us to get married until the 6th at the earliest.  To make a long story short, with all the delays at the SS office and county due to COVID, we were not able to get married until the 6th, a day before my fiances K1 visa expired, is that too late for us to get married?  and did we have to file the AOS before the visa expires?
