I received my 10 year green card 6 months ago (that's when I entered the country)

We never lived together before and after moving in together my husband became very abusive mostly verbally, every little argument triggered him calling me names.

about a month after I arrived he slammed my head against the wall, I took my stuff that night and went to stay with my friend. I didn't call the police, I just left.

This made him very angry and he said he will do everything to deport me, That same moment I changed the address on the USCIS website and I received my 10 year GC at my friends address.

A month later he begged me to come back and stupidly I went back and believed him when he said he won't do that again, but a few days later the verbal abuse started again and I realized that when he gets mad he has no boundaries and he is acting like a wild animal.

I left again. now I want to file for a divorce.

he is saying he will report me for fraud and that the USCIS will investigate me and deport me, he said that the fact that I left so fast will help his claim that this was fraud.

I am wondering what will happen 5 years from now when I apply for naturalization? will they investigate me because I changed the address one month after I arrived? will they deny me? if he report me, will I get into trouble?

One thing I found annoying,  most of the time, if an immigrant have an issue in his or her marriage, its label as fraud. Marriages either work or we find our way out of it. As long as you entered in the marriage with good intentions,  you will be okay. He can report you billion times, USCIS officers knows what they are doing,  yes they may investigate but that doesn't mean they will deport u just like that. Only an immigration judge can deport u. Its a long and complex process. Just gather all the evidence you have during your time with him either good or bad. 

If i were u, I would see a lawyer for an opinion.

We read a very similar story here a couple of weeks back, written from the petitioners POV asking how to report fraud.

 

Nothing is worth staying with an abuser - consider yourself lucky that you got out. Are you planning to file for divorce based on abuse?

 

I am not sure, but would keep all proof of bona fide marriage/relationship until your naturalization, just in case questions come up.

Fraud accusations by him would have to be backed up with substantial proof to hold any weight. Only you know if he does have such proof, but from what you describe he does not so I wouldn't worry too much about that.

You don’t need to worry about hour immigration status in the US- you didn’t commit fraud and you are legally here. He can threaten all he wants but the green card is YOURS: you don’t need him anymore. Don’t buy in to his threats and I suggest you block him from your phone and save the messages you have. You think USCIS who is on the brink of collapse is going to waste their resources looking/deporting you/your case with NO proof you committed fraud? Another tactic an abuser uses/thinks he can use. You have no problem applying for Naturalization 5 years from your residency date. File for divorce ASAP based on abuse. If you are ever in this situation again call police.  I’m glad you have somewhere safe to be. Move on with your life and don’t let him drag you down- no one deserves this.

You husband has NO control over you or your immigration status.  As a 10 year Green Card holder, you can apply for citizenship under the 5 year rule without issue.  Stay safe, protect yourself legally, and seek happiness for yourself.   Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Doesn't matter - you'll be filing under the 5 year rule, so the marriage you obtained your green card through won't matter for this process. Just tell the officer the truth and nothing but the truth and you'll be fine.

I would suggest a good divorce attorney.......Her immigration status is already determined. She has a 10 year green card which means they were married for at least 2 years before she entered the US.

When applying under the 5 yr rule sometimes they ask for more information about your marriage. Yes they can ask even under the 5 yr rule as you did get your GC through marriage.

Just explain  the situation if asked. 

Gather everything and anything you can think of that you did live together even though brief. All it can do is help.

I don't have anything since we didn't move to a new place or had a joined account, all bills were on his name we didn't change anything

Well that sucks but not the end of the world. Just be confident and explain if they ask how the relationship turned violent. You  moved out such and such date, he begged for you to come back you tried again and things again turned violent. I highly doubt you will have an issue. But in life only death and taxes are guarantied.

Hi I applied under the 5 year rule. Keep important documents handy and write down the dates as things happened. You might need to retell your story during the interview. I had to and I had to remember some dates. I was even asked if I lied on my form. Of course I didn't but she wanted to trap me in a lie. So come prepared.

 

I suggest you look into getting a restriction order. If you get a restriction order, take the papers with you. You haven't gone to the police so you don't have proof of his abuse. You need to protect yourself not only by leaving him but to keep a trail that shows that you leaving was justified so his claim of fraud cannot hold.

 

Of course my ex husband often threatened with deportation but he is responsible for you for the next 40 quarters that you work. If you get on public benefits and the government will come after him. So really, you have the upper hand right now. He will not be able to withdraw the I-864 nor can he deport you. Sorry if my post is all over the place, I just woke up from a nap

This is not correct.  OP, you don't need an immigration attorney.  You need a divorce attorney.
