The US Consulate in Vienna Austria confirmed that a K-1 is a NON-IMMIGRANT visa and ARE NOT AFFECTED by this ban. K-1's will be issued once the Consulates re-open and K-1's will be allowed in the country once the travel ban is lifted (or if you aren't in a country specified by the travel ban).

My fiance is in Austria too. But, she is waiting to receive her visa once the Consulate re-opens. I considered having her go to Canada, if possible, for 14 days and then have her enter the country as I have seen others get across the Canadian border with K-1s. I just need the Consulate to re-open first. Your plan is worth a try. Definitely let me know if it works.

Except I believe Canada's borders are tighter than the US.

As of now, I am not worried about this. There is no rationale to ban K-1s as their AOS takes about 6 months. Therefore, they are no immediate threat to American jobs. Obviously, the government may not care about that, but won't know until if or when an amendment is made to this EO.

That’s fine. If I had a k-1 in my hand, I wouldn’t waste much time to find out. That’s all.

I called my fiancé’s embassy in Croatia as well. They confirmed that K1 visa will not be affected. I don’t anticipate anything changing in this regard. You have to look at the intent of this bill - it’s not to separate spouses

United States law does not see you as a spouse.

Completely agree. If they will review non-immigrant visas, they will probably want to impact temporary work visas. I strongly believe that the K category (fiancés and spouses of US citizens) will not be affected. Let’s simply hope for the best.

Technically no but the K1 requirements to get the visa are the same as obtaining the spouse visa - minus the marriage certificate. For all intents and purposes they will be treated the same.

such a relieve! I emailed the US embassy in Madrid a few times since the European travel ban and never got a response. I’m glad they’re actually replying to emails now

March 3, 2020Sent I-129f to Dallas Lockbox via USPS.

March 5, 2020USCIS received I-129f application.

March 10, 2020 - Received receipt text from USCIS for NOA1.

October 8, 2020 - Case Tracker notification for RFE.

October 13, 2020 - RFE received through mail - Response sent same day.

October 19, 2020 - App Message from USCIS saying RFE response received.

November 25, 2020 - Case Tracker App Message for NOA2  approval.

December 5, 2020 - Received hard copy NOA2 through mail. Signed up to NVC Email list.

December 15, 2020 - NVC receive documents.

January 8, 2021 - Call to NVC - New Case Number assigned. Filled out DS-160.

June 29, 2021 - Joined Lawsuit King vs Blinken.

August 3, 2021 - Case Status changed from at NVC to In Transit on NVC Case Tracker.

August 9, 2021 - Case Status changed from In Transit to Ready on NVC Case Tracker. Interview and Medical Booked.

August 20, 2021 - Medical Complete.

August 25, 2021 - Interview Complete - approved subject to Medical Documents.

August 25, 2021 - Case Status to Refused subject to Medical Documents.

August 26, 2021 - Case Status changed from Refused to Administrative Processing.

August 31, 2021 - Case Status changed from Administrative Processing to Issued.

September 1, 2021 - K-1 Visa in delivered to home address and in hand!

The exemption:

 “(iv)    any alien who is the spouse of a United States citizen“ 


applies only to those that can prove they are the spouse of a United States citizen to Border Patrol. 
 

as of right now, non-immigrant visas will be admitted, but will be reviewed in 30 days. 
 

 

if you have a non-immigrant visa in hand, it’s a good idea to travel now.

Fly to Dubai, i heard Dubai is going to open flights to US from 1st May 2020. :)
