What if my wife didn't file for her tax return in 2018 but she filed in 2016 and 2017 can we just go ahead and upload the 2016 and 2017 transcripts??

Why did she not file 2018 taxes?  She will have to either file for tax year 2018 or explain why she wasn't required to file for 2018 tax year at all.

She couldn't do that now due to the Covid-19 and we don't know when this is gonna be gone.... Now we have the 2016 and 2017 transcripts can we just go ahead and upload the two then I can go with 2018 transcripts to my interview after the pandemic

No.  She will have to submit the most recent year tax forms or she will have to explain why she wasn't required to file for that year....The most recent year is 2018 (since 2019 taxes are not due until July 15th).......and by the time your interview is scheduled (if it is after July 15th), you will probably have to provide her 2019 tax documents.......

 

Her 2018 taxes (if he was required to file) are far overdue......

The thing is we are just exploring every available options we have, we paid an attorney to do all this run around for us but eventually he is only after money and does nothing, she actually filed 2018 tax return but our attorney ask us to get 2015,2016 and 2017 tax return which we have ready but now we are just getting to know we need 2018 tax return which we don't have... My wife file for it and she hasn't gotten it due to this Covid-19 and I don't think we gonna get it soon because irs is busy with stimulus stuff  and it's been more than a month, she couldn't get it online as well because she has issue with her name since we got married now we have been stucked for more than two month. Every other document is ready and uploaded just only this transcripts

You are changing your story......you said "What if my wife didn't file for her tax return in 2018".....

If she filed for tax year 2018, she MUST submit her transcript or a copy of the returns for that year (2018)...there are no other options........unless she waits until after July 15th....then she will have to submit her 2019 tax documents.....

The reviewing officer will have hard time believing not being able to do 2018 tax return because of COVID-19.

Don't get me wrong I'm just trying to get different opinion on our next step moving forward... We have being stuck here for 6weeks now and still don't know the way forward.... She filed 2018 tax return but she doesn't have 2818 tax return transcripts she only has 16 and 17 but she requested for 2018 transcripts month ago which she hasn't gotten up till now and might not get it soon moreso she couldn't get it online because she has name issue I'm just asking if there is a way forward for us instead of being stucked here for God knows when

Not when it comes before I go for the interview... The CO won't doubt anything if I present 2018 transcripts at the interview

Can you not just wait for your 2018 tax transcripts? Why the rush? Just wait and do it the right way. Your either waiting 2 months for the Transcript and submit everything or waiting 3 months for them to review your case and them saying in a RFE we need the 2018 transcripts and THEN wait another 3 months for them to review it again. 

 

Also I don't see how a letter explaining that the reason your not filing your 2018 transcripts with the NVC is because it "takes too long" is acceptable. Unless she was unemployed and had no income and didnt file joint taxes with you I don't see how thats a good reasoning. 

 

Just wait for your 2018 transcripts.

We requested for the 2018 transcripts 6weeks ago and we don't have it yet. Isn't it obvious irs have  a lot on their plate right now due to this stimulus they are dealing with and no assurance they will be sending it soon... Now I read on another post that we can use her 2018 1040 income tax form in place of tax transcripts with explanation letter
