My mom was bar from entering the US at point of entry for 5 years because the border control officers said she worked in the United States during her last visit.

The truth is, she didn’t work. Although, she babysit for a family friend member who gave her a gift when she was leaving. Her English is not very good and she couldn’t understand the officers very well. 
when I was there, I told the officers to get her someone that understand her dialect cos she don’t understand English much and the officer told me she spoke with someone in her dialect. But when I could speak to my mom, she told me she requested to give her someone that understand her language cos she don’t understand English but they refused. 
megaton can I do? I was told I could get a waiver.. 

someone should please help. We just lost our dad too, and then this happens to my mom.

That is usually considered a job in the US even if she was not paid at all in any forms.

i wonder what’s the success rate for inadmissibility waivers for B2 visa.

She performed a service for compensation- that’s work. Even without the gift it’s still work (replacing a local babysitter who would be hired for the job). Sorry, but the ban seems justified. You can try for a waiver ... no idea if it will be successful, have you looked into the requirements?

Nothing you can do. And unfortunately, in the eyes of the US government, you mother performed work. babysitting can be considered taking a job away from an American who can babysit for your friend. I know it seems strange, but these are the rules. If your mother was here for several months baby sitting almost every day, then it can most definitely be seen as working. Plus she was given a gift which can be viewed as payment.

 

There are no waivers for this and you mother will not likely be entering the US anytime soon. The only option is for her to reapply for a new visa in 5 years.

 

Sorry for the situation you she is in but for now, there is not much she can do.

Sorry but I don't think any waiver would work for tourist visa. There is a lot of life-death matters which are denied a tourist visa if you look it up.

As others said, that is considered work.

Makes me think of somebody recently who repeatedly claimed that being a caretaker isn't work since it was not paid. 🤷‍♂️

 

It sounds like it was an expedited removal, which carries the 5 year bar. There is a waiver - an I-212 (https://www.uscis.gov/i-212).

The likelihood of actually getting the waiver recommended is another issue...and it is not quick or cheap. Then she would have to interview for another visa and be determined eligible again. Another significant hurdle given a recent removal.

She'll most likely have to wait out the 5 year bar.

Personally I think it would be a waste of time and money, but she can apply for another visa and hope that the Consulate Officer who interviews her decides to recommend her for a waiver.

 

After the ban is up she can reapply, but also a long shot with her past history.

 

When you are a USC you can sponsor her to immigrate.

Sorry about that... It is considered work... Even if she babysat your kids and got anything in return.. Her B2 was for visit and pleasure. I You can't do anything and she will have to wait out her 5 years ban... Even after that consular could be unforgiving. She the best you can do now is file a petition for her if you are a citizen. Chances are you could get a waiver for her inadmissibility. Sorry about Your Dad... My heart felt condolence
