seperated Separated need help

My husband was deported and now wants to be separated but doesnt want a divorce.

He said he was told that the marriage would desolve after 5 years anyway. Has anyone heard of this.??

what country were you married in?

what are those laws regarding marriage?

Tell him you will file for a divorce and ask for alimony unless he signs the divorce papers/ that will settle it

you need to be free here and forget his issues

Well this isn't true at least according to the laws here in the USA. Where were you two married and what country are you both from?

No he thinks we do not need to get a divorce but thinks it will dissolve in 5 years since we are seperated. I've searched and searched and cant find anything or if this is true.

it is not true / no marriage in the US is automaticatly dissolved / takes a divorce / in some states , it even takes a former separation (like NY for a year ) before a divorce is final  / my sister went thru that

No, he is wrong. Even if you do a legal separation (as opposed to just saying "we're done" and moving out) you still need to get the marriage dissolved. Until you divorce -- all the filings, waiting for the order -- you two are still married. If either one of you get remarried before that's done, it's bigamy.

 

Nothing is stopping you from divorcing him even if he doesn't want it. Please get a lawyer because he is not in the US, which can complicate matters. Even if you only meet with a lawyer once to figure out what needs to be done, it will be worth it. Your husband sounds lazy and entitled. Divorce him and go live your amazing life without him dragging you down.

File for divorce. Last thing you want (even if there is a slim chance him being in another country) is him racking up debt and they coming after you. Or showing back up in the US even as a visitor and doing something stupid.
