This is what i was thinking how did she stay in the US on VWP (90 days) for probably at least 10 months? Even if you add the 6 months regular tourtist visa on to it. The time to get pregnant plus 9 months and time to recover after giving birth and traveling is way longer than 10 months.Thats crazy

first off the mom is from Taiwan and came to USA with tourist visa but while staying in the USA she met someone and then they had a child.  The problem is the guy does not want to have anything to do with them.  The child is a citizen.  She had to go back to Taiwan since her visa was expiring.   
 

is there anything she can do to come back to the US and apply for visa? So that she can send her child to school in the US?

Just as an aside there is nothing special about American elementary, middle, and high school education. In reality they lag behind most developed countries. It is at undergraduate and graduate level that the quality of American education shines and rises to the top.

 

Actually Taiwan is ranked above the USA in pre-university education.

Most of those high priced American Schools around the world are not the best schools. They are expensive because they cater to a demographic who are affluent (like expats) and/or have their employers picking up the tab.

 

Of course if the real intention is to use the child as an anchor into the USA, the facts I have presented won’t mean anything to her.

The education the child would receive in Taiwan would be better than the education she'd get here at public schooling.   It's not until post-secondary that the US kinda shines at all tbh.

I’ve obviously spent too much time on VJ which has made me cynical, but anyway, as has been said, there are alternatives for an “American Education “ that don’t involve the mother moving to the US - an option she doesn’t appear to have at the moment anyway. If that’s the objective she needs to look at those.

No extension possible for VWP.

The child can study in the US fine. They just need a guardian to take care of them in the US.

I was thinking about that, as the otherwise obvious route is for the child to live with the father, at least during school term.
He is of course liable for child support regardless, should the mother choose to enforce it.

Thank you all for the options and opinions.

 

I will relay this to her and hope she will know what to do.    I do not believed she over stayed her visa.   And I think her best bet is have someone in the USA take care of her child.  Or have the father of the child sponsor her.

You said the father wants nothing to do with her, the only way he can sponsor her is to marry her.
