K1 cancellation

Hi there, 

 

I would like to ask about  k1 cancellation. I am from the Philippines. My relationship with my boyfriend didn't work well,we decided to part ways,we applied for k1 visa and the case is already in Manila US embassy. We didn't schedule an interview ,we just let it sit there. That's way back 2017. Now,i had a prospect who is a US citizen. My question is can we apply a k1 visa with my new boyfriend even though the first k1 application is not cancel? Should i ask my ex to cancel it before we apply a new one? Or should we apply a spouse visa instead? I appreciate your comments about my case

Your petition approval would have expired in 2018.  If you still know what the MNL# is you can see what the current status is on ceac.state.gov 

 

Your new suitor certainly can petition for you.   I might expect to be questioned by the embassy come interview time

It has expired. You can start a new K-1 application, but USCIS will be doing a more detailed check on you. It will be an uphill battle for a new K-1. You can try for the spousal visa, but you have to prove it is a bona fide relationship.

I think my wife still refers to me as "The Prospect." :-))) Seriously, I think it is just a matter of English usage in the Philippines. My wife will use more formal words like this when a simpler one would suffice. I wouldn't read to much into it...

Not a newbie but lost my old info years ago) I have been through this process before --all the way through naturalization-- This site has always been a great help to me.

Same...seems like an ESL issue more than a fraud one. The term is technically correct but has a clear connotation attached that ESL readers may not catch.

US Embassy in Manila really doesn't seem to care if you had a previous K1 visa cancellation, From what I have seen.

In other countries it might be more of an issue but there does seem to be a larger than average number going through Manila who have had multiple American boyfriends, even previous petitions. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

It wouldn't hurt to have it canceled.

 

The Embassy in Manila on it letter states:   "Under U.S. immigration law, the approval of an immigrant or fiancée petition is automatically revoked upon:

 

1. The formal notice of withdrawal filed by the petitioner / beneficiary.

 

So It seem as if they allow the beneficiary to withdrawal as well as the beneficiary.
