September 2019 AOS Filers

Truly hoping all the RFEs are quickly resolved, very nerve racking as no one is immune from the dreaded RFE. Just hang in there and get back in there.

I had my biometrics on Oct 2nd, review completed the same day. & no update yet:/. Hoping to see that *case is ready to be scheduled* sometime soon! Aghh!

Update: So I got the RFE notifcation on USCIS site on 11/12/19 and I received the RFE hard copy letter on 11/15/19.  Attached images of the hard copy.

I'm just baffled, since we sent all the required documents on the RFE notice and it says it was insufficient. We also made sure to send all the docs because we saw other applicants from the same country receive this RFE notice having insufficient document for birth certificate and related docs.

 

Our only concern is are we okay to send the same documents again since it's asking for the things we've already sent?

 

It says to send in 1) Basic Certificate (Detailed) and 2) Family Relation Certificate (Detailed) OR submit a Family Census Registar and Family Relation Certificate (Detailed). I'm sending in everything both option 1 and 2.

09/12/19: Sent AOS package

09/14/19: Package arrived at Chicago.

09/30/19: Received 3 text notification at 10 PM

09/30/19: NOA 1: I-765 'Case Was Received dated' 9/16 (checked status on USCIS site using receipt number)

09/30/19: NOA 1: I-131 'Case Was Received' dated' 9/16 (checked status on USCIS site using receipt number)

09/30/19: NOA 1: I-485 'Fingerprint Fee Was Received' and dated 9/27 (checked status on USCIS site using receipt number)

10/01/19: Check cashed after 12 AM (pending at current time of writing)

10/05/19: Received 3 NOA 1 letters (hard copy in mail)

10/25/19: Bio-metrics Appointment

11/12/19: Received RFE for spouse's birth certificate

11/29/19: Case Center received our RFE response letter and documents

12/20/19: Case is Ready to Be Scheduled for An Interview

01/10/20: Case is Interview Was Scheduled

01/17/20: Received interview letter in mail. Interview is scheduled on 02/14/2020 (Valentine's Day)

I received a RFE too :( they asked for my birth certificate which I already submitted and my husband 2018 tax return (  his tax return wasn't ready by the time I sent the AOS package so i sent the 2017) .

Our biometrics appointment was October 24, the status was updated the next day.  No update since.  So your situation isn't out of the ordinary.  With the USCIS there really is no rhyme or reason... at least not from our vantage point.  Just keep checking daily.

Also got an RFE; clearly this is a new approach at NBC/USCIS.  A bunch of questions about financial standing which were insane, as there is no question we are over the income level and sent IRS transcripts etc. at the time of filing in September.

 

The questions in the RFE were contradictory and made no sense; the lawyer said she had never seen anything like it.

I think it is a combination of direction from above to place extreme scrutiny on finances (possibly ahead of the public charge stuff, which was blocked for the timebeing anyway) + having people who are simply not trained well enough to analyze the information in front of them.

Seems if they can't  get you one way  they'll  try another.

Oct 4, 2019 Received 4 receipt notices
Oct 11, 2019 Received Notice of Biometrics Appointment
Oct 24, 2019 Biometrics Appointment
Nov 14, 2019 Case (I-485) is ready to be scheduled for interview

 

Employment Authorization still Fingerprint completed.

Hi, thanks for this update.

 

Did you have a co-sponsor on your 864 by any chance? Were you using income, assets or both to qualify? On the IRS transcript, were they asking for info printed from its.gov that you’d already mailed or for prior year’s returns even if one is sufficient?

 

As you say, perhaps everyone is getting entangled in the stayed i-944 style procedures coupled with anything beyond the basics leading to confusion, but you would think that September filers wouldn’t have been hit regardless.

No co-sponsor.  Income gets us there without any question whatsoever.  The questions in the RFE just didn't make sense, but actually for that reason I am not stressed about it.  There is zero question about qualification I guess it just needs another letter and more evidence, which fortunately I am easily able to provide.  

 

Just annoying more than anything!

Just an update. On Nov. 14 our case was updated to Initial evidence Requested and on Nov 18 i received an RFE in the mail stating we did not meet the income requirement. We have sent everything from tax transcripts to employment letter and pay stubs just to prove my husband earns more than the income requirement btw my husband is a Registered Nurse and earns more than the requirement but still they want us to have a co sponsor. 
my question is do we need to send another i-864 for my husband or just send i-864 for our co sponsor? The only good thing about receiving rfe is i know they are working on our case😅...
