Will I be denied because of this?

Hello everyone. I’m an Italian citizen, my boyfriend lives in the USA but he can’t visit me right now. Because of this, I tried visiting him. I landed in Detroit but they deported me and revoked my ESTA because they thought I would overstay, which is not true. Now I want to apply for a tourist visa as that is my only option right now. But I’m wondering, will they deny me without second thought? I’m a student with no job, I live with my family, have no kids or anything. My only ties are my school and my family. I feel like that will be a problem. I don’t know what my options are at this point. Is there anything I can do to ensure they don’t deny me?

You won’t be getting a tourist visa with ESTA denial and POE turnaround. 

The USC bf better find time to come visit you.

You can’t demonstrate ties you don’t have .. but unfortunately your ties are not strong ties and it’s likely that the visa will be denied for the same reason that the ESTA was revoked. Unless your situation changes, and your demonstrable ties increase significantly, I don’t see a different outcome  

You could consider  meeting in a 3rd country

Did you receive an official expedited removal?  If so, that triggers a 5 year bar from entering the US.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I don’t think OP was really deported, denied entry more likely..

It will be a struggle to get an appropriate visa if your situation is still the same. But yes, your US partner can visit you or you could meet in another country..

Unless you can overcome the assumption that you will not overstay in the US, it is highly unlikely that you will be granted a visitor visa........ordinarily, all applicants are assumed to intend to overstay.  In your case, there is significant suspicion.......personally, I wouldn't waste the $160.00 USD.

You can certainly apply but I would expect them to deny you without a send thought.

Due to the reality that you have nil-to-no chance of getting a visitor visa to the US, this is what you need to say to your boyfriend, Sbrigati e vieni a trovarmi in Italia. Fai un buon viaggio. (Hurry up and come visit me in Italy. Have a good trip.) :thumbs:

If he is in Detroit, you can visit Canada and meet in Windsor. It's right across from Detroit.

Time to visit outside the US. You are free to apply, but I really don’t see a tourist visa in the near future given the circumstances.

Even if you get the visa, which is unlikely at this stage, you can still be denied entry. I’m curious as to why they denied you. It’s certainly unusual for a VWP visitor. You need to make sure you don’t make the same mistake again. 

 

What questions were you asked on arrival and how did you answer? How long were you planning to stay?

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Oath: March 22, 2021 COVID-style same-day oath
