I misread something that made me think it might be safer using a different one, but you should definitely  use the one you have been using the whole time. It is really weird that they issue RFEs to lots of people for the same thing. I read somewhere that people think it might be a quota thing, that the adjudicators are buying themselves more time by issuing RFEs. This isn't a fact, just an idea someone had, which I would consider to be true - I think they wouldn't miss THAT many birth certificates.

Did you send the birth certificate with it's translation for the EAD and the AP too? I read somewhere that birth certificates and translations are now necessary for those forms too.  I only sent one copy with it's  translation in  the AOS package and now I'm a little nervous  ☹️

Translation rule (copied from I-129f where I remembered seeing it) is pretty simple and straightforward.   Not sure why they seem to focus in on rejecting it, when it seems people were able to comply with this fairly simple requirement.  Not like it needs an attorney or even a notary.   Seems about anyone with some competency can qualify under this rule.

you should be fine.   The current instructions for EAD and AP do not require the BC.    We sent the BC with the 485......of course, 485 requires BC.   You may still get the RFE, but it won't be because you didn't follow the instructions......it will be due to some issue on their side like so many others have experienced, and seemed to have zero control over.

The takeaway seems to be, no matter how diligent you were preparing the forms, you may still get an unexplained RFE.   Feel like I'm in Vegas.

I have only sent one for the AOS, but don't worry, I haven't heard anyone having problems with that. Both the EAD and the AP don't mention birth certificate as one of the docs required.

Breaking news: What USCIS is asking for is my LEGAL SIZE birth certificate. I submitted the short version that my government sent to me via online, but what USCIS is asking for is the original one when I was born, it is in Legal size and has a bunch of signatures and a stamp from the Civil court in Mexico back in the day. So, I am sending that document to translate today to send back.

By the way, I read the same happened to another couple from April this year.

Good day, i just want to ask if upon filing the I-485 should i includ evidence like photos of our wedding ceremony, joint acoount bank statement of I and my spouse or any other evidence and also about the Advance Parole should i really need to file it together with I-485 and EAD? i have no plans of going out in the US so might as well not to file an AP?  thank you

It's either "Ready to be scheduled" and then "Interview has been scheduled" (it's possible just to get a mail with the invitation, seems like sometimes status is not updated on time) or RFE (hope not)

Hello, 

Some people send those stuff but I personally believe it's really unnecessary especially because there's no mention of it in the list of requiered supporting documents but as you can imagine not everyone has that at the time of filing. I didn't send anything like that.

 

And applying for AP and EAD won't hurt cause you don't pay an extra fee. You never know what might happen.

And it's the GC interview, right? There's no interviews for AP/EAD?

Supposed to be
There's no interview for AP/EAD. It's possible that you receive it before your GC, at least this is how it's supposed to be. You can check processing time for AP/EAD on USCIS website.

Hello everyone, I just submitted my AOS with 765 and 131. How long  can you receive your notice of action? Because I haven't receive mine.
