Untrue bill (cyberstalking) for i129f?

OP,  if you're still following this thread, just know that based on many, many similar stories here on VJ, if you do not disclose the arrest that you are trying to keep hidden from USCIS and your fiancee, it will come out in the background check that USCIS will do on you.  You cannot keep this hidden, and trying to keep it hidden will cause you additional problems with immigration as they will see you as not being honest on the I-129F, which you have to sign "under penalty of perjury,"  and potentially with your fiancee if she finds out that you are hiding this from her.  If you are innocent of the false charges, you have nothing to hide and nothing to fear.  Just tell USCIS on the I-129F, attach supporting documents from the court showing that it was dismissed, and tell your fiancee.  Good luck and I hope this all works out for you in the end.

Why are you so hung up on this if it's was proven that you are innocent? And yes, your future wife should know about it because it might come up at the interview and the visa might be denied if she doesn't know about it.... Why?

 

Immigration is a double edged sword. They are protecting you from scammers and such and also they are protecting the immigrant from getting into an abusive situation where they can be harmed by the USC.

Good luck suing the government. If you can't answer a simple question then a lawsuit will go no where. I kind of hope she finds out so you have to explain why you are so hard headed and can't get married to her now

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It’s not being used “against” you. The sooner you realize that, the better.

I think a lot of people provided you information and links to other threads where members told their stories about missing out declaring arrests.

You are a grown up, you can make your own decision based on the answers you got.

 

Sometimes it is unfortunate that this might happen that somebody is wrongly charged, but you were not convicted base don what you said.
