Good point, especially as they can’t work for months yet, and most health insurance plans don’t cover parents.

Timeline

Many plans do not cover spouses, I have only once come across somebody who said their plan did, many years ago and I was doubtful.

Weren't I-130 petitions already approved for them in 2013?

Just send photocopies of the I-130 approval notices with the I-485 packets to the Chicago Lockbox: https://www.uscis.gov/i-485-addresses

 

If you lost the I-130 approval notices then you can first file 2 I-824 forms: https://www.uscis.gov/i-824

my health insurance covered my spouse before he even arrived in USA :) but that was only because he already had an ITIN number for him.

To get back to the question, I’m wondering if there was an issue at the medical or interview that caused the original applications to be denied? Something that forms part of an immigrant visa process but not the tourist visa process. If so, the issue needs to be fixed as it will only re-surface during AOS

Actually we abandoned the original applications so her parents could stay and take care of her grandmother who eventually passed away. We have sent an email to NVC to see if we can reopen their cases. I will let you all know what the outcome is. 

 

There are are a lot of concerns on my end about health insurance etc... That’s why I’m trying to gather info. What is the time frame from green card to adjustment of status?

Would have been helpful if this had been revealed in the original post. As it stands, your original post implies that no petition has been filed for them and people therefore (correctly) advised you to start with the I-130

and concurrent AOS filing. But it transpires they already have approved I-130s so you would have wasted your money filing those again.  An approved I-130 doesn’t expire. The NVC case has an expiration date, however. 

 

To get good information out, you need to put good information in. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

Seems that the OP has not considered the Health Insurance issue, well that is the impression I have, I would start with how practical this plan is first before filing anything.

Nothing prevents an IO, at the time of green card interview — should one be required, from re-evaluating intent and making a decision based on that. However, coming here with non-immigrant intent, having a change of heart while already in the U.S. and seeking permanent residence is quite common and should not pose any issues.

We received a response to reopening the cases. Since they are over 1 yr old, they can not be reopened. 

 

So my wife wants to refile. Is she able to apply for Adjustment of Status at the same time as filing the I-130? If so it would be appreciated if you have info on how to do that. 

 

Also, when would her parents be able to attain work authorization?
