Depends if they are visiting the child or acting as a babysitter or caretaker. People have been both denied a visa and denied entry with a visa due to this.

Unfortunately, this is not 100% accurate. When it comes to immigration in the US, childcare/babysitting, even if it is a relative, can be considered work. We have been on this site long enough to see it happen. We saw people have been denied entry/ loss of visa because of childcare of a relative. In the eyes o the US government, it can be considered work.

 

I know it is hard  to believe. There were a lot of things that I couldn't believe were so draconian before needing to learn about immigration. There are some harsh truths about this process that will seem unfair. But ultimate goal is to endure so that you can be united with your loved one(s).

 

Just to clarify... there is a difference between a grandparent being around and helping out by watching the child(ren) while the parents run errands and such. As opposed to a grandparent babysitting the child during work hours everyday. On a visitor visa, it is expected the grandparents do the former rather than the latter.

The issue of child care and a B visa in the US boils down to the fact that, if a grandparent is coming over to take care of a grandchild on a part-time or full-time basis, that it is taking away child care work from an American or LPR who is authorized in the US to do said work, and visitor visas are not for any type of work that could instead be done by an American or LPR for money in the market economy...according to the government, child care falls under that category, hence nobody is allowed to do it on a B, not even relatives or grandparents.

 

So, in a sense, it's about trying to protect American workers and also ensure that no "work" is done by those on B visitor visas, not about keeping grandparents away from their grandkids. Unfortunately B visas are regularly abused when it comes to unauthorized work, hence the draconian rules around obtaining one.

I haven't gone thru all the posts yet, but I'm still spinning around in my head how some senator got a mother in law who was denied a tourist visa because she was obviously coming here to provide child care, so come to the US to work on a tourist visa, but he got it approved? I need that guys phone number, I've got a pending AOS I could use a fast track on.

Here on a K1? Need married and a Certificate in hand within a few hours? I'm here to help. Come to Vegas and I'll marry you Vegas style!!   Visa Journey members are always FREE for my services. You understand that a parent of a US citizen is eligible for a GC and able to move here and do the exact same thing. There is literally $400 difference in the application fee and loger wait but ultimately leads to the same thing. If people plan it early enough they can have grandma here permanently watching the kids. Do all American grandparents get paid for watching their grandkids when parents work or travel? Don’t think so!

Often not practical, Parents have to be sponsored and the big issue is Health care, not many are rich enough to see out their lives in the US.

 

I have seen quite a few posts from people who want to bring over young family members, to provide child care etc dueto the major cost differential, no practical way.

That's the difference between watching grandkids as an American or a GC holder.. which is legal. 

Watching grandkids on a b2 visa could be construed as illegal work.. which is illegal on a B2 visa.

I am glad you find the issue funny! If you were not aware you can contact your local political leaders and ask for help with federal agencies. They have interns in their offices who’s only job is to respond to the people in their region and help them. If you are truly  mistreated they will help you. Huge delay in an AOS case past processing time is a way be to be mistreated.

A huge delay in AOS is one thing and certainly something a senator is able to help with. A consular decision is something else entirely. Did you look uo the principle of consular nonreviewability as I suggested earlier? The law is actually specifically written so as to prevent a lawmaker within the US affecting a decision made by a consulate outside the US.

You're comparing a USCIS decision to adjudicate an application for a benefit in the US versus that of a consulate issuing a visa. Night and day.
