K1 accepted. Married before the visa. Will it be K3?

My wife and I applied for our K1 visa in November 2017, we applied late but were hopeful that we could get our K1 all done by June 1st ( which was our already arranged and announced marrage date.) anyway on June 2nd we received our K1 NOA 2... 

 

I'm aware they have essentially done away with K3 visa, however if we were applying for Cr1/Ir1 visa now, would we be eligible for K3 through previously filing an I-129f or are we just on the regular old Cr1/Ir1 train. 

 

I hope this makes sense?

Nope. Regular I-130 processing. Best to withdraw I-129f petition.

Nope. You should have rescheduled the wedding.

Now you need to start CR1 from a scratch. You just wasted time with K1...

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Never ever make any plans until she has her visa in her hands.

CR1 takes 12 to 14 months.

ROC Timeline

08/16/19: sent I-751 packet to USCIS Lockbox in Dallas

08/19/19: packet received by USCIS

08/21/19: received text message with case number ( Texas Service Center)

08/23/19: check got chashed

08/26/19: received extension letter in the mail

11/14/19: Biometrics appointment

04/28/20: case got transferred to my local field office in Atlanta

05/28/20: New Card Is Being Produced

05/29/20: New Card Got Approved

06/02/20: We Mailed Your New Card

06/03/20: The Post Office Picked Up Your New Card

06/04/20: Card Was Delivered To Me By The Post Office

K3 is not even being given out anymore really. Even if it were, you can't use an old petition for a new visa. Like others have said you'll have to withdraw the K1 petition (if you don't withdraw it there will be issues later because now you are no longer eligible for a K1) and file a new I-130 petition for a CR1 visa.

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

You need to cancel the I-129f since you are now married and ineligible for a K1.  The I-129f will not get you a K3.

 

You need to start over with an I-130 for a CR1 spousal visa.  Regular train like everyone else - no special consideration for previously having filed an I-129f.

The only advantage will be that the beneficiary has an "A Number" now.  That may have a little impact but I doubt if it will speed things up too much.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
